An Ordinance Authorizing the Conveyance of a
Certain Tract of Land within the
Jeffersonville Research and Industrial Park
to Austin and Davis Food Co., Inc.
WHEREAS, Austin and Davis Food Co., Inc. desires to purchase
a 0.1879 acre tract, being part of Survey No. 19, and a 2.8121
acre tract of Survey No. 20 located in jeffersonville Research
and Industrial Park, being hereinafter more particularly
described; and
WHEREAS, that legal title to said real estate is vested in
the name of the City of Jeffersonville; and
WHEREAS, the sum of $1.00 is the full sales price for said
real estate and said amount is due under an option to purchase
contained in a lease agreement dated November 1, 1974 between the
City as Landlord and Huber Supply Company (predecessor to Austin
and Davis Food Co., Inc.) which lease is recorded at
Miscellaneous Drawer 6, Instrument 11358 in the Recorder's Office
of Clark County, Indiana.
WHEREAS, the City Council having considered such request and
concluded that it is in the best interest of the City, and upon
the above terms.
THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL, that it
hereby authorizes the execution of a deed by the Mayor and Clerk-
Treasurer of the City to Austin and Davis Food Co., Inc. and the
execution of any and all other releases, bill of sales and other
documents required for the transfer of said property set forth
below. Said property being located in Clark County, State of
Indiana, and described more specifically as follows:
Being a 0.1879 acre part of Survey No. 19 and a 2.8121
acre part of Survey No. 20, all of the Illinois Grant
and being a part of a 165.9499 acre tract of land
heretofore conveyed by a deed recorded in Deed Drawer
No. 2, Instrument No. 1240 of the Clark County, Indiana
records, situated in Jeffersonville Township, Clark
County, Indiana, and more fully described as follows
to-wit:
Commencing at an old stone marked with a cross, 12
inches under the pavement of the New Albany-Charlestown
Road, designated as Stone "A" in the Clark County
Surveyors Record Book "D", pages 240 and 241. Said
stone being in the center of the New Albany-Charlestown
Road and at a corner common to Survey No. 19 and 20;
and on the southeasterly line of Survey No. 32 of the
Illinois Grant; thence from said stone, South 35° 49'
05" East, measured from true meridian along the line
dividing said Surveys 19 and 20, a distance of 464.47
feet to a one and one-eighth inch steel pin at the
easterly corner of an 0.78 of an acre parcel of land
heretofore conveyed to the P.C.C. & St. L. Railroad, by
deed recorded in Deed Record 138, page 391 of said
Clark County Records, and which is the most northerly
corner of the Grantor's land; thence continuing South
35° 49' 05" East along the line dividing said Surveys
No. 19 and 20, a distance of 514.18 feet to a one and
one-eighth inch steel pin at a corner to the land
heretofore conveyed to W.A.V.E. Inc., by a deed
recorded in Deed Record 135, page 543 of said records;
thence South 67° 46' 07" East along the southerly line
of the land of W.A.V.E. Inc., 454.89 feet to an iron
pipe, the True Place of Beginning of land to be herein
described:
Thence continuing South 67° 46' 07" East along the
southerly line of W.A.V.E. Inc., 293.48 feet to an iron
pipe; thence South 4° 14' 48" West, 422.86 feet to an
iron pipe on the northerly right of way line of
Fabricon Boulevard; thence North 85° 45' 12" West,
along said northerly line, 161.84 feet to a point on
the line dividing said Surveys 19 and 20; thence
continuing North 85° 45' 12" West along said northerly
line, 117.30 feet to an iron pipe; thence North 4° 14'
48" East, 139.47 feet to a point on the line dividing
said Surveys 19 and 20; thence continuing North 4° 14'
48" East, 374.01 feet to the place of beginning and
containing 3.0000 acres of land.
Subject, however, to a 7.5 foot wide utility and
drainage easement along the northly, westerly and
easterly lines of the above described 3.0000 acre
parcel of land
Subject to any and all easements and/or restrictions of
record affecting said real estate.
This Ordinance shall be in full force and effect from and
after its passage and approval.
