MINUTES
July 31,2024

PRESENT(VIRTUAL):
CALL TO ORDER: Mayor Mike Moore called the meeting to order at 9:30 a.m. in the Mayor's Conference
Room in City Hall. The meeting was held in person and streamed on the City's Website. Andy Crouch and
Rob Waiz served on the board.
APPROVAL OF THE MINUTES: Mr. Crouch made the motion to approve the minutes from July 24, 2024. Mr.
Waiz seconded the motion; motion passed, 3-0.
APPROVAL OF PAYROLL: Mr. Waiz made the motion to approve the payroll. Mr. Crouch seconded the
motion; motion passed, 3-0.
OLD BUSINESS:
NEW BUSINESS:
1. Les Merkley/Kevin Morlan-Bid Opening regarding purchase of two (2) 2025 Single Axle Dump
Trucks for the Street Department— Mr. Merkley advised this bid opening was for the purchase of
two 2025 Single Axle Dump Trucks for the Street Department. Only one bid was submitted and it
was from Kentucky Truck Sales. The unit price per truck is $223,371 for a total amount of$446,742.
Mr. Merkley recommended the board take the bid under advisement so he and Mr. Morlan can
review it.
Mr. Crouch made a motion take the bid under advisement and Mr. Waiz seconded the motion;
motion passed, 3-0.
2. Andy Crouch-Request for approval of 4-way stop conversion at the intersection of Market and
Missouri—Mr. Crouch advised they are currently working on paving operations on Market Street
and they have been looking at Market and Missouri and discussed with JPD about requesting to
make Market and Missouri a four way stop, currently Market comes through.
Mr. Waiz made a motion to approve the conversion and Mr. Crouch seconded the motion; motion
passed, 3-0.
3. Kim Calabro-Request for approval of contract between the City and Trailiant for cybersecurity and
anti-harassment training— Mrs. Calabro advised this contract is for the ongoing cybersecurity and
anti-harassment training. They are getting a better rate by signing a 3 year contract and she does
have the money in her budget.
Mr. Crouch made a motion to approve the contract and Mr. Waiz seconded the motion; motion
passed, 3-0.
4. Jason Sharp- Request for approval of Automatic Aid Agreement between the Jeffersonville Fire
Department and Utica Fire Department — JFD Deputy Chief Sharp advised this was a request for
approval for an automatic aid agreement between the City of Jeffersonville and the Utica Fire
Department. Mr. Crouch asked if this had been reviewed by legal and Mayor Moore confirmed it
has.
Mr. Crouch made a motion to approve the Automatic Aid Agreement and Mr. Waiz seconded the
motion; motion passed, 3-0.
5. Len Ashack-Request for approval of road closure on Main Street from 10th Street to Plank Road on
August 5, 2024 from 7:00 am to 8:00 pm for sewer lining project(road will be open to local traffic
but closed to through traffic;detour will be in place)—Mr. Ashack advised this would be closed to
through traffic but open to local traffic from 7:00 am until 8:00 pm to make sure all of the laterals are
staged.
Mr. Crouch made a motion to approve the closure and Mr. Waiz seconded the motion; motion
passed, 3-0.
6. Cameron Teeter with MAC Construction Closure Request—Mr.Teeter advised he is the project
manager on the Charlestown Jeffersonville Pike/Utica Sellersburg Phase 1 project. They are
currently working with the City and JTL on the realignment of the waterline within the westbound
lane of Utica Sellersburg. The would like to begin the road closure on August 12, 2024. It will be
closed to through traffic only and will be closed through the end of October. Once they begin the
portion of the box culvert which will begin immediately after the waterline is completed the road
closure will look to continue. Mayor Moore advised Katie Sutter with ProMedia this will need to be
publicized. We have been anticipating this for about three years and now the infrastructure work
has begun.
Mr. Teeter advised it would be closed from the intersection of Charlestown Jeffersonville Pike to
Keystone Blvd.
Mayor Moore instructed the Schools would also need to be made aware of this closure.
Mr. Waiz made a motion to approve the closure and Mr. Crouch seconded the motion; motion
passed, 3-0.

Automatic Aid Agreement
July 26, 2024
This AUTOMATIC AID AGREEMENT is entered into this 27th day of July, 2024 by and between the Utica
Township Fire Department(UFD)and Jeffersonville Fire Department(JFD).
AUTOMATIC AID RESPONSE AREA:
This agreement shall apply to incidents requiring the need of a fire department response for structure
fires in residential,commercial, recreational, and rural properties in the Utica Township Fire District.
Jeffersonville Fire Department response plan to areas protected by Utica Fire Department:
Incidents received by Clark County Central Alarm for addresses or occupancies within the defined are of
the Utica Township Fire District shall result in the automatic,simultaneous response from both Utica
Fire Department and Jeffersonville Fire Department.Jeffersonville Fire Department will respond:
1. to all reported structure fires within the Utica Township Fire Protection district with two(2)
Engine Companies,one(1) Ladder Company,and one(1)Command Officer.
2. to all rescues/entrapments with one(1) Engine Company, one (1)Truck Company, and one(1)
Command Officer.
3. to any medical call where the patient is unconscious or unresponsive with one(1) Engine/Truck
Company.
This Automatic Aid Agreement shall be in effect twenty-four(24) hours per day, seven(7)days per
week,three hundred sixty-five(365)per year.
No Reimbursement for Costs: No party in this Agreement shall be required to reimburse any other party
for the cost of providing the services set forth in this Agreement. Each party shall pay its own costs for
responding to the Emergency Incidents within the described Automatic Aid Agreement.
Command at an Emergency Incident:The first arriving unit on any emergency incident will establish an
incident command management structure that is consistent with NIMS.All responding personnel will
operate accordingly under the command structure established and will work at all times in assigned
sectors.
Radio Communications: Responding Jeffersonville Fire Department units to Emergency Incidents within
the Utica Township Fire District will use Fire Ground 4 or a chanel assigned by Clark County Central
Alarm or UFD.
Responding units shall anticipate the command to switch all radio traffic to a fire ground or tactical
channel at multi-company incidents.

Liability/Indemnification: Each party shall waive all claims against the other party for compensation for
any property loss or damage,and/or personal injury or death occurring as a consequence of the
performance of this Agreement. Each party shall bear the liability and/or cost of damage to its
equipment and the death of,or injury to, its personnel,whether the death, injury or damage occurs at
an emergency within the described boundary.To the extent allowed by law, each department shall
indemnify,defend and hold harmless all other parties for damages,claims, demands,suits,judgments,
costs and expenses arising from loss of or damage to private property and/or the death of or injury to
private persons whether caused by either department responding within the parameters of this
Agreement. Provided, however, nothing contained herein shall expand the immunity of a party granted
to It by law.
With respect to"Command at the Emergency Incident"as provided for above, each party waives all
claims against the other party for compensation for any property loss or damage, and/or personal injury
or death occurring as a consequence of any negligent acts,conduct, instructions or commands given by
the individual that assumes command(Incident Commander)at any Emergency Incident.This provision
shall not apply to any acts,conduct,instructions or commands given by an officer in the capacity of
Incident Commander,which are later determined at any time to have been grossly negligent,willful,
wanton or reckless.
Termination of Agreement: Either party may withdraw from this Agreement by giving thirty(30)days
written notice to the other party by certified mail.
Prior Agreements:This Agreement supersedes any other previous Agreements, either written or verbal,
that may have existed to define the response of the two fire departments in this area.
