We Hereby Submit Specifications And Annual Recurring Costs For:
Terrestrial Vegetation treatment for Van Dyke Park. Program includes application of all registered aquatic
herbicides, as necessary to provide acceptable management of the terrestrial vegetation around client's
pond. Assessments and/or applications will be made approximately once per month beginning in April (or
upon acceptance) through October. This program includes the spraying of terrestrial vegetation from
Second Street Bridge to River stage Park. Approximately 3,000 linear feet along the shore of the
Ohio River between walkway and waterline.
Professional Terrestrial Vegetation Control Service - Cost: $14,200.00 (no applicable sales
tax)

TERMS AND CONDITIONS
1. All materials, products and/or services offered by Jones Fish Hatcheries&Distributors LLC, DBA Jones Lake Management.
("Jones Lake Management", "our" or"us") are subject to the terms and conditions set forth herein. Client's signature on the
last page this Contract shall constitute acceptance of the Jones Lake Management Terms and Conditions as provided herein.

3. Treatment visits may be deducted at the end of the Contract year if unscheduled treatments are made during the season.
The Contract cost has been spread over the duration of the service period, and early termination of the Contract shall be
consideNd a material breach of the contract and will result in the remaining balance of the Contract price being imrrt.-diately

5. Clie iiunderstands that critical and unforeseeable factors beyond our control prevent us from eliminating all risks ih,the use

6. V 1 , +n of Liability—Jones Lake Management's total liability under this Contract shall be limited to the total pry•:; .id by
Client' • ones Lake Management for the materials, products and/or services provided hereunder. Under no circ 1=Aonces
shall Jones Lake Management be liable for any consequential, special,or incidental damages of any type or kind. l ..
7. All Jones Lake Management personnel providing treatment services are licensed as required by state and federal laws.
Client gives Jones Lake Management permission to keep all pesticide records, however they will be furnished to Client upon
written request.
8. PriC is based on tax laws in place at the time of execution of this Contract. Any changes to tax laws may modify e total
cost u ted herein and Client agrees to any such pass-through increases.
9. This. -ntract is governed by and shall be construed in accordance with the laws of the State in which the se ide Will be
provided.
10. In the event that the Client defaults on, or is in breach of, any part of this Contract, which includes these Terms and
Conditions, Jones Lake Management shall be entitled to recover any and all costs and expenses incurred as a result of
Client's default or breach, including any and all attorney's fees or other collection costs or expenses, regardless of whether or
not suit is initiated. In addition to the recovery of such costs and expenses, Jones Lake Management may i j diately
term, '.this Contract as a result of Client's breach.

11. If the use of a third-party billing or compliance company is required,the registration or invoice fees will be added to the first
invoice of the season.
12. Jones Lake Management assumes no liability for fish loss from the lack of properly sized aeration system and/or oxygen
depletion due to excessive vegetation die-off and its subsequent decomposition.
13. Total elimination of all phosphorus is not guaranteed,expected, or possible. Jones Lake Management does not guarantee
that these phosphorus reduction applications will eliminate all algae, aquatic weeds, and/or cyanobacteria growth this year, or
in future years.

below, (a) I indicate my acceptance of the same, and (b) authorize Jones Lake Management to do the work as
specified above. Payment will be made as stated.
Pricing listed is valid for 30 days after receipt of Contract (or 30 days after proposed start time). Contracts
accepted after this will be subject to increased cost or initial clean up fees.
Pricing includes the base price of$14,200.00.
