Pursuant to Agreement for Technical Services dated January 20, 2022
Project Information •
Services Name: Use Attainability Analysis(UAA) Preparation for Cane Run Creek and Ohio River
Services Description: ENGINEER will prepare a UAA in accordance with Indiana Department of
Environmental Management (IDEM) and United States Environmental Protection Agency (USEPA)
guidance. OWNER intends to submit the UAA in accordance with its approved Combined Sewer
Overflow (CSO) Long-Term Control Plan (LTCP) to IDEM for approval. If a UAA is required for the
Ohio River, additional submittals will be required for the Ohio River Valley Water Sanitation
Commission (ORSANCO) and Kentucky Division of Water(KDOW).
Scope of Services
ENGINEER will provide the following services to OWNER:
l. Attend one project kickoff meeting with OWNER.
2. Attend up to three meetings with OWNER and IDEM to discuss the change in use for Cane Run
Creek and need for a UAA for the Ohio River.
3. Attend up to one meeting with OWNER and ORSANCO to discuss the need for a UAA on the
Ohio River.
4. Attend up to one meeting with OWNER and KDOW to discuss the need for a UAA on the Ohio
River.
5. Review existing water quality data including the Stream Reach Characterization Evaluation and
Report previously completed by OWNER and publicly available water quality sampling of Cane
Run Creek and Ohio River. Provide request for additional water quality data collection needs to
OWNER. OWNER shall provide additional water quality data collection and analysis.
6. Provide a narrative discussion regarding existing land use in Cane Run Creek. Discuss attainment
of exiting water quality criteria in Cane Run Creek and the potential factors preventing
attainment of the currently designated use.
7. Provide a narrative discussion regarding existing land use along the Ohio River. Discuss
attainment of exiting water quality criteria in Ohio River and the factors preventing attainment
of the currently designated use.
8. Prepare a desktop water quality model of the Ohio River to analyze the time and duration of the
Wet Weather Limited Use classification in accordance with IDEM policy.

9. Assist OWNER with conducting a public information meeting to present the UAA findings.
10. Prepare a report summarizing the UAA findings for Cane Run Creek and submit the report to
IDEM and USEPA. The UAA is anticipated to recommend the Cane Run Creek designated use
be changed to a Limited Use Stream subcategory. The UAA may use Factor 2 (natural
ephemeral, intermittent, or low flow levels prevent attainment of use), Factor 3 (human caused
conditions or sources of pollution prevent the attainment of the use and cannot be remedied or
would cause more environmental damage to correct than to leave in place), Factor 4 (dams,
diversions, or hydrological modifications preclude attainment of use), and/or Factor 6(controls
more stringent would result in substantial and widespread economic and social impact). The
report will incorporate past and current Financial Capability Assessment.
11. Prepare a report summarizing the UAA findings for the Ohio River and submit the report to
OWNER, IDEM,ORSANCO, KDOW,and USEPA.The UAA is anticipated to recommend the
Ohio River in proximity to OWNER's CSOs designated use be changed to CSO Limited Wet
Weather Use subcategory during and after combined sewer overflow events. The UAA may use
Factor 3 (human caused conditions or sources of pollution prevent the attainment of the use and
cannot be remedied or would cause more environmental damage to correct than to leave in place),
Factor 4 (dams, diversions, or hydrological modifications preclude attainment of use), and/or
Factor 6(controls more stringent would result in substantial and widespread economic and social
impact). Report will incorporate past and current Financial Capability Assessment.
12. Respond to comments from OWNER, IDEM,ORSANCO, KDOW,and USEPA.
Compensation
OWNER shall compensate ENGINEER for Services under this Task Order on an hourly rate basis plus
expenses an estimated fee of$100,000.
Schedule
Services will begin upon execution of this Task Order, which is anticipated the week of March 4, 2024.
Services are scheduled for completion on June 30,2025.
