Yes or No Amended Contract Amount: Purpose: new K9 handler training For Clerk's Office to fill out . • Date uploaded to Gateway: HANDLER/CANINE CONSULTING CONTRACT This AGREEMENT made this 11 day of June , 20 24 by and between POLICE SERVICE DOG CONSULTING, LLC (PSD), whose mailing address is 4201 Limestone Trace, Jeffersonville, IN 47130,and Jeffersonville Police Department Hereinafter referred to as CONSULTEE. whose mailing address is 2218 E. 10th Street Jeffersonville, IN.47130 WHEREAS, CONSULTEE desires that PSD provide advice and assistance in handler/canine training for law enforcement services as set forth below. NOW THEREFORE, in consideration of the foregoing and for other good and valuable consideration, the parties, intending to be legally bound, mutually agree as follows: I. CONSULTEE agrees to make available the following teams: HANDLER CANINE NAME AGE BREED AREA(S) OF TRAINING Sgt. Leverett Dunko 1 Mal Basic handlers course in narcotic detection,cocaine, heroin,and meth.Patrol;obedience.area and article search building search tracking and criminal apprehension Basic Off. Happle Lobo 1 Mal/Dutch handlers course in firearm detection,gun/gun parts.Patrol: obedience,area and building search.tracking and criminal apprehension.Classroom.K9 behaviors.first aid and case law. II. PSD agrees to perform consulting services of ongoing handler/canine training maintenance for canines subject to the following terms and conditions. TYPE OF TRAINING: Basic handlers course, dual purpose Narcotic and Firearm detection and patrol a. The consulting period shall run for a period of 06/24/2024 08/23/2024 commencing on the date written above. b. This AGREEMENT may be terminated by either party,with or without cause, upon thirty(30)days prior written notice to the other. Upon termination of this AGREEMENT for any reason, PSD shall be entitled to receive such compensation and reimbursement , if any,accrued under the terms of this AGREEMENT but unpaid as of the date PSD ceases work under this AGREEMENT. c. The consulting time per month will total 40hr week hours to be divided between 8 weeksessions. Officer Happle and K9 will do 8 weeks. Sgt. Leverett and K9 will do 6 weeks. d. Training will be held at the CONSULTEE'S facility(unless otherwise noted and agreed upon). The location may change due to type of training, weather, or scheduling changes. e. PSD shall render services at such times as mutually agreed upon by the parties and hereby expressly include the following days and times: TBD as well as location. f. Should a schedule change be required, a make-up session will be held within 30 days at a time and location to be determined by PSD. Should a schedule change be made within seven(7)days or less of the originally scheduled training day, and said canine team(s)is unable to attend due to work obligations, CONSULTEE will be credited for that month's pro-rated fee. Otherwise, CONSULTEE is responsible for payment of fees regardless of attendance or absence on training days. g. All persons or their departments are responsible for their own insurance coverage. CONSULTEE hereby assumes all risk of and responsibility for, and agrees to indemnify and hold harmless PSD, its agents, and other persons,departments, and/orcanines, from and against any and all claims,demands, suits, actions, recoveries,judgments, costs, and expenses made, brought,or obtained on account of loss of life, loss of property, and/or injury or damage to the person or property of any person or persons whomsoever, due to the negligence of PSD or any agent or employee of PSD, or due to the negligence and/or fault,be it known or unknown, of the CONSULTEE or its agent or employee,whether such person or Page 1 of 2 persons be PSD, its agents or employees,or CONSULTEE, its agents or employees, or any third person in any way connected with either of the parties hereto,which loss of life or property, or injury or damage to persons or property,shall be due to or arise out of,result from, or be in any way connected with this AGREEMENT or services provided under this AGREEMENT or from, or be in any way connected with this AGREEMENT or services provided under this AGREEMENT or any work done thereunder or business carried on by PSD. h. ADDING OR REMOVING A TEAM FROM AN EXISTING CONTRACT: In the event that any part of the team becomes decommissioned or unable to perform their duties during the contract period, CONSULTEE must notify PSD within seven (7)days of the date of the incident. CONSULTEE has the option to replace the canine, handler, or team by designating, in writing, the name and identifying information of the new replacement.CONSULTEE will not be billed for services under the terms of the contract until such time as the replacement team is ready for maintenance training. Designation of a replacement canine, handler,or team shall not extend the contract period. In the event that CONSULTEE does not choose to exercise its option to replace any part of a decommissioned team. PSD will cancel the contract and discontinue billing or refund monthly amounts already paid by CONSULTEE after said incident. III. CONSULTEE agrees to pay dollars per month per team to be paid within thirty(30)days following receipt of invoice until such time as this AGREEMENT be terminated or completed as agreed by the parties or as specified herein. CONSULTEE will be invoiced on the first day of the billing period. Choose and circle one of the following: MONTHLY ❑ QUARTERLY ANNUALLY EI IV. This AGREEMENT is made and entered into in the state of Indiana and shall be enforced and interpreted under the laws of the state of Indiana. The terms of this AGREEMENT and any disputes shall be resolved in accordance with the laws of the state of Indiana. Jurisdiction and venue shall be Clark County, Indiana. Should a court of competent jurisdiction and venue determine that any of the terms or conditions of this AGREEMENT is unlawful or unenforceable; such determination shall not affect the validity or enforceability of any remaining terms or conditions of this AGREEMENT. V. MISCELLANEOUS CONDITIONS: $30 per hr for Happle for 8 weeks =$9,600.00 $25 per hr for Leverett for 6 weeks = $6,000.00. Additional training maybe needed at quoted per hr per team cost. The foregoing represents the entire AGREEMENT between the parties.
