ORDINANCE REZONING CERTAIN PROPERTY FROM
M-l, INDUSTRIAL (COUNTY), TO _~'~, CC~E
BE IT ORDAINED by the Common Council of the City of
Jeffersonville, Indiana, that the Zoning Ordinance be amended
in that the property in the name of Wilson E. Prentice, herein
described, is reclassified and rezoned from M-l, Industrial
94-1/2 acres in Survey No. 21 of the Illinois Grant which was
assigned and set off to Lucinda Wslkup, wife of Andrew Walkup,
formerly Lucinda Adams, daughter of Mathew Adams, deceased, in
the partition of the real estate of Mathew Adams, deceased, which
was confirmed ~in the Court of Common Pleas of said County at the
May term 1864, and designated as Lot No. 6 on the Plat of said
partition, being the land o~ned by said Mathew Adams, deceased,
at the time of his.death, in said Lot 21 of said grant which lles
between the center'of the Jeffersonville and Charlestown Turnpike
and the center road bed of the Ft. Wayne and Southern Railroad,
now the B & O S. W. R. R.
Also, part of Survey No. 20 of the Illinois Grant bounded thus:
Beginning at a stone in the center of the highway leading from
Jeffersonville to Charlestown and in the original line dividing
Surveys 20 and 21 of said Grant; thence S. 18 deg. 40' W. with
the center of said highway 1i links to a stake near a beech tree;
thence S. 40 deg. E. 9 chains and 97 links to a stake near a
beech and small poplar; thence N. 49 deg. E. 9 chains and 44
links to a stake' near a beech tree in the original line
aforesaid~ thence with said~ llne N. 40 deg. W. 15 chains and 47
links to the place of beginning, containing 12 acres and in all
106-1/2 acres, more or less.
Excepting therefrom, being part of Survey No. 21 of the Illinois
Grant, Clark County, State of Indians, more particularly
described as follows: Beginning at the most southerly corner of
said Illinois Grant N~. 21, said point being the true point of
beginning; thence with the line between Survey Nos. 20 and 21, N.
35 deg. 42' 28" W. 550.001'.to & point; thence leaving said Grant
Line on a line bearing N. 54 deg. 17' 31" E. a distance of
412.803' to a point; thence N. 22 deg. 53' 00" E. 21.848' to a
point; thenoe S. 67 deg. 07' 00" E. 195.000' to.a point; thence
S. 22 deg. 53' 00" W. 40.000' to a point; thence S. 67 deg. 07'
00" E. 280.000' to a point; thence S. 22 deg. 53' 00" W. 270.000'
to a point, said point being in the line between Survey Nos. 21
and 11 of said Illinois Grant; thence with said Grant Line S. 55
deg. 03' 41" W. 414.453' to a point, the true point of beginning,
containing 6.8009 acres more or less, being part of that land
acquired by Prentice by Deed Record 281 beginni~g at Page 267.
Also excepting therefrom, being part of survey No. 21 of the
Illinois Grant, Clark County, State of Indiana, more particularly
described as follows: Beginning at the most southerly corner of
said Illinois Grant No. 21, thence with the line dividing Surveys
No. 20 and 21, N. 35 deg. 42' 28" W., 560.001' to a point, said
point being, the true point of beginning; thence continuing on
said Grant Line N. 35 deg 42' 28" W., 330.000' to a point; thence
N. 54 deg. 17' 31" E., 370.00' to a point; thence S. 35 deg. 42'
28" E., 340.000' to a point; thence S. 54 deg. 17' 31" W.,
220.000' to a point; thence N. 35 deg. 42' 28" W., 10.000' to a
point; thence S. 54 deg. 17' 31" W., 150.000' to a point, the
true point of beginning, containing 2.8535 acres more or' less,
being part of that land acquired by Prentice in Deed Record 281,
beginning at Page 267.
Also excepting therefrom, being parts of Surveys 20 and 21 of the
Illinois Grant, Clark county, State of Indiana, More particu-
larly described as follows: Beginning at the most southerly
corner of Survey No. 21 of the Illinois Grant, thence with the
line dividing Surveys No. 20 and 21 of said Illinois Grant, N. 35
deg. 42' 28" W., 890.00' to a point, the true point of beginning,
thence continuing with said line dividing Surveys No. 20 and 21
N. 35 deg. 42' 28" W. 49.23' to a point, thence S. 53 deg. 34'
47" W., 626°44' to a point thence N. 35 deg. 37' 56" W. 664.82 to
a point in the center of the Jeffersonville-Charlestown Pike. A
public road thence with the centerline of said road N. 24 deg.
11' 15" E. 402.55' to a point thence leaving said road S. 65 deg.
48' 45" E. 495.00' to a point thence N. 24 deg. 11' 15" E. 40.00'
to a point thence S. 65 deg. 48' 45" E. 140.00' to a point;
thence N. 66 deg. 11' 15" E.'44.00' to a point; thence S. '74 deg.
17' 01" E. 402.69' to a point; thence S. 35 deg. 42' 28" E.
55.00' to a point; thence S. 54 deg..17' 32" W. 370.00' to a
point, the true point of beginning, containing 12.4572 acres,
more or less.
This Ordinance shall be in full force and effect upon
its timely passage, promulgation and approval by the Mayor.
