HomeMy WebLinkAbout2024-OR-54a Ordinance Rescinding 2008-OR-14 and Establishing Rules of Order & Procedure for Conducting Council Meetings ORDINANCE NO. 2024-OR- AN ORDINANCE RESCINDING ORDINANCE 2008-OR- 014 AND ESTABLISHING RULES OF ORDER AND PROCEDURES FOR CONDUCTING CITY COUNCIL MEETINGS IN THE CLASS 2 CITY OF JEFFERSONVILLE WHEREAS, Ordinance 2008-OR-014 established the procedure for conducting city council meetings prior to Jeffersonville becoming a Class Two City; WHEREAS, the prior Ordinance is no longer applicable nor does it comport with several Indiana Statutes regarding the order and procedures for a Class Two City; WHEREAS, Resolution 2021-R-10 adopts an Electronics Meeting Policy; and WHEREAS, the Common Council wishes to update and consolidate the aforementioned Ordinance 2008-OR-014 and Resolution 2021-R-10. THEREFORE, in consideration of these facts and circumstances the Jeffersonville City Council rescinds Ordinance 2008-OR-014 and adopts the following Order and Procedure for conducting City Council meetings. SECTION ONE: The Jeffersonville City Council (hereinafter "Council," or individually "member") shall meet on the First and Third Monday of each month, excluding holidays and Election Day. The meetings shall convene at 6:00 p.m. unless otherwise noticed pursuant to the Indiana Open Door Law. SECTION TWO: The Presiding officer shall be the duly elected President of the Council. In the President's absence the elected Vice-President shall preside. In the absence of both President and Vice President, the body present shall select by majority vote a member to preside. The President and the Vice-President shall be selected by majority vote at the first meeting each year and the term shall last one (1) year. 1 SECTION THREE: After the meeting is called to Order it shall proceed as follows: A. Call to Order; B. Invocation; C. Pledge of Allegiance; D. Roll Call; E. Approval of Minutes; F. Approval of Agenda; G. Approval of Claims; H. Report of the Clerk; I. Unfinished Business; J. New Business; 1. Public Comment NOT Related to New Business or a Public Hearing K. Committee Reports/Comments; L. Attorney Reports/Comments; M. Department Head Reports/Comments; O. Council Comment; P. Adjournment SECTION FOUR: The following procedures shall be followed by the Council on all matters that require action by the body: A. Issue shall be presented to the Council upon Motion of a member; B. Public Comment shall be heard subject to procedures set forth below; C. Council shall debate the issue. All council members shall be given an opportunity to make comment or debate upon every issue presented before any member can "call the question" for vote; D. After each member has had their opportunity to comment or debate upon the issue any member may move to end debate and call for a vote upon the motion; 2 E. Debate shall ONLY take place among the members of the duly elected council. The only exception shall be in those limited instances wherein a council member asks a non-council member a question related to the issue before the members. If any member objects to such a request, then the member making said request may call for a vote to permit the non-member's input; F. For any procedures not specifically addressed herein, the Council shall generally follow Robert's Rules of Order. SECTION FIVE: AGENDA: The following shall apply to all matters related to the Agenda of the City Council meetings: A. All Items on the Agenda shall be sponsored by or presented by a duly elected member of the Council and/or an individual designated by the sponsoring member; B. The Executive or the Executive's duly appointed designee shall be authorized to request Items to be placed upon the Agenda; C. The President shall assist and work with the Clerk to prepare each Agenda. The Clerk requests that all items proposed for the Agenda be provided not later than noon (12:00 p.m.) on the Tuesday prior to the regularly scheduled meeting; D. The Agenda for any meeting MAY be amended. The Agenda can only be amended upon motion made by a member and a majority vote of the council members present. SECTION SIX: PROCEDURE FOR PUBLIC COMMENT: The following procedure shall be followed as it relates to public comment. PUBLIC COMMENT IS A PRIVILEGE AND NOT A RIGHT; THEREFORE, THE COUNCIL SHALL HAVE THE RIGHT TO TERMINATE PUBLIC COMMENT AT ANY TIME UPON MOTION AND VOTE OF THE BODY. A. Any citizen that wishes to make public comment SHALL sign up prior to the call to order of the meeting. If a citizen fails to sign up prior to 3 the call to Order they SHALL NOT be permitted to make comment, except as otherwise permitted by the President; B. NO PUBLIC COMMENT SHALL EXCEED FOUR (4) MINUTES except as requested by a member. The Council reserves the right to terminate an individual's comment period if a member deems that the citizen's comments are vulgar or threatening; SECTION SEVEN: RIGHT TO CONVENE SPECIAL MEETINGS: The following shall apply to the procedure for convening a special meeting: A. The President of the Council shall have the authority to call for a special meeting; B. The Mayor shall have the right both pursuant to statute and rule; C. A majority of the Council may convene a special meeting; D. If a special meeting is convened the Clerk must be presented with an Agenda for said meeting and, absent a statutory exception, ALL statutory notice requirements shall be complied with as set forth in the Indiana Open Door Law. SECTION EIGHT: MOTION TO RECONSIDER ORDINANCE OR RESOLUTION: The following procedure shall apply in all instances when a member requests that the body reconsider an issue, ordinance or resolution that has been previously acted upon by the body. A. A motion to reconsider shall only be considered if the movant was a member that voted with the majority upon the original motion. However, a member that was not present at said meeting shall also be permitted to present a motion to reconsider. A member that abstained and/or voted "present" shall not be permitted to request that a matter be reconsidered; 4 B. This section does not prohibit the council from considering an ordinance or resolution that has been modified, amended or otherwise substantially changed. The purpose of this provision is to specifically prevent the serial presentation of an ordinance or resolution that has previously failed. SECTION NINE: COMMITTEES: Any member shall be permitted to request the creation of a Committee. Each Committee shall be designated for a specific purpose. Standing Committees shall continue to exist indefinitely and Special Committees shall be extinguished once they have completed the work on the specific purpose for which they were formed. The President shall request volunteers for members on the Committee. The Committee shall make reports and recommendations to the full Council as requested by the President or deemed necessary or appropriate by the Committee. Committees shall only be appointed to take action when they are granted specific powers, which may only be granted by majority vote of the Council. SECTION TEN: ELECTRONIC MEETINGS: Resolution No. 2021-R-10 A Resolution Adopting an Electronic Meeting Policy for Jeffersonville Common Council is hereby incorporated by reference and adopted in full. A. At least 5 members must be present in person in the Chambers; B. A member may not attend more than 50% of the meetings virtually, and not more than 2 meetings consecutively, except as otherwise permitted by Resolution No. 2021-R-10; C. When any member is present by remote means, all votes must be taken by Roll Call; D. Remote participation is not permitted when the Council is taking final action to adopt a budget, reduce personnel, initiate a referendum, establish or increase a fee or penalty, exert eminent domain, or establish, raise or renew a tax. THEREFORE, THE COUNCIL HEREBY ADOPTS THE ABOVE ORDINANCE. 5 EFFECTIVENESS: This Ordinance shall be adopted after the passage by the Common Council of the City of Jeffersonville and approved by the Mayor of the City of Jeffersonville, or timely override his veto.
