IN RE THE PROPERTY LOCATED AT:
19 LOUISE STREET,
ALLEGED TO BE A NUISANCE PROPERTY
DANNY LEE PIERSON (PROPERTY OWNERS)
FINDINGS OF FACT
AND ORDER
WHEREAS, on November 10, 2025 the Jeffersonville Building Commissioner("the
Enforcement Authority") citied above property owner for violation of Ordinance No. 2010-
OR-30, specifically, Section III of said Ordinance and Article 9.6B(c) of the Jeffersonville
Zoning Code; and
WHEREAS, the property owner was cited for maintaining a public nuisance at the
property by permitting or allowing to remain on or within the property or upon public ways
abutting such real property any materials, trash, garbage, debris or any other matter which
is detrimental to public health, comfort, safety, or to the aesthetic well-being of the
community; and
WHEREAS, a Citation to Appear was sent by certified mail to the following persons
with a substantial property interest in the subject premises:
19 Louise Street, Jeffersonville, Indiana
WHEREAS, service on property owner was successful via certified mail with return
receipt; and
WHEREAS, said notice also invited the property owner or any interested party to
appear at the hearing to present evidence and/or testimony in reference to the violation;
and
WHEREAS, a hearing was scheduled upon the Citation on December 10, 2025 at
9:30 a.m.; and
WHEREAS, the owner, Danny Lee Pierson, appeared in person at the hearing
before the Board of Public Works and Safety("the hearing authority")to present evidence
or arguments; and
WHEREAS, the Enforcement Authority testified at the hearing that there was large
number of bicycles stored outdoo the on the property including of such constitute publicther garbagesane
and trash on the property to the extentpresence
under 2010-OR-30; and

**Copy of Order shall be posted at 19 Louise Street, Jeffersonville, IN
WHEREAS, Article 9.6B(c) of the Jeffersonville Zoning Code prohibits outdoor
storage without sufficient screening; and
WHEREAS, the Enforcement Authority testified that the placing or accumulating the
aforementioned on or within the property attracts or may attract rodents, insects, domestic
or wild animals in such a manner to create a health hazard or unsanitary or dangerous
conditions; and
WHEREAS, the outdoor storage constitutes a public nuisance as set forth in Section
III(a)(3) of Ordinance No. 2010-OR-30
WHEREAS, the owner testified that he was attempting to abate the property of the
nuisance material; and
WHEREAS, the Enforcement Authority testified that violations at this property have
been on-going since at least 2017; and
WHEREAS, the hearing authority adopts the testimony given at the hearing as its
Findings and further incorporates the minutes of the meeting including said exhibits
introduced.
NOW THEREFORE, it is hereby ORDERED that the property at 19 Louise Street,
Jeffersonville, Indiana, is deemed a public nuisance pursuant to 2010-OR-30 and shall be
abated by the property owner by January 14, 2026;
IT IS FURTHER ORDERED that a fine of$300.00 is hereby assessed each day the
property is not abated; and
IT IS FURTHER ORDERED that property owners shall appear before the Hearing
Authority on January 14, 2026 at 9:30 a.m. to provide a status update on the abatement;
and
IT IS FURTHER ORDERED the City shall abate the property at owners' expense in
the event the property owner fails to comply with this Order; and

DEAR PROPERTY OWNER:
The above-referenced property is in violation of the following Jeffersonville Ordinance:
DESCRIPTION OF VIOLATION:
General Nuisance 2010-OR-30 Section III: Nuisances No owner, occupant, or tenant shall
permit or allow to remain on or within property or upon public ways abutting such
property any materials, trash, garbage, debris or any other matter which is detrimental to
public health, comfort, safety, or to the aesthetic well being of the community.
Oudoor Storage Screening Article 9.6B (c) Outdoor storage: No un-screened outdoor
storage is permitted.Clean up of the property is necessary to avoid more fines.
INSPECTOR'S NOTE: Failure to comply will result in more fines and possibly a citation
and hearing at the Board of public Works for review of the violations and necessary
actions to be taken at that time. Please call with questions.
A re-inspection will be conducted on July 11, 2025, at which time failure to comply will result in
fines and or penalties levied on property. or The City performingnecessarywork and billing
property owner accordingly.
Failure to pay accrued cost will result in a tax lien being filed against the property. Any appeal of
either the abatement notice or the bill must be made in writing within ten (10) days of the date of
the document being appealed. The appeal must be in writing and must be filed with the
Department of Code Enforcement. If a written appeal is filed with the Department of Code
Enforcement the matter shall be scheduled for a hearing before the hearing authority and a
hearing shall be held pursuant to Ind. Code 36-7-9. The hearing authority's order regarding this
appeal is considered final from the date of its issuance and is subject to judicial review pursuant
to the provision of Ind. Codes 36-7-9-8.

The City of Jeffersonville Board of Public Works and Safety meets in the Mayor's
Conference Room on the second floor of City Hall, 500 Quartermaster Court.
Failure to appear or have an inspection confirming that corrective action has been
taken may require the City of Jeffersonville to begin legal action to correct the
problem.

To Whom It May Concern,
My name is David Sparks and I am a Battalion Chief with the New Albany Fire Department.
I am writing this letter in regards to Mr. Dan Pearson who resides at#19 Louise St.Jeffersonville,
Indiana Mr. Pearson contacted me in early September and inquired if the new Albany Fire
Department still collected bicycles for the children for Christmas. I advised him yes,we did. Mr.
Pearson then shared his story of his love for bicycles and how he worked at a local bicycle shop
when he was a young adult. He stated he collected bicycles with the intent to restore them and
give them away to those in need.
Mr. Pearson stated after his wife passed, he put his full attention into collecting Bicycles and has
now become overwhelmed. He advised me his Collecting has now become an issue with The
City of Jeffersonville Code Enforcement. He stated he has been fined by the city of Jeffersonville
because of the State of his property. Mr. Pearson stated he has been cleaning trying to correct
the issue but he is just overwhelmed with the number of bicycles he has that need to be
removed. He advised he has approximately 600 Bicycles at his residence and multiple storage
units.
Since that time in early September,we have been working with Mr. Pearson removing bicycles
to restore and to date we have removed approximately 350 bikes. I have told Mr. Pearson I will
continue to work with him to resolves his code issues. I truly believe Mr. Pearson understands
there is a problem with his property and truly trying to make the need to changes to his
property to bring it back into code.
