contiguous to the real estate described herein; and
,
WHEREAS, on the /~ day of ~ 1988, a
Petition for Annexation of the real estate described herein was
filed by the legal and equitable owners of said real estate,
requesting annexation of the area pursuant to I.C. 36-4-3-5.
NOW, THEREFORE, be it ordained by the Common Council of
the City of jeffersonville, Indiana, that:
SECTION I.
The following described land be, and the same is, hereby
annexed and declared a part of the City of jeffersonville,
Clark County, Indiana to-wit:
Commencing at an iron spike in the centerline of the New Albany
and Charlestown Pike, marking the west corner of Survey No. 21 of
the Illinois Grant; running thence North 50° East along the line
dividing Surveys No. 21 with No. 33 and 34, a distance of 1833.15
feet to a point; thence South 40° East, 2333.76 feet to a point
in the center of the jeffersonville and Charlestown Pike and
being the true place of beginning of land to be herein described:
Thence North 16° 45' East along said centerline of the Jefferson-
ville and Charlesto%~n Pike, 500 feet to a point; thence South 81°
15' East, 730 feet to a point; thence North 8° 45' East, 575 feet
to a point; thence North 57° 14' 47" West, 305 feet to a point;
thence North 73° 15' West, 350 feet to a point in the center of
said jeffersonville and Charlestown Pike; thence North 16° 45'
East along said road centerline, 1150 feet to a point; thence
South 40° East, 1012.11 feet to a point; thence North 50° East,
462 feet to a point; thence South 40° East, 244.20 feet to a
point; thence South 50° West, 32.51 feet to a point; thence South
400 East, 871.86 feet to a point on the westerly right-of-Way
line of the B. & O. Railroad; thence South 18° 45' West along
said westerly right-of-way line, 2855 feet, more or less, to a
point; thence North 40° West, 2290 feet, more or less, to the
place of beginning and containing 110 acres, more or less of
land.
~/~, however, to the easterly one-half of the right-of-way of
the Jeffersonville and Charlestown Pike.
SECTION II.
Be it further ordained that the boundaries of the City of
jeffersonville shall be and the same hereby are, declared
extended to include all of the real estate herein above
described as part of the city of jeffersonville, Clark County,
Indiana.
SECTION III.
This ordinance shall be in full force and effect from and
after its passage, promulgation, approval by the Mayor and
publication in accordance with the law.
Passed and adopted by the common Council of the City of

BEFORE THE COMMON COUNCIL OF
THE CITY OF JEFFERSONVILLE
PETITION
Comes now Ethel E. Woehrle and Terry W. Thom, the
respective legal and equitable owners of certain real property
within Clark County, Indiana, and hereby petition the Common
Council of the City of jeffersonville to annex approximately
110 acres of such land, more particularly described herein as
follows:
Commencing at an iron spike in the centerline of the New Albany
and Charlestown Pike, marking the west corner of Survey No. 21 of
the Illinois Grant; running thence North 50° East along the line
dividing Surveys No. 21 with No. 33 and 34, a distance of 1833.15
feet to a point; thence South 40° East, 2333.76 feet to a point
in the center of the Jeffersonville and Charlestown Pike and

point; thence South 50° West, 32.51 feet to a point; thence South
40° East, 871.86 feet to a point on the westerly right-of-way

point; thence North 40° West, 2290 feet, more or less, to the
place of beginning and containing 110 acres, more or less of
land.
Subject, however, to the easterly one-half of the right-of-way of
the Jeffersonville and Charlestown Pike.
The total border of this land is 11,395.88 feet, of which
2,290 feet are contiguous with the City's corporate boundaries.
Therefore, 20% of the borders of the proposed annexation is
contiguous with the City's corporate boundaries.
Ethel E. Woehrle is the sole legal owner of the real
estate described hereinabove, and Terry W. Thom is the
equitable owner of such real estate based upon contract for
sale of such land executed between himself and Ethel E.
Woehrle.
WHEREFORE,
equitable
pursuant to I.C. 36-4-3-5, said legal and
owners request an ordinance annexing the area
described hereinabove.

DURABLE POWER OF ATTORNEY
KNOW ALL FIEN BY THESE PRESENTS, That I, ETHEL E. WOEHRLE,
of Clark County, in the State of Indiana, constitute and appoint
my son, JOHN WOEHRLE, my true and lawful attorney-in-fact for me
and in my name and stead for the following purposes, to-wit:
1. To draw checks or withdraw funds against my account or
accounts in Commerce America Banking Company, First Federal
Savings & Loan Association and the Farm Bureau Credit Union, all
of Clark County, Indiana, or any institution, bank, or associa-
tion in which I may now or hereafter have an account.
2. To endorse all checks, notes, drafts, or bills of ex-
change which may require my endorsement for deposit as cash and
for collection in said bank, trust company, or other financial
institution.
3. To endorse my name and draw money on checks and any
other negotiable instruments payable to my order, including
checks payable to my order drawn on the Treasurer of the United
States.
4. To open or establish accounts in any bank, trust company,
or other flnaneial institution in my name or in the name of mY
attorney-in-fact.

safet deposit box with full power and authority with reference
to both withdrawing or changing from time to time the contents
of said box, or in r. elation to any other thing pertaining thereto,
including the removal oft said contents and/or the surrender and

"could do if personally present, hereby waiving any liability of
any bank, arising out of the exercise by my said attorney of
any. of the powers herein contained.
6. To take, hold, possess, invest, or otherwise manage any
'and all of my property, or any interest therein or pertaining
thereto.
7. To buy, receive, lease, accept, or otherwise acquire,
and to sell, convey, lease, or trade or otherwise dispose of,
and to mortgage, pledge, or otherwise encumber any property,
real, personal or mixed of which ! now or hereafter may own or
have an interest therein; upon such terms and conditions as my
attorney may deem expedient; to execute deeds of conveyance,
bills of sale, assignments, leases, mortgages or other instruments
necessary to convey title thereto, and to receipt for the purchase
price thereof.
8. To collect all sums due and owing me and, if necessary,
to commence and prosecute any legal proceedings necessary to
recover any such money or property, and to compromise and
settle any and all claims owing upon such terms as my attorney
shall, in his discretion, deem expedient.
9. To execute any and all tax returns and other governmental
reports, declarations, applications, requests and documents with
respect to all of my income and propertY..
10. To pay and and all taxes with respect to said real and
personal property and the income derived therefrom.
· 11. To act as my attorney-in-fact or proxy in respect to
any policy of insurance on my life and in that capacity to
exercise any right, privilege, or option which I may have there-
under or pertaining ~hereto, excluding however, the right to
change the beneficiary~ the right to change the method of pay-
ment of the insurance proceeds, and the right to make a cash
surrender of the policy as distinguished from a surrender of
the policy for loan, conversion, or other purposes as provided
therein.
12. To consent to any medical treatment or operation or
hospitalization or to admit me to a nursing home, which may
become necessary, and under those circUmstances in which ! am
unable to consent to such medical treatment, operation or
hosPitalization on my own behalf.
13. To do all lawful acts requisite for the effectlng of
these presents and generally to act as my attorney or agent in
all matters in which I may be interested or concerned as fully
to all intents and purposes as I myself could do if personally
present, with full power of substitution and revocation, hereby
ratifying and confirming all that my said attorney-in-fact shall.
do therein by virture of these presents and no person who shall
pay money or other considerations to my said attorney-in-fact
in connection with the eX~rcislng of the foregoing powers by
my said attorney-in-fact shall be required to see to the appli-
cation of such payment. :
