MINUTES
May 22,2024

PRESENT(VIRTUAL):
CALL TO ORDER: Andy Crouch called the meeting to order at 9:31 a.m. in the Mayor's Conference Room
in City Hall. The meeting was held in person and streamed on the City's Website. Clark Miles and Amy
Huffman served on the board.
APPROVAL OF THE MINUTES: Mr. Miles made the motion to approve the minutes from May 15, 2024.
Mrs. Huffman seconded the motion; motion passed, 3-0.
APPROVAL OF PAYROLL: Mr. Miles made the motion to approve the payroll. Mrs. Huffman seconded
the motion; motion passed, 3-0.
OLD BUSINESS:
NEW BUSINESS:
Larry Wallace-Hearing regarding 211 Webster Blvd., home owner, Robin Montgomery on
review of compliance with Building Commissioner enforcement— Mr. Merkley asked if the
property owner, Robin Montgomery was present or anyone on behalf of the property and
nobody came forward. Mr. Merkley stated for the record they did have service on the owner of
record for the property at 211 Webster Blvd which is Robin Montgomery. Certified mail was
sent to the owner at the listed address of 8361 Pekin Road in Greenville, Indiana and they have
proof that there was service. Mr. Merkley asked Mr. Wallace to explain the status of the
property. Building Commissioner Larry Wallace advised the property had gutters and gutter
boards hanging down, there was an overgrowth of vegetation, and the back deck was a danger.
Mr. Wallace stated he is requesting permission to go in and be able to take the gutter down and
the gutter boards, repair or remove the back deck and remove the overgrown vegetation in the
front of the house. Mr. Wallace advised his department has already cut back the overgrown
vegetation twice and invoiced the property owner. Mr. Merkley asked Mr. Wallace if there
were pictures of the current condition of the home and Mr. Wallace submitted the pictures of
the structures current condition for the record and board review. Mr. Merkley asked Mr.
Wallace if it was in his opinion as the Building Commissioner for the City of Jeffersonville that
this property had become a public nuisance. Mr. Wallace stated that was correct. Mr. Merkley
asked if the public nuisance was a result of the current condition of the structure on the outside.
Mr. Wallace said that was correct. Mr. Merkley asked Mr. Wallace if the building had not been
maintained to the standards set forth by the City's Building Code. Mr. Wallace stated yes. Mr.
Merkley asked if the property was vacant and Mr. Wallace advised the property was vacant. Mr.
Merkley asked Mr. Wallace if it was his opinion as the Building Commissioner that the structure
has not been maintained in a manner that would comply with the requirements of the City's
local ordinance and Indiana's Building Code. Mr. Wallace confirmed that was correct.
Mr. Merkley requested the record reflect the hearing took place and evidence testimony was
presented. Mr. Merkley requested the motion be that the property owner has 10 days to
remove the gutter and gutter board, repair or remove the back deck, and remove the
overgrown vegetation around the structure. If that's not done within 10 days the Building
Commissioner is directed to take action to have it completed. Mr. Merkley advised he would
prepare the order to send the property owner.
Mrs. Huffman made a motion that the property owner has 10 days to remove the gutter and
gutter board, repair or remove the back deck, and remove the overgrown vegetation around the
structure and if that's not done within 10 days the Building Commissioner is directed to take
action to have it completed; Mr. Miles seconded the motion; motion passed, 3-0.
1. Paul Northam-Request for approval of special events application for the following events:
Assistant Parks Director Amber Ridings requested approval for the events that were approved in
the Special Events Committee. The events were:
• The Euro District car show on October 5, 2024 at Fisherman's Wharf from 11:00 am to
5:00 pm
• The Wine Walk on July 26, 2024 on Spring Street from 5:30 pm to 9:00 pm
• The 4th of July Parade on July 4 2024 on Spring Street at 10:00 am.
Mr. Crouch asked if all of these could be approved at once and Mr. Merkley advised they could.
Mr. Miles made a motion to approve the special events applications and Mrs. Huffman
seconded the motion; motion passed, 3-0.
ATTORNEYS REPORT:
Mr. Merkley stated he had nothing for the attorneys report.
ADJOURNMENT:
With no further business, Mr. Miles made a motion to adjourn at 9:36 a.m.
