BEFORE THE JEFFERSONVILLE REDEVELOPMENT COMMISSION
STATE OF INDIANA
A RESOLUTION APPROVING WAIVER AND
RELEASE OF RESTRICTIONS ON REAL ESTATE
WHEREAS, the City of Jeffersonville Department of Redevelopment owned certain real
estate as described in attached Warranty Deed (see Exhibit"A"); and
WHEREAS, the City of Jeffersonville Department of Redevelopment conveyed said real
estate on October 13, 1993 to Maxine Ransdell; and
WHEREAS, the conveyance to Maxine Ransdell included a restriction that nothing was
to be built on the adjoining parcel of real estate; and
WHEREAS, the Jeffersonville Redevelopment Commission on behalf of the Department
of Redevelopment finds that the surrounding area of the real estate has developed in a manner
not anticipated at the time of the imposition such said restriction, so as to change the character of
the area and to make said restriction burdensome rather than of benefit for development; and
NOW, THEREFORE, BE IT RESOLVED by the City of Jeffersonville
Redevelopment Commission that the attached"Waiver and Release of Restrictions" (see Exhibit
"B") is hereby approved; and
IT IS FURTHER RESVOLED by the City of Jeffersonville Redevelopment
Commission that its President is hereby authorized to executed the "Waiver and Release of
Restrictions"; and
IT IS FURTHER RESOLVED by the City of Jeffersonville Redevelopment
Commission that the attached "Waiver and Release of Restrictions" shall be recorded at the
Clark County Recorder Office.

in consideration of the sum of One Dollar ($1.00) and other good
and valuable cons-derations, the receipt of which is hereby
acknowledged,

the following described real estate in Clark County, State of

enlargement to the City of Jeffersonville,
Clark County, Indiana .
The Grantee assumes and agrees to pay all taxes assessed

This conveyance is made to convey a non-buildahle lot to the
ad;oining parcel of real estate. It is understood and agreed by
Maxine Ransdell that upon acceptance of this deed, she will attempt
▪ to build no individual structure upon it, but will have rights of
ownership of the one half lot only. Further it is agreed that any
future building permits would require the incorporation of this
• legal description into the existing legal description of the
premises at 823 Meigs Avenue, Jeffersonville, Indiana, for one
' unified lot for building purposes.

WAIVER AND RELEASE OF RESTRICTIONS
WHEREAS, in a deed from the City of Jeffersonville Department of Redevelopment,
Clark County, State of Indiana to Maxine Ransdell, Clark County, State of Indiana dated October
13, 1993, and recorded on October 14, 1993 in Deed Drawer 3 / strument 16090 of the Clark
County Recorder, Indiana records, the said deed imposed certain restriction and condition upon
the real estate in Clark County, Indiana, described as follows:
The Southern half of lot number fourteen (14), in the block number ninety-seven
(97), of the enlargement to the City of Jeffersonville, Clark County, Indiana.

WHEREAS, said conveyance was made to convey a non-buildable lot to the adjoining
parcel of real estate whereby it was understood and agreed that Maxine Ransdell would not
attempt to build no individual structure upon it.
WHEREAS, the use of such real estate and the surrounding area has developed in a
manner not anticipated at the time of the imposition of such restriction and conditions, so as to
change the character of the area and to make such restriction and condition burdensome rather
than of benefit for development.
NOW, THEREFORE, the undersigned, who is the prior owner of the real estate
hereinabove described, do hereby waive, release, abandon and forever discharge said restriction
and condition heretofore imposed on said land by the City of Jeffersonville Department of
Redevelopment, hereby discharging the portions of said real estate owned by the others of all
