PRESENT(VIRTUAL): CALL TO ORDER Mayor Mike Moore called the meeting to order at 9:30 a.m. in the Mayor's Conference Room in City Hall. The meeting was held in person and streamed on the City's Website. Andy Crouch, and Rob Waiz, sat on the board. APPROVAL OF THE MINUTES: Andy Crouch made the motion to approve the minutes from June 3, 2026. Mr. Waiz seconded the motion; vote taken, motion passed, 3-0. APPROVAL OF PAYROLL: Rob Waiz made the motion to approve the payroll. Andy Crouch seconded the motion; vote taken, motion passed, 3-0. OLD BUSINESS: Hearing none. NEW BUSINESS: 1. Les Merkley—905 E. Court Avenue speed humps Before you today is the matter of speed humps being placed in Sassafras Alley by Johnny Link. On May 13, 2026 Street Department received complaint about speed humps placed in Sassafras Alley. May 14, 2026 Street Department removed speed humps and took to shop. May 15, 2026 Johnny Link came into the Street Department and met with Kevin Morlan, Street Commissioner. At that time Mr. Morlan explained to Mr. Link it was illegal to put traffic control devices on a city alley or street. Mr. Link said they had been there for about 5 years with no problems. Mr. Morlan told him he could not put them back out in alley, Mr. Link said well I probably will. May 19, 2026 was down in area of Sassafras Alley and noticed speed humps had been placed back out. May 20, 2026 Had crew remove them again and held per the request of City Attorney for hearing. May 21, 2026 Mr. Link contacted Street Department asking for speed humps, Mr. Morlan returned his call, and left voicemail that he needed to appear at BPW meeting on June 10, 2026 to discuss further, and letter will follow this voicemail. Indiana Code 36-9-6-15 states, City Works board may order the removal of any structure in a street, alley, or public place of the city. If the person maintaining the structure fails to remove it, the works board may remove it at the person's expense. Also, 2005-OR-40 prohibits the obstruction of public streets and right of way. And last, Indiana Code 35-44.1-2-13 Obstruction of traffic. A person who, with the intent of obstruct vehicular or pedestrian traffic, obstructs vehicular or pedestrian traffic commits obstruction of traffic, a Class B misdemeanor. Is Mr. Link here? Yes, I am. You may now speak, says Mr. Merkley. We have a lot of children that play in that alley and people just fly down it, it wasn't as bad until the construction on Court Avenue but I am really worried about the kids getting hit, says Mr. Link. None of the neighbors have had an issue with this until now and they have been out there for about 5 years, says Mr. Link. Ok, my recommendation is to give Mr. Link the speed humps back, but they can not be placed back in alley, if they are placed back into alley we will be ordering fines and also referring to prosecutor's office for criminal charges, says Les Merkley, Corporation Counsel. Andy Crouch makes motion, seconded by Rob Waiz,vote taken, motion carries 3-0. Also, Assistant Chief, Josh Lynch stated the police department has never received a complaint from Mr. Link or his neighbors about speeding in Sassafras Alley. 2. Clark Miles—Approval to purchase trash bins You have a proposal in front of you to purchase 364 trash bins, total cost will be $29,587.29. We usually purchase these about twice a year. Rob Waiz makes motion to approve, seconded by Andy Crouch,vote taken, motion carries 3-0. 3. Kevin Morlan—Contract approval with Cintas for Street, Sanitation, &Vehicle Maintenance This is a contract with Cintas that gives us a "Government" rate for uniforms and other services. Rob Waiz makes motion to approve, seconded by Andy Crouch,vote taken, motion carries 3-0. 4. Mike Moore—approval of dumpster I need to have a dumpster placed at 606 W. Riverside Dr for 2-3 days, I am having a new deck built. Andy Crouch makes motion to approve, seconded by Rob Waiz,vote taken, motion carries 3-0. Court Ave. (Johnny Link residence) in Sassafras Alley. -05/13/26 Kevin Morlan received complaint from Mayor's Office regarding speed bumps in Sassafras Alley. -05/14/26 the Street Dept removed the speed bumps. -05/15/26 Johnny Link came to the Street Dept. and met with Morlan. I gave them back but told him it was illegal to put traffic control devices on a city alley or street and he said they'd been there for 5 years with no problems. He said he was probably going to put them back out at different times of the day when speeders were the worst. I told them we'd have to remove them again if he did. -05/19/26, I noticed that the speed bumps were back in the 900 block of Sassafras Alley. -05/20/26, I had them removed again and held per the request of the City Attorney and BPW Hearing. -05/21/26, called Street Dept. office wanting them back. When Morlan returned his call, he got Link's VM. Left message that letter would follow, however he needed to be at BPW meeting on 06/10/26 to discuss the matter. He never returned the call.
