2026-OR-6 Ordinance for Partial Vacation of Unimproved Grandview Drive
ORDINANCE NO. -d ' -6 IN RE THE JOINT PETITION FOR PARTIAL VACATION OF AN UNIMPROVED GRANDVIEW DRIVE, A PUBLIC WAY IN THE CITY OF JEFFERSONVILLE, INDIANA WHEREAS, petitioners, David Erickson, Rebecca McMasters, Elisabeth Konzelman and David Erickson, II ("Petitioners"), have filed a petition for the vacation of a portion of an unimproved dedicated right of way known as Grandview Drive, pursuant to the provisions of IC 36-7-3-12; and, WHEREAS, Petitioners have caused a notice of public hearing on such petition before this Council to be properly published in accordance with Indiana law; and, WHEREAS, the adjoining property owners to that portion of the public way proposed to be vacated,have either consented to or have been notified of said petition via certified mail, return receipt requested; and WHEREAS, this Council having held such public hearing at the date and time as stated in such published notification; and NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL FOR THE CITY OF JEFFERSONVILLE, INDIANA, as follows: 1. The Common Council for the City of Jeffersonville, hereby finds all of the following: a. The property owned by Donald L.Abshire,Jr.and Linda M.Abshire located to the south of a portion of the right of way for which vacation is sought was never a part of the Plat of McBride Heights and not owned by the developer of McBride Heights at the time of the Original Plat. b. That portion of right of way for with vacation is sought has not been improved for more than 70 years. c. The proposed vacation will not hinder the growth or orderly development of the City of Jeffersonville, Indiana. d. The proposed vacation will not make access to the lands of any aggrieved person by means of public way difficult or inconvenient. e. The proposed vacation will not hinder the public's access to a church, school, or other public building or place. f. The proposed vacation will not hinder the use of a public way by the neighborhood in which it is located or to which it is contiguous. 2. Petitioners' petition for vacation of a portion of the unimproved right of way platted as Grandview Drive, as depicted on the Replat of McBride Heights attached hereto as Exhibit"A" is hereby vacated. 3. Due to the above-stated findings, and the consent of adjoiners to the petition filed by the Petitioners; a. Title to the entire forty (40) foot width of that portion of the vacated right of way lying between the property owned by David Erickson, Rebecca McMasters, and Elisabeth Konzelman, and the property owned by Donald L. Abshire, Jr. and Linda M. Abshire, as more particularly depicted and described as Parcel 1 on Exhibit "B" attached hereto, shall hereby vest in David Erickson, Rebecca McMasters, and Elisabeth Konzelman, as tenants in common. b. Title to the entire forty (40) foot width of that portion of the vacated right of way lying between the property owned by David Erickson II and the property owned by Donald L. Abshire, Jr. and Linda M. Abshire, and title to a portion of the forty (40) foot width of the portion of the vacated right of way lying between the property owned by David Erickson II and the property owned Kimberly Bandy and Rex Upton, as collectively more 2 4935-9097-8176,v.2 particularly depicted and described as Parcel 2 on Exhibit`B"attached hereto,shall hereby vest in David Erickson II. c. Title to a portion of the forty (40) foot width of the portion of the vacated right of way lying between property owned by David Erickson II and the property owned by Kimberly Bandy and Rex Upton, as more particularly described as Parcel 3 on Exhibit "B" attached hereto, shall hereby vest in Kimberly Bandy and Rex Upton, as joint tenants with rights of survivorship. 4. Petitioners shall cause a certified copy of this Ordinance to be recorded in the office of the Recorder of Clark County, Indiana, in accordance with the provisions of Ind. Code § 36-7- 3-12(e), and thereafter shall file a recorded copy with the office of the Clerk-Treasurer of the City of Jeffersonville, Indiana. 5. This Ordinance shall be in force and effect upon its adoption. JOINT PETITION FOR PARTIAL VACATION OF AN UNIMPROVED GRANDVIEW DRIVE, A PUBLIC WAY IN THE CITY OF JEFFERSONVILLE,INDIANA Comes now petitioners, David Erickson, Rebecca McMasters, and Elisabeth Konzelman (collectively, "EM&K") and David Erickson, II ("Erickson II," and together with EM&K hereinafter referred to as "Petitioners"), and hereby petition the City of Jeffersonville, Indiana (hereinafter referred to as the "City"), for partial vacation of an unimproved platted right of way adjacent to McBride Heights Subdivision, Jeffersonville, Indiana, and, in support hereof, would state as follows: 1. EM&K are siblings and the joint owners of Lots 28 and 29 of McBride Heights, which plat is of record in Plat Book 6, at Page 35 in the office of the Recorder of Clark County, Indiana, and having an address of 3303 Utica Pike, Jeffersonville, Indiana 47130 (the "EM&K Property"), as evidenced by the Quitclaim Deed recorded on August 27, 2024 as Instrument No. 202417831 in the Clark County Recorder's Office (the "EM&K Deed"). A copy of the Deed is attached hereto as Exhibit"A". 2. The Subdivision known as McBride Heights, was originally platted in 1947 pursuant to plat recorded in Plat Book 6, at Page 35 in the office of the Recorder of Clark County Indiana (the "Original Plat"). A copy of the Original Plat is attached hereto as Exhibit "B". The Original Plat reflects the dedication of a 40 foot wide right of way adjacent to the southwestern lot lines of the EM&K Property. 3. McBride Heights was subsequently replatted in 1948 pursuant to plat recorded in Plat Book 6, at Page 85 in the office of the Recorder of Clark County Indiana (the "Replat"). A copy of the Replat is attached hereto as Exhibit "C". The Replat reflects the dedication of the same 40 foot wide right of way adjacent to the southwestern lot lines of the EM&K Property and Lot 23 of McBride Heights, which 40 foot right of way is shown on the Replat as Grandview Drive. 4, Lot 23 of McBride Heights was subsequently replatted in 2021 into Tract 4 shown on the Hill Minor Plat recorded in Plat Book 18, at Page 69 in the office of the Recorder of Clark County Indiana (the "Partial Replat"). A copy of the Partial Replat is attached hereto as Exhibit 5. Erickson II is the owner of Tract 4 as shown on the Partial Replat(the "Erickson II Property, and together with the EM&K Property, hereinafter collectively referred to as the "Property"), as evidenced by the General Warranty Deed recorded on July 3, 2025 as Instrument No. 202513944 in the Clark County Recorder's Office (the "Erickson II Deed"). A copy of the Erickson II Deed is attached hereto as Exhibit "E". 4. Pursuant to the provisions of IND. CODE § 36-7-3-12, Petitioners jointly seek the partial vacation of an approximately 500 foot portion of the platted but unimproved Grandview Drive extending from the right of way of Utica Pike northerly to the North corner of the Erickson II Property. The area of the right of way Petitioners seek to vacate is described as three(3)separate parcels comprising an aggregate of.442 acres which are depicted and more particularly described by metes and bounds contained in Exhibit"F" attached hereto. 2 4935-9097-8176,v.2 6. EM&K own Lots 28 and 29 of McBride Heights, as shown on the Original Plat. Erickson II owns Tract 4 of Hill Minor Plat, as shown on the Partial Replat (the same being formerly known as Lot 23 as shown on the Replat). The names and addresses of other owners of properties adjacent to that portion of right of way to be vacated are listed below(the"Adjoiners"): a. Donald L. Abshire, Jr. (now deceased) and Linda M. Abshire, the surviving widow of Donald L. Abshire, Jr., 3213 Utica Pike, Jeffersonville, Indiana 47130; b. Kimberly Bandy and Rex Upton, 25 Grandview Drive, Jeffersonville, Indiana 47130 (the Owners of Lot 24, McBride Heights, as shown on the Replat). 7. The Adjoiners have consented to this Petition as shown by the consents attached hereto as Exhibit "G". 8. The portion of Grandview Drive for which this partial vacation is sought has never been improved during the more than 70 years following the Replat. Therefore, in support of the proposed vacation, Petitioners further affirmatively state their good faith belief that: a. The proposed vacation will not hinder the growth or orderly development of the City or the neighborhood in which it is located or to which it is contiguous. b. The proposed vacation will not make access to the lands of any persons by means of public way difficult or inconvenient. c. The proposed vacation will not hinder the public's access to a church, school, or other public building or place. d. The proposed vacation will not hinder the use of a public way by the neighborhood in which it is located or to which it is contiguous. 9. Further, since the property owned by Linda M. Abshire, widow of Donald L. Abshir,Jr. and adjoining a portion of the southerly boundary of the right of way to be vacated was never a part of McBride Heights and was not owned by the party platting McBride Heights at the 3 4935-9097-8176, v. 2 time of the Original Plat or the Replat, EM&K request that the Ordinance Vacating that portion of Grandview Drive adjacent to the EM&K Property provide that title to all forty (40) feet of the vacated right of way revert to EM&K. That portion of Grandview Drive for which EM&K seeks full ownership is described as "Parcel 1" contained in Exhibit "F" attached hereto. Linda M. Abshire, the surviving widow of Donald L. Abshire, Jr., consents to the requested reversion pursuant to their consent attached to this Petition. 10. Finally, Kimberly Bandy and Rex Upton, as the owners of Lot 24 of McBride Heights, have consented to the requested reversion pursuant to their respective consents attached to this Petition. 11. Since all of the owners adjoining the right of way to be vacated have either signed this Petition or consented to this Petition,there is no necessity in mailing notice of this Petition to any person or entity. Petitioners have published notice of this Petition in The News and Tribune newspaper one(1)time at least ten(10)days before the scheduled date of such hearing as required by IND. CODE § 5-3-1-2(b). WHEREFORE, petitioners, EM&K and Erickson II, respectfully ask that the Common Council of the City of Jeffersonville, Indiana, conduct a public hearing on this Petition, and that following such hearing, enact and adopt an ordinance vacating the above-described unimproved right of way and the reversion of title to same to Petitioners, as requested herein.
