Terms Payment The Client agrees to remit full payment upon the execution of this contract. Payment must be submitted at the time of contract signing. Payment options include convenient online payment at the bottom of this contract via Square Electronic Payments with your Visa, MasterCard, Discover, or American Express. Failure to receive payment within 10 days of receipt of the contract and invoice, may result in the loss of your confirmed date and time. Kindly note that gratuity is not included in the initial service price but is always appreciated. OP Recipient initial l2ECIPtFNT IN17714L i Responsibilities My Local Santa (MLS) shall not be held responsible for any client-compromised issues caused beyond its control.This includes, but is not limited to, issues such as cancellation, rescheduling, adverse weather conditions, scheduling complications, and inaccurate addresses provided to My Local Santa. MLS is committed to delivering an enjoyable experience for the guests at the event. MLS will arrive 5-10 minutes prior to the scheduled appearance unless otherwise specified in this agreement, subject to weather or traffic conditions. The client is responsible for providing Santa Lincoln with a sturdy and comfortable seating arrangement. **As an alternative, the client has the option to rent our Santa Chair for an additional $350 for the duration of the event.This fee, covers the rental, delivery and setup of the chair, is due at the time of booking.** All costumes are standard Santa-themed costumery.Any special costume requests, if desired,should be communicated to MLS in advance. Due to the nature of MLS's traditional outfits, periodic breaks are necessary. It is expected that the performance location be cool and comfortable. MLS requests a 15-minute break after each hour worked, and under no circumstances shall MLS be required to work longer than 90 minutes without a break. Promotion/Marketing In the event that the business desires to promote their Santa event, it shall adhere to the following guidelines: Approved Photo Usage: The business shall have the option to utilize an approved photo from our designated portfolio for promotional purposes, subject to our prior written consent. Additional Cost for Custom Photos: Alternatively, if the business opts to use custom promotional photos featuring Santa,they may do so at an additional cost.The details regarding the cost and specifications of such photos shall be mutually agreed upon between both parties prior to their production. Cartoon Character Option: In the absence of using an approved photo or custom photos, the business may employ the use of a cartoon character to promote the Santa event. However, the cartoon character must not resemble or imitate the likeness of the Santa character depicted in our portfolio. Violation Consequences: Should the business breach this clause by promoting an alternative Santa without obtaining proper authorization as outlined above, it shall be subject to a fine of $500 payable to the party entering into this contract. Both parties agree to abide by the terms stated herein, acknowledging that this clause forms an integral part of the entertainment contract. Santa Chair Rental The Client agrees to rent the Santa Chair from My Local Santa for a fee of$350.This fee includes delivery, setup, and rental of the chair for the duration of the event.The Client is responsible for any damages to the chair during the rental period. Payment of the Rental Fee is due at the time of booking, and any cancellations are subject to the Provider's discretion.This clause represents the entire agreement between the Client and the Provider.
