HomeMy WebLinkAbout1984-OR-08ORDINANCE NO. 84-0R- ~ AN ORDINANCE regulating the construction, alteration, repair, location and use of buildings and structures in the City of Jeffersonville, Indiana; providing for the issuance of permits therefor; providing penalties for the violation thereof; and repealing all ordinances and parts of ordinances in conflict therewith. BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, CLARK COUNTY, INDIANA, AS FOLLOWS: SECTION 1. TITLE. This ordinance, and all ordinances supplemental or amendatory hereto, shall be known as the "Building Code of the City of Jeffersonville, Indiana, may be cited as such, and will be referred to herein as "this code". SECTION 2. PURPOSE. The purpose of this'Code is to provide minimum standards for the protection of life, health, environment, public safety and welfare, '~!~:~t and for the conservation of energy in the design and construction of buildings and structures. SECTION 3~ AUTHORITY. The Building Commissioner is hereby authorized and directed to administer and enforce all of the provisions of this Code. Whenever in the building regulations, it is provided that anything must be done to the approval of or subject to the direction of the Building Commissioner or any other officer of the department, this shall be construed to give such officer only the discretion of determining whether the rules and standards established by ordinance have been complied with; . and no such provision shall be construed as giving any officer discretionary powers as to what such regulations, codes, or standards shall be, or power to require conditions not prescribed by ordinances or to enforce ordinance provisions in an arbitrary or discriminatory manner. SECTION 4. SCOPE. The provisions of this Code apply to the construction, alter- ation, repair, use, occupancy, maintenance and additions to all buildings and structures, other than fences, in the City of jeffersonville. SECTION 5. ADOPTION OF REGULATIONS BY REFERENCE. A. The following rules, regulations and codes a~e hereby adopted by reference as the rules and regulations governing the construction and alteration of buildings and structures in the City of Jeffersonville, Indiana. (i) Construction Rules and Regulations, Volume I, 1980 Edition of the State of Indiana (660 IAC 1-1.i) originally published as (3 IR 2148) which identifies, amends and incorporates therein the Uniform Building Code, 1979 Edition, and the Uniform Building Code Standards, 1979 Edition. (2) Indiana Electrical Rules, 1981 Edition (660 IAC 7) originally published as (4 IR 798) which identifies, amends and incorporates therein the National Electrical Code, 1981 Edition. (3) Indiana Plumbing Rules, 1981 Edition, (660 IAC 9) originally published as (4 IR 2398) which identifies, amends and incorporates therein the Uniform Plumbing Code, 1979 Edition. (4) Indiana Mechanical Rules, 1981 Edition, (660 IAC 8) originally published as (4 IR 1828) which identifies, amends and incorporates therein the Uniform Mechanical Code, 1979 Edition. (5) One and Two Family Dwelling Code of Indiana, (660 IAC 3-1) originally published as (4 IR 916) which identifies, amends and incorporates therein the One and Two Family Dwelling Code, 1979 Edition. (6) Indiana Energy Conservation Rules and Regulations for New Building Construction, Volume V, 1979 Edition. (660 IAC 4) (1980 Supp.) published under that title. -1- (7) Indiana Swimming Pool Rules 1982 Edition (660 IAC 5-2), published originally as (5 IR 1829) under that title. (8) Indiana Standard for the Permanent Installation of Manufactured Homes, (660 IAC 3-2) originally published as (6 IR 1729) under that title. B. Copies of this code and rules, regulations, and codes adopted herein by reference are on file as required by law in the office of the jeffersonville Clerk-Treasurer. SECTION 6. APPLICATION FOR PERMITS. No permits shall be issued for the foregoing purposes, unless the application for such permit is accompanied by a plat or sketch of the proposed location showing lot boundaries, and by plans and specifications showing the work to be done. All plans for building construction under the authority of the Administrative Building Council of the State of Indiana must also be filed with said Council. No local permits shall be issued hereunder until a copy of a Release for Construction from the State Building Commissioner is received by the Building Commissioner. SECTION 7. PERMIT REQUIRED. A permit shall be obtained before beginning construction, alteration or repair of any building or structure, using forms furnished by the Building Commissioner. All permits shall be issued by the Building Commissioner, and all fees provided for herein shall be paid to the jeffersonville Clerk-Treasurer. SECTION 8. OTHER ORDINANCES. All work done under any permit issued hereunder shall be in full compliance with all other ordinances pertaining thereto, and in addition to the fees for permits hereinafter provided for, there shall be paid the fees prescribed in such ordinances. SECTION 9. LICENSING AND REGISTRATION. Section A Structural Licenses and Registration A.1 Commercial General Contractor License Any person, firm or corporation who engages in the erection of all new structures or all new additions to existing structures and all remodeling, repair, and demolition of existing structures shall be required to obtain a license from the Department in order to engage in such activities. (This license permits all construction activities permitted by A.3, A.5 and A.6 below). This license provision is divided into categories enumerated below. Dollar amounts refer to the general contract amount, excluding electrical or mechanical portions of contract. A.2 Contractor License Categories: A.l.a Contractors doing construction from S0.00 to and including $50,000.00 A.l.b Contractors doing construction from $50,000.00 to and including $250,000.00 A.l.c Contractors doing construction from S250,000.00 to and including S500,O00.O0 A.l.d Contractors doing work without regard to any specific dollar limitation Commercial Construction Superintendent License Contractors will, at the time application is made for a building permit, file with the Building Department the name of the individual who will be the responsible person for supervision of the project, for which the permit is being applied. Any individual who engages in or who supervises the work of commercial construction shall be required to be licensed with the Depart- ment in order to engage in such activities. Any individual who makes applica- tion for such license must have worked for a period of four (4) years (as a foreman, journeyman or equivalent, in the same line of work for which he is seeking license): Evidence of work to be furnished by licensed or recognized contractor for whom he has worked and the applicant is required to take an examination and obtain a passing grade of 70%. The Supermntendent license categories are listed below for which cards will be issued. -2- A.3 A.4 A.5 A.6 License Categories: A.2.a Superintendents for contractors holding A.l.a license A.2.b Superintendents for contractors holding A.l.b license A.2.c Superintendents for contractors holding A.l.c license A.2.d Superintendents for contractors holding A.l.d license Residential Contractor License (up to and including three (3) stories) Any person, firm, or corporation who engages in the erection of new residential structures or new additions to existing structures; and remodeling, repair and demolition of residential structures, shall be required to obtain a license from the Department in order to engage in such activities. (This license permits ail construction activities permitted by A.5 and A.6 below, as to residential structures only~) Residential Construction Superintendent License Any individual whoengages in or supervises the work of residential construction (up to and including three (3) stories) shall be required to be licensed with the Building Department. Any individual seeking such license must have worked for a period of at least four (4) years as a foreman or journeyman in the same line of work for which he is seeking license: Evidence of work to be furnished by licensed or recognized contractor for whom he has worked and the applicant is required to take an examination and obtain a passing grade of 70%. Home Improvement Contractor License Any person, firm or corporation who engages in the improving, remodeling, and repair of existing one and two-family structures shall be required to obtain a license from the Department in order to engage in such activities. Any individual who makes applmcatzo for above license must have worked for a period of at least two (2) years as a journeyman for a recognized building contractor: Evidence of work to be furnished by licensed or recognized contractor for whom he has worked. This license permits all activities pertaining only to the improving, remodeling and repair of one and two-family structures, additions not included. Re- modeling jobs are jobs which do not add square footage in floor area to a building. This license will permit the construction of unattached garages and accessory buildings. Contractor Registration Any person, firm or corporation, including but not limited to the following enumerated trades and activities as a contractor or who engages in any subsidiary or ancillary construction as a sub-contractor to a General Contractor Licensee, a Residential Contractor Licensee, or Home Improvement Licensee shall be required to register with the Department in order to engage in such activities. The Department shall designate on the registration form issued to the registrant those activities in which the subsidiary contractor registrant may engage. However, registration under this category is in no way to be interpreted as to include any person, firm or corporation who contracts and engages in any activity which is not directly related to the building, remodeling, or repairing of a structure, Registration categories are as follows: A.6.a Concrete A.6.b Masonry A.6.c Carpentry or frame A.6.d Steel Erecting A.6.e Roofing -3- A.6.f Drywalling, Plastering and Acoustical Tile Installation A.6.g Siding A.6.h A.6.i A.6.j Demolition Architectural Sheet Metal, Gutters, Flashings Miscellaneous work -- Tower Buildings, Swimming Pool, Lawn Sprinkler System, etc. All contractors who are not currently licensed and who are required to obtain licenses pursuant to Section 9 A (above) must secure the required licenses within ninety (90) days of effective date of this ordinance. SECTION B. Mechanical Licenses B.1 Electrical Licenses B.l.a Electrical Contractor's License Any person, firm, or corporation who engages mn electrical contracting, including the securing of permits for installation alterations, and repair of any electrical wiring devices, appliances, or equipment shall be required to obtain a license from the Department in order to engage in such activities, except as provided in B.2.a, B.2.b and B.3.a. Any licensee under this classification mush be either the holder of an Electrical Superivisor's License, as defined in Section B.l.b or B.l.c; or have in his employ one who holds an Electrical Supervisor's License as defined in B.l.b or B.l.c. Scope of work permitted licensee is determined by classification of Supervisor. B.l.b B.l.c Commercial Supervisor's License An individual who supervises the work and is responsible for installing, maintaining, altering or repairing electrical wiring, electrical devices, electrical appliances and electrical equip- ment while in the employ of an Electrical Contractor Licensee shall be required to obtain a license from the Department in order to engage in such activities- Any individual seeking such license must have worked for a period of at leas= four (4) years as a journeyman or foreman in the same line of work for which he is seeking a license. This license includes all activities permitted inB.l.c. One and Two_famil~Residential Electrical Su~visor's License An individual who supervises the work and is responsible for installing, maintaining, altering, or repairing one and two- family residential electrical wiring, electrical devices, electrical appliances, and electrical equipment while in the employ of an Electrical Contractor Licensee, shall be required to obtain a license from the Department in order to engage in such activities. Any individual who makes application for a One and Two-family Residential Supervisor's License must have worked for a period of five (5) years or equivalent as an electrician, one (1) year of which he must have been a journeyman, as defined in Section B.l.e below. -4- B.2 Plumbing Licensin8 and Registration B.2.a Sanitary Plumbing Registration Any person, firm or corporation who is licensed by the Indiana Plumbing Commission as a Plumbing Contractor in accordance with Public Law 188 of the Indiana Acts of 1972 as Amended, and who performs any work under said plumbing license shall be required to register with the Department in order to engage in such activities. Any registrant herein shall be permitted to install Power and control wiring as may be required for satisfactory performance of installed fossil fueled heat systems, and domestic water heaters, as set forth in paragraph B.2.a.1. B.2.a.1 Anyone who has license under B.2.a shall be permitted to make electrical connections and install control wiring as may be required for satisfactory performance of either new installa- tions or replacements of fossil fueled heating systems, heat pumps or domestic water heaters. Such work is restricted as follows: 1. Control wiring no restriction unless codes require it to be installed in metal raceway. In these cases, receway shall be installed by Electrical Contractor. 2. Circuit wiring may be completed from a disconnect located and rated to comply with applicable code. For new installations, circuit and disconnect will have been provided by Electrical Contractor. For replacement, connection may be made to existing circuit and disconnect provided rating of circuit conductors and disconnect are not exceeded, and location eomplies with applicable code. Licensee is not permitted to install service equipment, branch circuit, over current devices, nor resistance electric heat. Licensee shall clearly state on..~ach permit application for replacement or first-time installation at existing buildings who will do electrical portion of work: i.e. by licensee or others. B.2.b Non-Sanitary Plumbing License Any oerson, firm or corporation who engages in the installation, maiatenance, alteration or repair of pmpmng systems not specifically covered by the Sanitary Plumbing Code of the State of Indiana, ex- cluding fuel and refrigerant lines for heating and air conditioning, shall be required to obtain a license from the Department in order to engage in such activites. An examination shall be required of any license applicant in the following special Categories i, J, and k as defined below: Areas covered by non-sanitary licensing include but limited to the following special categories i, j and k. (a) Storm drainage (b) Underground tanks for fuel (c) Aboveground tanks for fu~l (d) Compressed air systems (e) Temperature controls (f) Sprinkler systems (g) Hydraulic systems (h) Gas piping systems (i) Refrigerant system - refrigerant system that is capable of maintaining a constant temperature below 60© Fahrenheit in a structure (j) Low pressure hot water and steam heating boilers and equipment (k) High pressure steam boiler --5-- RR- 1 Any person, firm or corporation holding a jeffersonville Heating, Air Conditioning, Refrigerant and Duct System License prior to 1982 will not be required to obtain a Non-Sanitary License for the following special Categories i, j and k as defined above. Any registrant herein shall be permitted to install power and control wiring as may be required for satisfactory performance of installed fossil fueled heat systems, and as set forth in paragraph B.2.b.1. B.2.b.l Anyone who has license under B.2.b shall be permitted to make electrical connections and install control wiring as may be required for satisfactory performance of either new installations or replacements of fossil fueled heating systems, heat pumps. Such work is retricted as follows: 1. Control wiring. No restriction unless codes require it be installed in metal raceway. In these cases raceway shall be installed by Electrical Contractor. 2. Circuit wiring may be completed from a disconnect located and rated to comply with applicable code. For new installations, circuit and disconnect will have been provided by Electrical Contractor. For replacement, connection may be made to existing circuit and disconnect provided rating of circuit conductors and disconnect are not exceeded, and location complies with applicable code. 3. Licensee is not permitted to install service equip- ment, branch circuit, over current devices, nor resistance electric heat. 4. Licensee shall clearly state on each permit applica- tion for replacement or first-time installation at existing buildings who will do electrical portion of work: i.e. by licensee or others. New fuel systems, except parts thereof confrolled and maintained by a public utility, shall conform to the requirements of this Chapter and shall not 'be made operative until first approved by the City of jeffersonville Building Department official. Natural Gas A. The following procedure shall apply to any installation requiring a new meter set and turn on. B. Meter to be connected to supply line only upon approval of the Jeffersonville Building Department. Approval to be given to the proper department of serving gas supplier by phone and confirmed in writing. C. Fuel supply line to bear inspector's tag as having met the following requirements: 1. All welded pipes to be tested at 60 PSI for 30 minutes. 2. Threaded line 1~" or larger to be tested at 30 PSI for 15 minutes. 3. Threaded line 1¼" or smaller to be tested at 10 PSI for 15 minutes. D. Fuel lines to extend outward from building from 4-6 inches. E. All testing to be completed in the presence of a City of jeffersonville Building Department official. F. Inspection to be made within two (2) days after request from contractor on a normal working day. G. Gas to be released to heating plant or water heater only if these bear an approval from a City of jeffersonville Inspector. Ail other gas burning appliances are excluded. H. UNDER NO CIRCUMSTANCES IS THE METER LOCKING DEVICE TO BE REMOVED OR GAS INITIALLY RELEASED BY OTHER THAN EMPLOYEES OF SERVICE GAS SUPPLIER. I. Upon gas release the employee may light pilot, ignite main burner, check for proper ignition, adjust flame air control, then shut down the unit by closing both the hand valve and automatic valve serving each unit. It shall be the responsibility of the Heating Contractor to put the heating unit into service, verify the safety and performance of each control, part and overall operation. -6- Liquid Petroleum Gas A. New line installations shall conform to regulations as set out for natural gas. Continuous roll copper tubing ~" or smaller is exempt except if concealed within a building or buried underground. ~iquid Fuel A. No testing of lines carrying liquid fuel shall be demanded unless buried underground. If buried they shall comply with Section M-1921 of Indiana State Building Code covering one and two-family dwellings or in accordance with requirements of UMC Standard Number 5-1. B.3 Temporary Heat - Warm Air A. Warm air heating plant shall not be put into operation without having the return air system completely connected to heating unit or, when applicable, installed under ANSI Regulation A83.7, as approved October 17, 1974. Heating~ Air Conditioning~ Refrigerant and Duct System Licenses B.3.s Heating, Air Conditioning, Refrigerant and Duct Syste~ Contractor's License Any person, firm or corporation who contracts for the servicing and installation of heating, air conditioning, refrigerant and duct systems in any structure shall be required to obtain a license from the Department. Any licensee under this classifica- tion must be either the holder of a Heating, Air Conditioning, Refrigerant and Duct System Supervisor's License, in the category or categories as enumerated below, or have in his employ a holder of Heating, Air Conditioning, Refrigerant and Duct System Supervisor's License, as set forth in Section B.3.b below. In order to engage in any activity or activities for which said supervisors must be qualified within a specific licenses category. Any registrant herein shall be permitted to install power and control wiring as may be required for satisfactory performance of installed electric air conditioning, fossil fueled heat systems, as set forth in paragraph B.3.a.1. B.3.a.l Anyone who has license under B.3.a shall be permitted to make electrical connections and install control wiring as may be required for satisfactory performance of either new installations or replacements of electric air conditioning, fossil fueled heating systems, heat pumps. Such work is restricted as follows: 1. Control Wiring-No restriction unless codes require it be installed in metal raceway. In these cases, raceway shall be installed by Electrical Contractor. 2. Circuit wiring may be completed from a disconnect located and rated to comply with applicable code. For new installations, circuit and disconnect will have been provided by Electrical Contractor. For replacement, connection may be made to existing circuit and disconnect provided rating of circuit conductors and disconnect are not exceeded, and location complies with applicable code. 3. Licensee is not permitted to install service equipment, branch circuit, over current devices, nor resistance electric heat. 4. Licensee shall clearly state on each permit applica- tion for replacement or first-time installation at existing buildings who will do electrical portion of work: i.e. by Licensee or others. B.3.b Heating, Air Conditioning, Refriserant and Duct System Supervisor's License Any individualwho supervises the work of installing, maintaining, altering, or repairing heating, air conditioning, Refrigerant and duct systems equipment, appurtenances and accessories while in the employ of a Heating, Air Conditioning, Refrigerant and Duct System Contractor Licensee shall be required to obtain a license from the Department. A Supervisor must be qualified to act in a supervisory capacity in the respective category or categories for which he is licensed and must have worked for a period of five (5) years or equivalent for a B.3.a Contractor, one (i) year of which he must have been a Journeyman, as defined in B.3.c below, in order to engage in such activities in a certain category or categories. A Supervisor's License will be issued in any one or a combination of the following categories: Category A - Heating and air conditioning systems having a heating capacity of 360,000 BTU or less, and a cooling capacity of 120,000 BTU or less, including fuel and refrigerant lines required (including, but not limited to electric, gas or oil fired furnaces and duct heaters) that do not utilize a high pressure steam boiler. Category B - Heating and air conditioning systems having a heating capacity of 1,800,000 BTU or less, and a cooling capacity of 600,000 BTU or less, including fuel and refrigerant lines required (including but not limited to electric, gas or oil fired furnaces and duct heaters) that do not utilize a high pressure steam boiler. Category C - Heating and air conditioning systems together with refrigerant and fuel lines required, without regard to any BTU limitations. Category D - Duct System License (a): low pressure duct systems with velocities of 2,000 FMP, duct static pressure to 2 inches of W.C. and transporting no more than 4,000 CFM. Category E - Duct Systems License (b): Installs, services, maintains, alters or repairs any medium and high pressure duct system as defined by ASHRAE Guide, without restrictions as to CFM. Installs, services, maintains, alters, or repairs exhaust systems, blow pipe systems, dust collector systems, and other specialty fields not specifically mentioned herein. SECTION C C.1 Category F - Start up service, or maintain gas burners, oil burners, stokers, air conditioning, etc. Category G - Electric air conditioning for systems with a cooling capacity up to and including 120,000 BTU. Si~n License Category "~' Si~n Contractor Any person, firm or corporation who engages in the erection, placing, painting or repainting, repairing, enlarging, moving or maintenance on or off premises, exterior signs or displays used for advertising, pro- motion or public notice purposes shall be required to obtain a license to engage in such activities. This category shall include, but not be limited to permanent, portable, mobile trailer signs, electric and non-electric signs, and make electric hookup to existing service out- side of building. This License permits in addition to the above activities those listed in C.2 C.3 below. Any person making application for a Category A Sign Contractor License shall have forty-eight (48) -8- C.2 C.3 months' experience in the construction and installation of signs with a qualified Sign Contractor, or have in his employment a full-time employee with forty-eight (48) months' experience in the construction and installation of signs with a qualified Sign Contractor. Category "B" Sign Contractor License Any Person, firm or corporation who engages in the erection, maintenance, painting or repainting of non-electric, on or off premises, exterior signs of not more than 100 square fee and not overhanging public property, shall be required to obtain a license to engage in such activities. This license permits in addition to the above activities those listed in Category C.3 below. Any person making application for Category B Sign Contractor License shall have thirty-six (36) months' experience in the construction and installation of signs with a qualified Sign Contractor, or have in his employment a full-time employee with thirty-six (36) months' experience in the construction and installation of signs with s qualified Sign Contractor. C.4 Category "C" Si~n Contractor License Any person, firm or corporation who engages in the exterior display of mobile trailer signs, portable signs, projection screens for adver- tising purposes shall be required to obtain a license to engage in such activities. Any person making application for a Category C Sign Contractor License must satisfy the Building Commissioner that the display which the applicant will be placing, installing, or showing will meet all wind-load requirements of local, state and national regulations and that if the display contains lighting or electrical devices, they will conform to local and national electrical codes. No sign license issued under this ordinance shall be transferable, unless the transferee shall meet all the requirements of this ordinance. If the transferee is a corporation, said corporation shall furnish to the Building Co~m~issioner an affidavit that its principal stockholder, operation or plant manager or superintendenn meets all the requirements of this ordinance. Installation or erection of architectural letters or numerals are exempt from above categories. Any person, firm or corporation holding an active Commercial General Contractor's License is exempt from Categories A, B, and C above when constructing, erecting or installing building mounted identification signs or a freestanding building identification sign (building identification signage means the principal name andfor address of the building) with letters or numerals of materials which are normally part of the bid documents as issued by an architectural/engineering firm for any new project. This work shall be part of the work historically performed by the general contractor and no extra permits will be required. WAIVER OF EXAMINATION - Si~n Contractors A license applicant shall be issued a license by the Department without requiring an examination for the issuance thereof, if said applicant shows to the satisfaction of the Department he was actively engage~ as a Sign Contractor, said applicant providing sufficient evidence that he engaged actively as a Sign Contractor for a period of one (1) year prior to ordinance effective date. The waiver period shall extend to and include December 31, 1984,~fter which all license applicants shall be required to take an examination, without regard to the length of time they have been Sign Contractors. -9- SECTION D - Contractor Licensees All structural, electrical, mechanical and plumbing contractor licensees shall be required to have in their employ, an individual superintendent/ supervisor licensee or registrant, whichever is applicable in order to do work under any of any licensing or registration categories for which a superintendent/supervisor card shall be issued only to an individual. Such an individual superintendent/supervisor shall not be employed by more than one contractor at the same time. If an individual superintendent/ supervisor licensee or registrant, by virtue of whose license or registra- tion a contractor licensee is performing work, leaves the employ of such contractor, said contractor licensee shall notify the Building Department within five (5) days from the date of the termination of the employment of said individual superintendent/supervisor, after which~said contractor shall immediately employ another duly qualified person who will be responsible for the supervision of work being performed. Upon failure to employ such an individual, said contractor licensee shall not be per- mitted to continue work on the project if the performance of such work requires said individual superintendent/supervisor licensee or registrant. The person so named as the superintendent/supervisor of any job or project shall be on the site at all times when any work is being performed. This applies to, but is not limited to, apartment complexes, condominiums, and all commercial and industrial work. The Building Commissioner may waive this requirement in cases where he considers the job size and complexity to be such not to warrant this and where the supervisor is available to be on the project within one (1) hour notice to meet with representative of the Building Department. It is the responsibility of the superintendent/supervisor or registrant to be sure necessary permits have been obtained, that inspections are requested and made. SECTION E E.1 Examinations for Licenses Any person, firm or corporation applying for any license, except as hereinafter provided, shall be required to take an examination given by the Building Commissioner, with Board approval. E.l.a Time and Date of Examinations Examinations for license applicants shall be conducted not less than once every six (6) months, the time, date and place of the examination to be conveyed to license applicant at the time of his application. The Building Commissioner may conduct examinations at other times and from time to time if, in his opinion or the opinion of the Board, an examination is necessary to avoid the imposition of a hardship on a license applicant or applicants. E.l.b Examinations Examinations shall be standard in formand shall be prepared by the Building Commissioner or other individuals as designated by the Commissioner. E.l.c Examination Results The Commissioner may use the Chief Inspector of the examined trade involved, as well as all other individuals as the Commissioner feels may be required to make a fair, unbiased and impartial judgment of the results of the applicant's examination and the applicant's qualifications based upon his examination results. Applicant shall be notified of examination results within thirty (30) days and of his right to appeal within ten (10) days thereafter. E.l.d Hearing If a license applicant has been rejected by virtue of his examination results, applicant may appeal such rejection and -10- shall be entitled to a Hearing before the trade connnittee involved of the Board. A request for such Hearing must be made in writing within ten (10) days after receipt of notice of rejection by the applicant. The Board shall thereafter notify the applicant of its decision within a reasonable time after the hearing. E.l.e Examination Fee The Building Connnissioner, with Board approval, shall prescribe a reasonable examination fee to be paid by the license applicant, said fee to defray the cost of preparation.and conducting the grading of examinations. This fee may be changed from time to time as the Commissioner sees fit in order to defray the expenses as set forth herein. E.2 Expiration and Renewal of Licenses or Registrations Ail licenses or registrations, together with the renewal thereof, shall expire on the 31st day of December of each year. Thereafter, every licensee or registrant shall have the right, without further examination, to obtain a license of the same classification each calendar year after the issuance of said license or registration, upon the payment to the Jeffersonville Bulding Department o$ the prescribed annual license or registration fee. Whenever any license issued under the provisions of the codes administered by this Department and these Rules and Regulations has expired for a period of twelve (12) calendar months, the licensee must apply for a new license at initial license fee. E.3 Inactive License E.4 Any contractor licensee may elect to hold his license in an inactive status upon informing the Department and thereafter the inactive licensee shall be registered by the Department upon paymenn of an annual fee of $25.00. License issuance no persons or firms heretofore engaged in the following categories without examination; Commercial Contractor, Commercial Construction Superintendent, Residential Contractor, Residential Construction Superintendent, Home Improvement Contractor and Non Sanitary Plumbing Contractor. E.4.a Any person, firm or corporation that has contracted to do and has done work in the City of Jeffersonville at least one year prior to the effective date of this ordinance may be issued a license by the Building Commissioner without an examination. E.4.b Proof of having done business in the City of Jeffersonville one year prior to such date shall be by a showing that s work permit was issued by the Building Con~nissioner to such applicant an least one year prior to such effective date and by this evidence only. E.4.c The Building Commissioner shall inspect the work of any applicant receiving a license under this section as soon as possible and may thereafter require an examination as provided. -11- SECTION 10. FEES. Fees Paid to City Clerk. (1) Ail fees fQr permits required to be paid by any section in this Chapter, or elsewhere in this Code shall be paid to the City- Clerk when such permits are issued by him, with the approval thereof by the Building Commissioner. Permits covering the work to be performed are to be issued only to licensed permit applicants, provided however, that nothing in these Rules and Regulations shall be construed to prevent a person who owns and occupies a single or nwo-family residence from securing a permit to personally perform the work allowed by the permit, provided he shows to the satisfaction of the Building Commissioner that he has reasonable knowledge of such work and is capable of completing suc~ work. The area of two or more advertising displays, when their combined areas are less than the minimum for their class, shall not be added or included in one permit, but a seperate permit shall be taken for each such display. Each face shall be calculated in determining total fee. Any sign oradvertising display that shall be taken down temporarily from its fastenings or supports or replaced in any manner, shall be considered as a new sign or display, and an erection permit shall be required as for a new installation before such sign or Ail wiring for signs or advertmsm g display shall be re-erected. must be done in accordance with the provisions of the National Electric Code. Fees for Annual Inspectio.n_of Projectin~gns-' The owner, or person in charge or control of the maintenance of any projecting sign, over five square feet in area and under ten pounds in weight, or any such sign weighing less than ten pounds, shall pay an annual inspection fee for each and every sign in $ 10.00 place at the time such inspection is made. Fees and Annual Inspection of Signs and Advertising Displays other Than Pro.~ecting Sign{. An annual inspection fee shall be paid to the City Clerk by every person in possession, charge, or control of any kind of advertising display, other than projecting signs, as follows: B.5.f.1 Ground Sign boards over 25 square feet in 15.00 area overall 25.00 B.5.f.2 Roof Signs B.5.f.3 Wall bulletins, or wall signs, over 16 square feet in area overall, or of any area when 15.00 electrically illuminated. -18- B.5.g Periods Covered b~ Initial Fee and Annual Fee for all kinds of Advertisin Dis~:la's and Si. ns B.5.g.1 The fee chargeable and paid at the time of the issuance of a permit for the erection of any kind of advertising display, or sign, as provided for this Chapter, shall cover all charges for any such advertising display, or sign, for the remainder of the calendar year in which such permit is issued. The annual inspection fee for any kind of such advertising display, or sign, shall be due and payable on the first of January of the year next following the erection of any such advertising display or sign, but it shall not be delinquent until thirty days after such annual inspection is made and a written notice thereof is delivered or mailed to the person owning same. B.5.g.2 When any inspection fees shall be unpaid and delinquent, the person owing same or in control of the sign, shall be again notified in writing thereof and that unless paid within one week from the mailing of such notice, or its personal service, the Commissioner of Buildings, will cause such sign to be removed, at such person's expense. If so removed, no sign shall be replaced, without payment of all arrears due and also the new per- mit fees. B.5.g.3 A separate fee shall be paid for each and every kind of sign, or advertising display described in this Code. However, two or more such signs, or advertising displays, may be grouped on one inspection slip, and when the fees therefor shall be paid one tag may be issued for the entire group. No reinspection fee shall be required for signs painted on the walls of buildings. B.5.g.4 The permit fee for all public owned structures or structures owned or wholly occupied by religious or non-profit organizations shall be one-half the fee as stated in any section of this Chapter. B.6 Fees for Reinspection. Whenever so requested, or for any use, it becomes the duty of the Commissioner of Buildings, on his own motion, to reinspect, or cause to be reinspected, any building, structure, electrical circuit, machinery device, elevator, or apparatus or equipment for combustion, the owner, lessee or tenant, or person in possession or control thereof, or of the premises on or in which the same may be situated, shall pay in advance a fee of twenty five ($25.00) to the City Clerk, if he requests such reinspection; or he shall pay such fee within ten days after the delivery to him of a certificate certifying that such building, structure, electrical circuit, machinery or device, elevator, or apparatus or equip- ment for combustion has been reinspected, when it was not done at the request of such person. Unless the fee provided by subsection (1) of this section shall be paid as herein prescribed, no reinspection shall be made when so requested by any such person; or if not paid after reinspection on the motion of said Commissioner of Buildings and being billed therefor, as aforesaid, such charge may be either collected by suit, or be certified by said Commissioner of Buildings to the City Treasurer, who shall enter the same on the tax duplicate of the owner of such premises, to be a lien thereon and to be collected as taxes are collected. -19- Fees - Doubled - When Should any person, partnershiP, or any corporation begin work of any kind such as hereinbefore set forth, or for which a permit from the Bureau of Buildings is required by . ~ ordinance, without having secured the necessary permit therefor from the Bureau of Buildings either previous to, or during the day of commencement of any such work, or on the next succeeding day where such work is commenced on a Saturday or on a Sunday or a holiday he shall when subsequently securing such permit be required to pay double the fees hereinbefore provided for such permit, and shall be subject to all the penal provisions of this Code. B.6.b Continued violation. The continued violation of any provision of this ordinance shall be and constitute a serparte offense for each and every day such violation shall continue. B.6.c All inspections requested or required by the provisions of this Code for which the Fees are not stated, shall be a fee charge of $25.00 per inspection. B.6.d Delete Paragraphs # 4 and # 5 of Section 610 of Chapter 6 Electrical Rules and Regulations of Ordinance # 67-OR-3. B.6.e Delete Chapters 10-11-12 of Ordinance # 67-0R-3 and Ordinance # 70-OR-11 in their entirety. These Chapters are replaced by Section 9 of this Ordinance- SECTION 11. REVIEW OF APPLICATION. Prior to the issuance of any building permit hereunder, the Building Commissioner shall: (a) Review all building permit applications to determine full compliance with the provisions of this ordinance. (b) Review all building permit applications for new construction or substantial improvements to determine whether proposed building sites will be reasonably safe from flooding. (c) Review building permit applications for major repairs within the flood plain area having special flood hazards to determine that the proposed repair (1) uses construction materials and utility equipment that are resistant to flood damage, and (2) uses construction methods and practices that will minimize flood damage. (d) Review building permit applications for new construction or substantial improvements within the flood plain area having special flood hazards to assure that the proposed construction (including prefabricated and mobile homes) (i) is protected against flood damage, (2) is designed (or modified) and anchored to prevent flotation, collapse, or lateral movement of structure, flood damage, and (4) uses construction methods and practices that will minimize flood damage. SECTION 12. INSPECTIONS. After the issuance of any building permit hereunder, the Building Commissioner shall make, or shall cause to be made, such inspections of the work being done under such permit as are necessary to insure fullcompliance with the provisions of this ordinance and the terms of the permit. Reinspections of work found to be incomplete or not ready for inspection are subject to assessment of reinspection fees as prescribed in this Code. SECTION 13. ENTRY. Upon presentation of proper credentials, the Building Commissioner or his duly authorized representatives may enter at reasonable times any duty imposed upon him by this Code. -20- SECTION 14. STOP ORDER. Whenever any work is being done contrary to the provisions of ~his code, the Building Commissioner may order the work stopped by notice in writing served on any persons engaged in the doing or causing such work to be done, and any such persons shall forthwith stop such work until authorized by the Building Commissioner to proceed with the work. SECTION 15. CERTIFICATE OF OCCUPANCY. No certificate of occupancy for any building or structure erected, altered or repaired after the adoption of this ordinance shall be issued unless such building or structure was erected, altered or repaired in compliance with the provisions of this ordinance. SECTION 16. STANDARDS. Ail work on the construction, alteration and repair of buildings ~nd other structures shall be performed in a good and workmanlike manner according to accepted standards and practices in the trade. SECTION 17. VIOLATIONS.. It shall be unlawful for any person, firm or corporation, whether as owner, lessee, sub-lessee, or occupant, to erect, construct, enlarge, alter, repair, improve, remove, convert, demolish, equip, use, occupy or maintain any building or structure, other than fences, in the City of jeffersonville, or cause or permit the same to be done, contrary to or in violation of the provisions of this code. SECTION 18. RIGHT OF APPEAL. Ail persons shall have the right to appeal the Building Commissioner's decision first through the Board of public Works, and then to the Administrative Building Council of Indiana, in accordance with the provisions of IC 22-11-1-16 or IC 22-11-1-21.5 as applicable. SECTION 20. PENALTIES. If any person, firm or corporation shall violate any of the provisions of this ordinance, or shall do any act prohibited herein, or shall fail to perform any duty lawfully enjoined, within the time prescribed by the Building Commissioner, or shall fail, neglect or refuse to obey any lawful order given by the Building Commissioner in connection with the provisions of this ordinance, for each such violation, failure or refusal, such person, firm or corporation shall be fined in any sum eot less than $50.00 Dollars, nor more than $300.00 Dollars. Each day of such unlawful activity as is prohibited by the first sentence of this section shall constitute a serarate offense. In any case where a provision of this ordinance is SECTION 21. ~ENERAL. with a provision of any zoning, building, plumbing, found to be in conflict electrical, heating, ventilating, fire, or sazesy code of the City of jeffersonville, existing on the effective date of this ordinance, the provision which establishes the higher standard for the promotion and protection of health and safety of the people shall prevail. SECTION 22. REPEAL OF CONFLICTING ORDINANCES. This shall provide that all ordinances and parts of ordinances in conflict herewith are hereby repealed. -21- This Ordinance shall be in full force and effect from and after its passage and approval.
