Brandenburg, KY 40108 Phone: 270-945-5039 mike@funtimepros.com CONTRACT This agreement is entered into this the 2nd day of January,2024, by and between the City of Jeffersonville whose address is 500 Quartermaster Ct. Room 205,Jeffersonville, IN 47130 and whose phone number is 502-468-1752 and Fun Time Productions, LLC. 1. Fun Time Productions, LLC agrees to bring the Coastal Express trackless train to the City of Jeffersonville Steamboat Nights on Oct.4th and Oct. 5th located in Jeffersonville, IN for a set fee of$7,000 and has that date exclusively held for Amber Powell. Terms: 50% security deposit($3,500)with signed contract by January 31,2024 to hold date and remaining balance payable 30 days prior to arrival. 2. The route for the train to travel will be determined upon arrival and set up. 3. Fun Time Productions, LLC will provide FREE rides for children and adults at the event during the hours of 7:00 p.m.to 10:00 p.m. on EST each night. 4. The City of Jeffersonville agrees to provide a dedicated area for the train to operate and a level area for the train to carry passengers with no steep inclines. 5. Fun Time Productions, LLC reserves the right to limit the number of rides per person in order to serve the largest number of guests possible. 6. Certain entertainment, attractions or activities that may be provided for in this agreement cannot operate safely in adverse weather conditions. In the event that Fun Time Productions, LLC makes a reasonable effort to provide contracted entertainment, attractions or activities,but is prevented or delayed in doing so due to adverse weather conditions, no refund is available to client and shall not void terms of contract. 7. The City of Jeffersonville agrees to provide a dedicated parking area for a 32ft.cargo trailer to remain parked during the event in a level location for unloading and reloading. 8. We consistently service our equipment on a strict maintenance schedule to avoid any breakdowns. In the unforeseen event that a breakdown should occur,your event would only be charged for the number of work hours that had been completed. 9. In the event of any unforeseen emergency that would prevent Fun Time Productions, LLC from fulfilling this contractual agreement, Fun Time Productions will reimburse the party named in this contract in full for the amount of time not completed in contract and will not be held liable for any reason. This includes decisions pertaining to COVID-19. 10. Customer agrees to indemnify and hold Fun Time Productions, LLC harmless from any and all claim, actions,suits, proceedings, costs, expenses, fees, damages and liabilities, in connection with or resulting from the inappropriate use of leased equipment. Fun Time Productions, LLC cannot under any circumstances, be held liable for injuries as a result of inappropriate use,God, nature, or other conditions beyond its control or knowledge. 11.
