MINUTES
December 10, 2025

PRESENT(VIRTUAL):
CALL TO ORDER Rob Waiz Redevelopment Director called the meeting to order at 9:30 a.m. in the
Mayor's Conference Room in City Hall. The meeting was held in person and streamed on the City's
Website. Clark Miles and Andy Crouch served on the board.
APPROVAL OF THE MINUTES: Mr. Crouch made the motion to approve the minutes from December 3,
2025, Mr. Miles seconded the motion; motion passed, 3-0.
APPROVAL OF PAYROLL: Mr. Crouch made the motion to approve the payroll. Mr. Miles seconded the
motion; motion passed, 3-0.
OLD BUSINESS:
Nothing at this time.
NEW BUSINESS:
1. Les Merkley—Larry Wallace/Bing Lovan—19 Louise Street
Hearing to review of compliance with the building commissioner code enforcement regarding 19
Louise Street, Homeowner Danny Lee and Linda K. Pierson.
This matter before you today is because code enforcement has been working with the
homeowner to get property cleaned up, but as of now it is still not up to code, says Les Merkley.
Les Merkley: Bing have you been to this residence?
Bing Lovan, Code Enforcement: Yes, I have, and have had ongoing issues since 2023.
Les Merkley: Can you tell us a description of the property?
Bing Lovan: The pictures you have were taken yesterday, December 9, 2025
Les Merkley: Did you take the pictures?
Bing Lovan: Yes, I did take the pictures
Les Merkley: Was you on the property of 19 Louise St?
Bing Lovan: No, I was in the neighbor's yard looking into 19 Louise St.
Les Merkley: Do you feel this property is a nuisance?
Bing Lovan: yes, I do.
Les Merkley: Is there anyone here representing this property?
Danny Pierson: Yes, I am here
Les Merkley: State your name and address please
Danny Pierson: My name is Danny Pierson, 19 Louise Street.
Les Merkley: Do you have anything to say at this time?
Danny Pierson: I was in a very dark place with grief, I lost my job, and lost my wife and just
starting picking up bicycles to repair and give them away and I just have too many. I spent 60
years as a head bicycle mechanic at Falls City. I have been in process of getting rid of it all, as of
today I have given away 350 bicycles to Floyd County Fire Department and I have a signed letter
stating that. You all have fined me recently for my yard being like this and I have paid it so by
taking money from me it makes me not able to fix up the bikes. And actually they listed that
fine improperly, and my attorney, Mitch Harlan said I should ask for a refund, but at this time I
will not being doing that. I have been seeking help for my grief and I am embarrassed as to how
this looks right now but I am trying.
As you can see in the pictures I have four different racks for the bicycles and all of them are
within the racks. I also have a collection of motorcycles that I have gotten rid of, except for my
Harley. Everything is going out. I have worked with Larry previously on this and he told me he
didn't care about the box trailers on concrete pads, but along come Bing and he cares, so not
sure what needs to be done to make them happy.
Michael O'Brien: When I was working in code enforcement I dealt with this property and that
was 2017.
Les Merkley: When did you lose your job Mr. Pierson?
Danny Pierson: I am not sure why you need to know that, so I will not be answering.
Les Merkley: Well, I believe you have had enough time and good weather in the last 10 years
this yard could have been cleaned up.
Danny Pierson: this is the first time I have had to come here before this board, and they had
never viewed my backyard until I let them back there.
Les Merkley: My recommendation for this board is to deem this property a nuisance under
2010-OR-30, citing outdoor storage. Must have this cleaned up within 30 days, if not in
compliance then the City will go in and abate. Fines of$100.00 will be assessed daily under
property is in compliance. So moved says Mr. Crouch, seconded by Mr. Miles, motion carries 3-
0.
