CERTIFICATE OF PLAN COMMISSION APPROVAL
The City of Jeffersonville (the "Plan Commission") hereby certifies as follows:
1. The Jeffersonville Plan Commission has jurisdiction over the platted area in Lots 1 through
4 in Highland Trace Subdivision, Phase 1, as the same appears of record in Plat Book 13, Page No. 43, as
Instrument No. 200409114 in the office of the Recorder of Clark County, Indiana under Ind. Code § 36-7-
4;and,
2. The Plan Commission has reviewed the foregoing Vacation of Part of Subdivision Plat and
has approved the partial vacation of the plat as described in the instrument to which this Consent is
attached.
So approved by a majority of the entire membership of the Plan Commission at a properly noticed
and convened meeting held the__ eday of January, 2024.

The Plan Commission is asked to approve and consent to the partial vacation of the Secondary Plat of
Highland Trace subdivision; Plat Book 13, Page 43.
Case Summary
Back in 2004, Highland Trace was platted as a large patio-home community. The community was
platted and subjected to a condominium regime, whereby owners would own their individual home, but
not the land around it. Shortly thereafter, a secondary plat was filed for the first phase and
condominium construction began. The prior developer inadvertently subjected the 18 acres of land to
the condominium statute and as a result of the financial failure of the original developers, only 10 units
were ever constructed leaving 10 unfinished condo sites in the first phase and almost 18 acres of
undeveloped land.
The current ownership has plans to complete the 10 remaining units from the 1st phase, and all owners
of the entire condominium project recently removed all but the 1st phase of the Property from the
condominium regime. A copy of the recorded second amendment to condominium declaration is in this
packet. This allows the 18 acres to be developed into a residential subdivision rather than a
condominium.
The owner of the 18 acres is is asking the Plan Commission to approve the vacation all but the 1st
phase of the plat so that it might be developed as a single family subdivision in accordance with a new
plat to be filed in the future. The diagram on page two of this packet shows the extent of the vacation
that is requested. The vacation request has been signed by all existing property owners in the original
plat of Highland Trace.
