ORDINANCE NO- 84-OR~ An Ordinance Authorizing the Conveyance of a Certain Tract of Land Within the jeffersonvllle Research and Industrial Park to Mark J. Strobel. WHEREAS, Mark J. Strobel desires to purchase a 2.2062 acre tract, being part of Survey No. 19, located in jeffersonvllle Research and Industrial Park, being hereinafter more particularly described; and WHEREAS, that legal title to said real estate is vested mn the name of the City of jeffersonville; and WHEREAS, the sum of $35,271.00 is the full sales price for said rea] estate and said amount is being paid to the Citizens Bank and ~rust Company, as holder of a note and real estate mortgage Indenture of Trust, dated the 1st day of November, 1975, and executed by the City of jeffersonvi]]e, Indiana, recorded in Mortgage Drawer 7, Instrument 11251, by S & T Industries, Inc., and said principal balance of said for said conveyance; and WHEREAS, said S & T in the property pursuant amount is to be credited on the note and being the full consideration Industries, Inc., which has an interest to a lease agreement with the City, and said S & T Industries, Inc. desires that the City convey the property to Mark J. Strobel, and the City Council having considered such request and concluded that it is in the best interest of the City, and upon the above terms. THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL, that it hereby authorizes the execution of a deed by the Mayor and Clerk-Treasurer of the C~ty to Mark J. Strobel and the execution of any and all other documents required for the transfer of said property set forth below. Said property being located in Clark County, State of Indiana, and described more specifically as ~ollows: Being a 2.2062 acre part of Survey No. 19 of the Illinois Grant and being a part of a 165.9499 acre tract of land known as the Jeffersonville Research and Industrial Park, and being a part of an 86.00 acre tract of land heretofore conveyed to The Civil City of jeffersonville, Indiana, by a deed recorded in Deed Drawer No. 7, Instrument No. 11250 of the Clark County, Indiana, Records, situated in jeffersonvllle Township, Clark County, Indiana, and being more fully described as follows, to-wit: Commencing at an old stone marked with a cross, 12 inches under the pavement of the New A]bany-Charlestown Road, designated as Stone "A" in the Clark County Surveyor's Record Book "D", Pages 240 and 241, said stone being in the center of the New Albany-Charlestown Road and at a corner common to Surveys No. 19 and No. 20, and on the southeasterly line of Survey No. 32 of th Illinois Grant; thence from said stone, ~ 05" South 35 49' East, measured from true meridian along the line dividing said Surveys 19 and 20, a distance of 464.47 feet to a one and one-eighth inch steel pin at the easterly corner of a 0.78 of an acre parcel of land heretofore con'veyed ~o the P.C.C. & St. L. Railroad, by a deed as recorded in Deed Record 138, Page 391 of said Clark County Records; thence South 22© 30' 25" West along the southeasterly line of said 0.78 acre parcel of land and along the northwesterly linen of said 165.9499 acre tract of land, 429.53 feet 5o a one and one-eighth inch s~eel pin on the easterly line of the original 60 foot right-of-way of the P.C.C. & St. L. Railroad; thence South 0° 48' 00" West along the east line of said 60 foot right-of-way and along the west line of said 165.9499 acre tract of land, 1743.07 feet to a98ne andd one-eighth inch steel pin; thence South 8 12' 00" East, 30.00 feet to a one and one-eighth ~nch steel pin; thence continuing South C 48 00 West along the west line of said 165.9499 acre tract of land, 761.58 feet to an iron pin, the true place of beginning of land to be herein described: Thence south 89© 12' 00" East, 310.00 feet to an iron pin on the westerly right of way line o~ Industrial Parkway (50 foot R/W); thence South 0© 48' 00" West along said westerly line, 310.00 feet to an iron pin; thence North 89u 12' 0h" west, 310.00 feet to an iron pin; thence North 0v 48' 00" East, 310.00 feet to the place of beginning and containing 2.2062 acres o~ land. Subject, however, to a 7.5 foot wide Drainage and Public Utility Easement along the northerly and southerly line and a 50 foot wide Sanitary Sewer Drainage and Public utility Easement along the westerly line of the hereinabove described 2.2062 acre parcel of land. Subject, further, to all easements and restrictions of record affecting said real estate. This Ordinance shall be in full force and effect from and after its passage and approval.
