PRESENT(VIRTUAL): CALL TO ORDER Rob Waiz Redevelopment Director called the meeting to order at 9:30 a.m. in the Mayor's Conference Room in City Hall. The meeting was held in person and streamed on the City's Website. Amy Huffman and Andy Crouch served on the board. APPROVAL OF THE MINUTES: Mr. Crouch made the motion to approve the minutes from October 15, 2025, Ms. Huffman seconded the motion; motion passed, 3-0. APPROVAL OF PAYROLL: Mr. Crouch made the motion to approve the payroll. Ms. Huffman seconded the motion; motion passed, 3-0. OLD BUSINESS: Nothing at this time. NEW BUSINESS: 1. Les Merkley—Hearing on 834 Fulton Street—Russell &Alice Muncy This matter was cited before the board for today for allegedly being out of compliance with 2010-OR-30 due to trash, abandoned cars, and just yard being unkept. This same residence came before the board back in June 2025 with same issues, at that time we gave the residents 30 days to clean up the property, while assessing fines in the amount of$300.00 per day and return before the board at the end of 30 days. They returned to the board and at that time the residence was cleaned, fees were waived by board. Now we are back due to the same issue as before. Les Merkley: Mr. Lovan is here representing Code Enforcement that has been monitoring this property. Mr. Lovan when were the pictures taken we have before us? Bing Lovan: last night 10/14/2025. Les Merkley: Is the pictures an accurate depiction of property as of yesterday? Bing Lovan: yes, there are mattresses, car parts, 2 inoperable vehicles in driveways, and trash. We have also received paperwork from Health Department on a complaint they received. Les Merkley: In your professional opinion does this property need to be cleaned up to meet our ordinance? Bing Lovan: yes, it does. Les Merkley: Is the homeowner, or representative of homeowner here? Russell or Alice Muncy? I am Jason Curry,Alice Russell owns this home, she is my mother but she has onset on dementia. My name is Theresa Johnson, I am the daughter of Alice Russell. Les Merkley: Do you have any dispute that the property needs to be cleaned up? Theresa Johnson: No, we are not here saying the property doesn't need cleaned up, but my mother has dementia, my brother has a lot of health issue and is wheelchair bound, and he doesn't even know it's this bad until Bing comes to say it needs cleaned up, because he doesn't go out very often. His daughter is the one that brings all this stuff there and she is mentally challenged and she just doesn't listen. Les Merkley: my recommendation is to deem the property a public nuisance and in violation of 2010-OR-30, start fines of$300.00 per day, and give them 10 days to clean property, if not cleaned City will hire to get it cleaned at the expense of the homeowner. Amber Ridings—Approval of"Once in a Generation Celebration at Schimpff's Confectionery Special events committee approved the Once in a generation celebration hosted by Schimpff's Confectionery, 347 Spring Street. Scheduled for Friday, November 7, 2025 from 10:00 a.m.— 1:00 pm. They will be shutting down that block of Spring Street for the celebration. Mr. Crouch made motion to approve event, seconded by Ms. Huffman, motion carries 3-0. 3. Amber Ridings—Request for approval of street closure We are requesting approval of road closure in the Terraces of Park Place for October 31, 2025. Chippewa and Kewanna will be one way. We will be needing barricades. Mr. Crouch makes motion to approve, seconded by Ms. Huffman, motion carries 3-0. 4. Kevin Morlan—Request for approval of Change Order#1 I am requesting approval of Change Order#1—final installed quantity adjustment for Community Crossings Grant funded street paving project. Mr. Crouch makes motion to approve change order, seconded by Ms. Huffman, motion carries 3-0. 5. Len Ashack—Approval of road closure Request for approval of road closure on Oaklawn Drive from Highland to Plank, beginning October 20, 2025 to November 6, 2025. A representative of the Clark County Health Department investigated the complaint with City of Jeffersonville Code Enforcement on June 3, 2025. A representative of the Clark County Health Department observed the property to be in violation of Clark County Ordinance No. 34-2017. You are in violation of the following County Ordinances and hereby ordered to abate the violations. Bing Lovan said they have been working on and off with the residents of this property for over a year Bing Lovan said they are getting calls weekly from the surrounding residents regarding the poor condition of the property. Bing Lovan said they have dropped off a city dumpster on multiple occasions for the residents to fill and had their dump truck with the claw arm pick up many items set out for disposal I observed the driveway on the SE side full of junk and garbage The NE side of the property and NW side of the property also have excessive amounty of junk stored around the home There is even trash spilling into E 9th Street on the NW side of the property Pictures are attached for reference. This is an urban area in close proximity to other homes I knocked on the door and Alice Muncy, Owner, answered I asked Alice if she was the homeowner and she said she was but that her family members(son, grandaughter. and grandaughters friends)are the ones who have created the mess on the property and she didn't have much control of it Mrs Muncy said her son was available and she would get him for me to speak with Jason Curry, Son of Owner, came to the door and I informed him the state of the property was unacceptable and in violation of county ordinance and state law. CCHD will wait to see what happens with the City of Jeffersonville before pursuing further enforcement action. 07/07/2025 Drew Roudenbush Nobody Follow-up 07/07/2025 11 15am I arrived at 834 Fulton Street, Jeffersonville, IN 47130 and the property was in satisfactory condition I will follow up with Bing Lovan to discuss their actions 07/07/2025 Drew Roudenbush Follow-up 07/21/2025 11:31am Phoned Bing Lovan and he said they were fining the property$300 per day until it was cleaned up. Bing Lovan said he also followed- up with the property today and was going to provide the City Attorney with pictures and an update on the property to remove further fines now that the property was cleaned up. City of Jeffersonville Code Enforcement, contacted me and said the property is in an unsanitary condition again and asked if CCHD could go look at it. 10/03/2025 Drew Roudenbush Ryan Curry and Miguel Follow-up 10/08/2025 11:30am Arrived at property and observed junk and trash surrounding home. in driveway, behind house. and along 9th Street. Pictures attached I spoke with Ryan Curry, owners grandaughter, and Miguel, Ryan's friend. Ryan Curry said she was aware the property was an issue again Ryan Curry said her mother and her mothers friends keep bringing junk to the property and leaving it everywhere. Ryan Curry said she is trying to keep people off the property who don't belong there and trying to prevent her mother from bringing more junk to the property she pulls out of dumpsters Ryan Curry and Miguel told me they were actively working on hauling junk off the property again and they would be working on it over the next several days Ryan Curry said she thought they could have the property cleaned up by Wednesday I told here the City of Jeffersonville is planning another meeting in mid October with the property owner and possible fines again I informed Ryan Curry it would be in her family's best interest to get all the junk and trash off the property and properly disposed of prior to their meeting and they need to figure out a way to keep the property in a sanitary condition going forward. 10/08/2025 Drew Roudenbush Follow-up 10/09/2025 9:30 am Drove by the property and junk and trash is still on the property.
