HomeMy WebLinkAbout2024-R-13 Resolution Amending Resolution 2023-R-7 Incorporating & Adopting Findings Pursuant to I.C. 36-7-25-7 BEFORE THE JEFFERSONVILLE REDEVELOPMENT COMMISSION STATE OF INDIANA RESOLUTION NO. 2024-R- ;") A RESOLUTION AMENDING RESOLUTION NO. 2023-R-7 INCORPORATING AND ADOPTING FINDINGS PURSUANT TO I.C. 36-7-25-7 WHEREAS, on the 25th day of October, 2023 the Jeffersonville Redevelopment Commission("Commission")adopted Resolution No.2023-R-7 whereby it approved an interlocal agreement with the Board of School Trustees for the Greater Clark County School Corporation ("GCCS"), for the use of Tax Increment Funds("TIF"); and WHEREAS, I.C. 36-7-25-7 authorizes the Commission to enter into a contract with an eligible entity to provide certain programs; and WHEREAS, I.C. 36-7-25-7(a) defines an eligible entity one whose principal functions include the provision of educational programs, work training programs; worker retraining programs or any other programs designed to prepare individuals to participate in the competitive and global economy; and WHEREAS, the City of Jeffersonville is located in GCCS by providing high-quality educational and extracurricular programs for students from K-12;and WHEREAS, GCCS includes Jeffersonville High School where approximately 2500 students attend with most of those students residing in the City of Jeffersonville; and WHEREAS, GCCS offers both academic, training and extracurricular programs for its students to prepare them for post-secondary education and/or employment; and WHEREAS, Jeffersonville High School has the highest graduation rate in southern Indiana; and WHEREAS, Jeffersonville High School strives to be a school of academic excellence where all students are inspired and supported to achieve success; and WHEREAS,Jeffersonville High School's mission is to provide all students with a diverse education in a safe, supporting environment that promotes self-discipline, motivation and excellence in learning; and WHEREAS, Jeffersonville High School offers a wide variety of academic programs to help students develop skills and practical training; and WHEREAS, among those programs is WJHI Radio and TV whereby students gain practical experience and training for employment in broadcasting;and WHEREAS, WJHI Radio and TV is part of the Jeffersonville High School Radio and TV academic program; and WHEREAS, WJHI Radio and TV stations are student operated providing practical experience a field of study that students at most other area highs schools would not enjoy; and WHEREAS, WJHI Radio and TV has been recognized as one of the best such programs in the nation by providing practical training with state-of-the art equipment; and WHEREAS,students enrolled the Radio and TV academic program at Jeffersonville High School have the unique opportunity to gain knowledge and hands on experience by operating equipment that is utilized by professionals in the field; and WHEREAS, both the Radio and TV studios are on the cutting edge allowing students attain experience that they may immediately use in the broadcasting field; and WHEREAS, many of the students enrolled in the Radio and TV program attain employment in the broadcasting field while still attending school providing them with significant experience when they enter the job market upon graduation; and WHEREAS, the Radio and TV program also contributes to the local community with its broadcasting of high school and community events year around; and WHEREAS, since students completing the Radio and TV program have a greater opportunity to either attain employment in the broadcasting field upon graduation or to continue their studies in broadcasting at college, return to the City of Jeffersonville and attain gainful employment,the support of the Radio and TV program will benefit the local economy and generate additional tax revenue; and WHEREAS, the Commission and GCCS have negotiated an interlocal agreement for purposes of providing funding for state-of-the-art video screens that will allow students enrolled in the Radio and TV program to gain practical experience and training in broadcasting both live and recorded events at Jeffersonville High School; and WHEREAS, the City of Jeffersonville is experiencing unprecedented growth and development; and WHEREAS, such growth and development demand a qualified and trained workforce; and WHEREAS, providing funding for the Radio and TV program at Jeffersonville High School helps address the demand for a qualified and trained workforce that is necessary so the City of Jeffersonville is positioned to remain competitive in today's global economy; and WHEREAS, I.C. 36-7-25-7(e) allows for the Commission to spend not more than 15%of the allocated tax proceeds its receives on an annual basis for fund a program that provides education, work training, worker retraining or any other designed to prepare individuals to participate in the competitive and global economy; and NOW, THEREFORE, BE IT RESOLVED by the Jeffersonville Redevelopment Commission that it hereby amends Resolution No. 2023-R-7 to incorporate the aforementioned and hereby adopts the following findings: 1. GCCS qualifies as an eligible entity for purposes of I.C. 36-7-25-7(a); and 2. The subject matter of the attached interlocal agreement is designed to provide educational and work training for individuals to participate in the competitive and global economy for purposes of I.C. 36-7-25-7(b); and 3. The subject matter of the attached interlocal agreement is one that will promote the redevelopment and economic development of the City of Jeffersonville, is of utility and benefit and is in the best interests of the City of Jeffersonville's residents; and 4. The funding of the attached interlocal agreement does not exceed 15%of Tax Increment Funds collected by the Commission from the appropriate allocation areas to fund the interlocal agreement; and 5. The use of the Tax Increment Funds to fund the attached interlocal agreement serves and benefits the allocation areas from which the funds are expended; and IT IS FURTHER RESOLVED by the Jeffersonville Redevelopment Commission that the attached interlocal agreement(Exhibit"A") is hereby approved and ratified. Scott Hawkins, President Jeffersonville Redevelopment Commission ATTEST: /61%A Zeri 414-1-4-'3 Duard Avery, Secretary EXIIIBIT"A" INTERLOCAL AGREEMENT ATTACHMENT A, AGREEMENT BETWEEN THE JEFFERSONVILLE REDEVELOPMENT COMMISSION THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE AND THE BOARD OF SCHOOL TRUSTEES FOR THE GREATER CLARK COUNTY SCHOOL CORPORATION THIS AGREEMENT is entered into by and between the Jeffersonville Redevelopment Commission ("JRDC"); the City of Jeffersonville, Indiana, ("the City"), through the Mayor and Common Council; and, the Greater Clark County School Corporation ("GCCS"), through its Board of School Trustees. 1. PUBLIC ENTITIES. Greater Clark County Schools ("GCCS") is an entity established under IC 20-23-4; and, the Jeffersonville Redevelopment Commission("JRDC"), is an entity established under IC 36-7-14 and maintains a Tax Increment Financing Fund ("TIFF"); and, the City of Jeffersonville("the City")is an entity established under IC 36-4-6. Each of these entities has the legal ability and authority to enter into an Inter-Local Agreement of this type. 2. PURPOSE OF AGREEMENT. GCCS,a public school corporation in the State of Indiana, is an entity whose principal function includes the provision of educational and other programs designed to prepare our community's youth for participation in a competitive and global economy. The JRDC and the City are interested in enhancing the facilities, athletic, extracurricular and academic programs at the Jeffersonville High School campus located at 2315 Allison Lane, Jeffersonville, Indiana. Such enhancement is of utility and benefit and is in the best interest of the City of Jeffersonville. The JRDC and the City recognize that Jeffersonville High School is located within the boundaries of Jeffersonville,and are desirous of assisting GCCS in said upgrades and improvements to Jeffersonville High School. The JRDC and the City further recognizes the academic value of the Radio/TV program at Jeffersonville High School as it provides opportunities for students to gain practical experience and training for employment in broadcasting. The Radio/TV program at Jeffersonville High School also contributes to the local community with its broadcasting of high school and other local events. 3. IDENTIFICATION. The Tax Increment Financing Funds to be provided to GCCS are those identified as the "The Intercity Road and/or Falls Landing TIF Districts" (`°TIF District". 4. THIS AGREEMENT PROVIDES. a) That the JRDC shall provide GCCS with Tax Increment Financing Funds from the TIF District,in the sum of$268,000.00;and, b) That GCCS will recognize and acknowledge both the JRDC's and the City's assistance toward the enhancement of the facilities, athletic and academic programs at Jeffersonville High School; and, Page 1 of 4 c) That GCCS, through this Agreement, ensures the payment of the TIF funds subject of this Agreement shall be used only as follows: towards the purchase and installation of (two) large video screens (each screen approximately 7 feet by 15 feet in size) and scorer table with video screen (approximately 20 feet wide) at Johnson Arena to be utilized by the students in the Radio/7'V program at Jeffersonville High School. GCCS shall repay the JRDC in the event GCCS does not make the aforementioned purchases within six(6)months;and This purpose has been established for the benefit of the School Corporation's students, faculty, employees, administrators, general public and citizens of the City and surrounding communities for both economic and redevelopment benefit. In consideration of the JRDC and the City gifting the aforementioned funds, GCCS hereby agrees that the City of Jeffersonville shall receive prominent signage measuring at least 2 feet by 15 feet(or equivalent square footage of signage) attached to each video screen. Additionally, GCCS agrees that the City of Jeffersonville shall receive digital signage at the scorer table, which shall not be less than twenty-five percent(25%) of the signage available on the table. All signage for the City of Jeffersonville shall continue for the duration of this Agreement even in the event the video screens and/or scorer table are removed,altered,or replaced. The sign content for the City of Jeffersonville shall be provided by the Mayor with the content chosen and changed at his/her sole discretion. 4. DURATION. This Inter-Local Agreement shall begin at such time when all parties have signed this Agreement and has been appropriately recorded and remain in full force and effect from the time it is executed by all parties for twenty-five (25) years. This Agreement shall survive changes in administration or commission members of said entities. 5. MANNER OF FINANCING, STAFFING AND SUPPLYING THE JOINT UNDERTAKING AND OF ESTABLISHING AND MAINTAINING A BUDGET THEREFORE. a) Manner of Financing: GCCS is being honored with a gift of $268,000.00 in TIP proceeds to be used per this Inter-Local Agreement. GCCS shall be responsible for the costs related to those uses from the TIP proceeds. b) Staffing: GCCS will provide the necessary staffing for subject matter set forth in this Agreement. c) Maintenance of Budget: JRDC will maintain records of the budget for the TIF funds provided and GCCS will maintain records of the funds used per this Inter-Local Agreement. d) Supplying the Joint Undertaldng: By the JRDC providing TIF funds for this project; and GCCS making the purchases set forth in Section 4 of this Agreement, the joint undertaking will be accomplished. 6. ADNIINISTRATION.This Agreement shall be administered by Director of Redevelopment and Mayor of the City of Jeffersonville with regard to the TIF district funds and the GCCS Superintendent of Schools, or his designee with regard to the use of said funds. These Page 2 of 4 1 individuals shall be authorized to perform all duties, as applicable to their responsibilities, to carry out all functions as are necessary to effectuate the purpose of this Agreement. 7. METHODS THAT MAY BE EMPLOYED IN ACCOMPLISHING THE PARTIAL OR COMPLETE TERMINATION OF THIS AGREEMENT. This Agreement shall terminate upon the expiration of twenty-five (25) years, as set forth in Section 4 of this Agreement;unless amended by joint agreement of all parties. 8. ACQUIRING, HOLDING AND DISPOSING OF PROPERTY. Any property to be acquired,held or disposed of related to this Agreement will be GCCS property. 9. PAYMENT SCHEDULE. Payment per the terms of this Agreement shall be made upon the approval of this Agreement by all parties. 10.APPROVALS. FILING. The parties agree that upon final approval of all three(3) entities, the Resolutions and this Agreement, known as Attachment A, in each document shall be returned to the Superintendent of Schools for the Greater Clark County School Corporation and GCCS will record the Agreement. Recorded copies of the Agreement shall be provided by the Superintendent of Schools to IRDC and the City. Within sixty (60) days of the date the Agreement takes effect, all parties shall file a recorded copy with the county auditor and the State Board of Accounts for audit purposes pursuant to IC 36-1-7-6.
