HomeMy WebLinkAbout1988-OR-24 ORDINANCE NO. 88-OR-~ ORDINANCE ESTABLISHING E-911 SERVICE FOR THE CITIZENS WITHIN THE CORPORATE BOUNDARIES OF THE CITY OF JEFFERSONVILLE WHEREAS, the Indiana Legislature has adopted Public Law 91-1988, which legislation makes it possible for legislative bodies of cities to adopt E-911 service for its citizens, and to have individual user surcharges applied in order to defray the expense of such service; and WHEREAS, the Common Council of the City of jeffersonville has previously petitioned the County Council of Clark County, Indiana, to establish this service county-wide pursuant to the existing legislation; and WHEREAS, the County Council of Clark County, Indiana, at its regular meeting on June 9, 1988, declined to provide such service county-wide and as necessary information has not been compiled for county users. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of jeffersonville that in accordance with I.C. 36-8-16 et seq., an emergency telephone system fee may be established to provide the funding for an ,,Enhanced Emergency Telephone System" which utilizes the three digit number 911 to send automatic number and location identification to reporting police, fire, medical or other emergency situations. BE IT FURTHER ORDAINED as follows: collected purchase, A monthly fee per telephone access line will be by the service supplier to pay for the lease, or maintenance of Enhanced Emergency Telephone equipment, including necessary computer hardware, software, and provisioning; and the rates associated with the monthly system cost by the total number subscribers in the service area to be covered. 2. Each service supplier that collects the Enhanced Emergency Telephone System fee on behalf of the City is entitled to a three percent (3%) administrative fee as of telephone data base service suppliers' Enhanced Emergency Telephone System Network Services. The fee will be determined by dividing the total compensation for collecting the fees. The remaining amount of the fee collected during the calendar quarter shall be remitted to the office of the Clerk-Treasurer of the City of jeffersonville within ten (10) days after the last day of the quarter. At the same time the collected fees are remitted, the service supplier shall provide a fee collection report to the office of the Clerk-Treasurer of the City of jeffersonville on a form provided by such office. 3. The Clerk-Treasurer shall deposit the remitted fees in a separate fund known as the jeffersonville Emergency Telephone System Fund. The Clerk-Treasurer may invest money in the fund in the same manner that other moneys are invested with the interest earned from such investment to be deposited in that fund. 4. During January of each year, required to collect the fee for delinquent fee list the service supplier that is the City shall provide a report to the Clerk-Treasurer- Reports shall name, address, and amount due for each service user who is two (2) or months delinquent in paying the fee. 5. Be it further ordained that this ordinance shall be in force and effect on the first day of the second month after its passage by the common council of the City of jeffersonville and approval by the Mayor.
