HomeMy WebLinkAbout2024-01 Certificaions of Promotions (BPW approved 8/28/24) STATE OF INDIANA BEFORE THE CITY OF JEFFERSONVILLE FIRE MERIT COMMISSION RESOLUTION NO.2024-01 WHEREAS,pursuant to Ind. Code § 36-4-6-2,the City of Jeffersonville Common Council (hereinafter the"Council"),is the legislative body of Jeffersonville City government; and, WHEREAS,pursuant to Ind. Code § 36-8-2-3,the City of Jeffersonville has established, maintains, and operates a fire fighting and fire prevention system to preserve public safety and provides facilities and equipment for that system(hereinafter, collectively referred to as the "Department"); and, WHEREAS,pursuant to Ind. Code § 36-8-3.5-10,the duly appointed City of Jeffersonville Fire Merit Commission(hereinafter the"Commission") adopted the City of Jeffersonville Fire Merit Commission Rules&Procedures(as amended from time-to-time by the Commission,pursuant to amendment procedures set forth in City of Jeffersonville Fire Merit Commission Rules and Procedures) (hereinafter, collectively referred to as the "Rules"); and, WHEREAS,pursuant to Ind. Code § 36-8-3.5-13 and Ind. Code § 36-8-3.5-14,the Commission is responsible for establishing the weight given to each of the statutory factors to be considered during the promotions process,the competitive examination procedures, and the establishment and certification of the Promotions Eligibility List for each rank; and, WHEREAS,pursuant to Ind Code § 36-8-3.5-13,the Commission shall establish and certify a Promotion Eligibility List for each rank,which"consists of members who have been placed on the list in order of their cumulative score on all rating factors," and the duly appointed members of the Commission have adopted Rule&Procedure No. 5 Promotions within the Department, Section II, which establish the procedures for calculating the factors used in the weighted composite scoring; and, WHEREAS, according to Ind. Code § 36-8-3.5-13(c) and Rules&Procedure No. 5: Promotions within the Department, Section II, Subsections H Promotion Eligibility List, the list shall be maintained for two (2)years from the date of certification, after which time the list shall be retired and a new list established. The retired list shall be kept for five (5)years and then destroyed";and, WHEREAS,the prior Promotions Eligibility List was certified on November 6,2022, and pursuant to Ind. Code § 36-8-3.5-13(c) and Rules& Procedure No. 5: Promotions within the Department, Section II, Subsections H Promotion Eligibility List,the prior Promotions Eligibility List is set to expire on November 6, 2024 as more than two (2) years will have passed from the date of certification; and WHEREAS, the duly appointed members of the Commission have conducted written examinations and interviews of eligible members of the Jeffersonville Fire Department in conformity with the Rules adopted by the Commission and Indiana Statutes governing Police and Fire Merit Systems, and prepared a proposed Promotions Eligibility List, of eligible members with passing scores from highest to lowest score, based on the results; and WHEREAS, by Resolution requiring a majority vote of the Commission, the Commission would resolve to approve Resolution 2024-01, effective November 7,2024, certifying the Promotions Eligibility List to the Board of Public Works and Safety on the effective date. The Promotions Eligibility list is attached as "Exhibit A," incorporated herein by reference into this resolution. SO APPROVED THIS 2 2n d DAY OF 41.13 U S- , 2024.
