Home My WebLink About1984-R-33 RESOLUTION NO. ~ RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA, AUTHORIZING THE FILING OF AN APPLICATION WITH THE INDIANA DEPARTMENT OF COMMERCE FOR AN URBAN ENTERPRISE ZONE DESIGNATION AND ESTABLISHING AN URBAN ENTERPRISE ASSOCIATION WHEREAS, it is the desire and intent of the State of Indiana to provide economic development incentives in designated target areas throughout the State. As a result of this desire, the 1983 Indiana General Assembly passed House Enrolled Act No. 1629 which provides for the creation of Enterprise Zones; and, ~" WHEREAS, the purpose of the Enterprise Zone would be twofold: First, to revitalize specific distressed geographic areas and secondly, to create jobs for zone residents. The Indiana strategy is to create a favorable climate for private sector investment and individual initiative which will expand the economic opportunities for residents of these zones. The program will nOt .Qnl]y fallow ~Indiana ~o ~take ,advantage offeder~ Enterprise Zone legislation incentives but also would stand alone regardless 9f the fate of the federal legislation. To date, six (6) Enterprise Zone areas have been designated in Indiana; and, WHEREAS, the 1984 Indiana General Assembly has;~sSe~il~egiSl~ati°h all°wing for four (4) additional sones to be designated in a competitive process with zone designations to be made by January 1, 1985; and, WHEREAS, on October 10, 1983, the Common Council of the City of jeffersonville through Resolution number 83R18 authorized the filing of an application for an Enterprise Zone designation and established an Enterprise Association to work in conjunction with this application; and, WHEREAS, the City's 1983/84 application for an Enterprise Zone designation was not approved thus rendering the establishmentofthe1983/84 Enterprise Association void; and, WHEREAS, the City of Jeffersonville plans to submit an application with the Indiana Department of commerce to declare a portion of the City as an Urban Enterprise Zone and will appoint a new Enterprise Association to work in conjunction with the 1984/85 zon~ designation area; and, WHEREAS, the Common Council of the City of Jeffersonville is aware of a possible tax shift because of the inventory tax abatement provisions of Act No. 1629 and the City's Zone application; and, WHEREAS, House Enrolled Act No. 1629 requires the creation of an Urban Enterprise Association which shall do the following: 1) Coordinate zone development activities; Serve as a catalyst for zone development; Promote the zone to outside groups and individuals; il Establish a formal line of communication with residents and businesses in the zone; and, 5) Act as a liaison between residents, businesses, the municipality and the Enterprise Zone Board for any development activity that may affect the zone or zone residents. In no case are provisions of IC 22-2-2-1 through 22-2-2-13 and IC 22-7-1-2 mitigated by the chapter of House Enrolled Act 1629 relating to the Enterprise Association; and, WHEREAS, the Urban Enterprise Association shall consist of eleven (11) members, each serving a four (4) year term, to be chosen as follows: 1) The Governor shall appoint the following: A) On~ (1) state legislator whose district includes all or part of the Enterprise ZOne, who is not a voting member of the Urban Enterprise Association; and, B) One (1) representative of the State Department of Commerce, who is not a voting member of the Urban Enterprise Association. 2) The executive of the municipality in which the zone is located shall appoint the following A) One (1) representative of the plan commission having jurisdiction over the zone, if any exists. B) One (1) representative of the municipality department that performs redevelopment, planning or economic development functions. re resentatives of businesses located in the zone, one (1) C) ~Ow~h s~all be from a manufacturing concern, if any exist in the zone. 3) D) One (1) resident of the zone. The legislative body of the municipality in which the zone is located shall appoint, by majority vote, the following: A) One (1) member of the municipality's legislative body whose district includes all or part of the zone. B) One (1) representative of a business located in the zone. C) Two (2) residents of the zone. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE that: Said Council approves the filing of an application with the Indiana Department of Commerce for an Urban Enterprise Zone designation as described in House Enrolled Act 1629; 2. That a copy of the Urban Enterprise Zone designation area map is attached as ATTACHMENT A: 3. That said Council and Mayor have agreed to appoint the required representatives to serve on the Urban Enterprise Association; and, The names of the representatives appointed to serve during the first term of the Urban Enterprise Association are attached to thi.s resolution as ATTACHMENT B. BE IT FURTHER RESOLVED that the Clerk-Treasurer of said City of Jeffersonville, Indiana, is hereby ordered and directed to give notice as provided by law. That he is the duly qualified and acting City Clerk-Treasurer of the City of Jeffersonville, Indiana, (hereinafter called the "Locality"), and the custodian of the records of the Locality, including the minutes of the proceedings of the Common Council of the City of Jeffersonville, Indiana, (hereinafter calleo the "Governing Body"). 2. All other requirements and proceedings under Law, the By-Laws, or otherwise, incident to the proper adoption of the Resolution of the Governing Body, including any publication, if required by Law, have been duly fulfilled, carried out, and otherwise observed. 5. If an impression of the seal has been affixed below, it constitutes the official seal of the Locality and this certificate is hereby executed under such official seal and was duly affixed by the undersigned at the time this certificate was signed.
