HomeMy WebLinkAbout1984-OR-65 ORDINANCE NO. 84-OR-65 AN ORDINANCE DESIGNATING WEIGHT LIMITS ON CERTAIN STREETS AND ALLEYS WITHIN THE CITY. W~EREAS, it has come to the attention of the Common Council of the City of je[fersonville, Indiana, that certain of the City's streets and alleys are deteriorating as a result of the heavy loads crossing them and that the City's sewers are being damaged; and WHEREAS, the City may provide for restrictions on the weight of vehicles traveling on its streets, alleys and drives. SECTION ONE NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of jeffersonville, Indiana, that it shall be a violation of this ordinance for any vehicle having a gross weight in excess of five (5) tons to travel upon or across the following streets, alleys, drives or any portion thereof unless a permit is obtained pursuant to the provisions of this Ordinance: Plaza Drive Locust Street between Seventh Street and Eleventh Street 3. Illinois Avenue 4. Larkspur Drive 5. East Larkspur Drive 6. North Larkspur Drive 7. Briscoe Drive 8. Virgin Alley 9. Strawberry Lane ~ · _ e _3 .t et The unnamed alley which runs behind Station One of Fire Department between Seventh Street and Ninth Street SECTION TWO BE IT FURTHER ORDAINED, that the Board of Public works and Safety is hereby authorized to erect such signs as are necessary for the enforcement of this Ordinance. The Board of Public Works and Safety shall also determzne such alternative routes as may be necessary to allow access to Industrial or Business cites Located in the City. The ~d of__~lic Wv~,~ is also empowered to grant permits for travel upon the streets and alleys set this Ordinance, provided that the ~~.]~~ forth in Section One of 'permiit lndiqidual requesting such can demo nstrate to the oe--r~r~ ,,v~o ........ ~ that access to a particular location cannot be made without use of the restricted street or alley and that such individual provides the body with a bond in an appropriate amount. SECTION THREE If any vehicle is driven in violation of this ordinance and the owner of the vehicle or the person in whose name the vehicle is titled shall be some one other than the driver, then the person who is the owner or the person in whose name shall be held prima facie responsible the vehicle is registered for the violation. SECTION FOUR Any person receiving a citation as a result of a violation of any of the provisions of this Ordinance shall pay an assess- men~ of twenty-five dollars ($25.001 (except as herein provided) if paid within seventy-two (72) hours to the Clerk-Treasurer of the City of jeffersonville, whose office is located at Room 421, City-County Building in Jeffersonville, Indiana. In the event that any person who is charged with a violation hereunder fails to pay as above-provided, such person shall be charged in City Court and upon conviction shall be fined not less than twenty-five dollars ($25.00) nor more than five hundred dollars ($500.00). SECTION FIVE Any Ordinance or part thereof in conflict with this Ordinance is hereby repealed. SECTION SIX If any part of this Ordinance is determined to be invalid by a court of competent jurisdiction, all valid parts which are severable from the invalid parts shall remain in effect. If a part of this Ordinance is invalid in one or more of its applications, any other application which is severable shall remain in effect. SECTION SEVEN This ordinance shall be in full force and effect from and after its passage by the Common Council, approval by the Mayor and due publication as required by law.
