The deposit will be returned upon lease expiration or termination when the studio key is returned '
to Public Art Administrator, and the studio is vacated within the requested time period and cleaned
according to contract standards (see Tenant Responsibilities)
LEASE AGREEMENT START DATE: Jan 1, 2024
LEASE AGREEMENT END DATE: Dec 31, 2024 .
Upon expiration of this agreement, the City has the right to renew the current lease or select a new
artist to occupy Tenant's space. **Tenants must reapply each year, within 60 days of lease
expiration, to determine eligibility for lease renewal and space availability**.
This agreement is between the artist identified above (Tenant) and the Jeffersonville Public Art
Administrator (PAA), representing the Jeffersonville Board of Public Works & Safety on behalf of the
Jeffersonville Department of Redevelopment (City) in regard to the Tenant's studio space within the
NoCo Arts Center (NAC), which is a City-owned entity that may not be transferred, assigned or
sublet to any other party without written permission given by the City.

MONTHLY RENTAL INCLUDES:
P. 24-hour access to secure facility via entry code; 24-hour keyed access to private studio space
► climate-controlled facility with accessible amenities and standard utilities (plumbing/water/electric/wifi)
► camera-monitored parking/property
IN. communal area with kitchen appliances and utility sink
► preferred access and/or discounted entry to all public events hosted in common spaces of the NAC,
including art markets, performances, and workshops. (Tenants must inquire with NAC management about
reservations/admissions before participating;some restrictions may apply).
O. promotional support from Jeffersonville Public Art Program through social media and press releases
► discounted event rental for the common spaces of the NAC'
10111T RESPONSIBILITIES:
Tenant will provide rental payment on or before the 17th of each month. Payments can be made via
postal mail or hand delivery to 500 Quartermaster Court, Suite 257, Jeffersonville IN 47130. Checks
can be made payable to Jeffersonville Redevelopment Commission. Tenant will pay one month's rent

tilplus a deposit before gaining access to the space designated in this agreement.
•Tenant will actively work with the NAC management and City by participating/volunteering in at least
two (2) public arts programming events per year.
•Tenant is required to report the following to NAC management:2
-compromised security issues (door lock malfunctions,jammed window, lost key, power outage, etc)
-witnessed/observed property damage or malfunctions (broken equipment, defective appliances,
utility concerns, clearing walkways, poisonous plants, pests, etc)
- illegal activity on premises or property(drug usage,vandalism, theft, illegal dumping, etc)
-unexpected permanent or semi-permanent spills, stains, or damage on premises or property
- low inventory or insufficient supplies required for facility maintenance/cleaning
- intent to use hazardous materials or any equipment/machinery that could cause personal injury
- intent to use temperature-regulating items in studio space (space
heaters/humidifiers/dehumidifiers/window AC unit)
- intent to store personal belongings/equipment/materials in common spaces (exception: food
storage)
- intent to host any type of event or gathering in the common spaces of the facility.
- intent to vacate the studio space and surrender keys
'Facility Rental Agreement is a separate application. Tenants will need to fill out to request a discount on event rental.
'Custodial or facility maintenance requests must be submitted in writing to the PAA.

TENANT RESPONSIBILITIES (continued):
I"4 • enant is responsible for securing the facility upon departure to prevent unauthorized access to the

public. This includes ensuring bay doors, entry doors, vent fans, and windows are tightly closed and
locked, when applicable.
atil• Tenant is responsible for locking their own studio space and securing personal/creative property upon
departure. Any working art materials/equipment in the common spaces should have a written plan with
the PAA for specified location/storage/project timeline. (Tenant will be held responsible for lost, stolen,
or damaged personal property. It is strongly encouraged that tenants have their own renter's insurance.)
• Tenant may grant controlled access to non-tenants, with the understanding that the Tenant assumes

full liability and responsibility for any activity involving their authorized guests or non-tenants.
43• Tenant is responsible for cleaning and disposing of leftover materials,food waste, and/or any
remaining messes associated with Tenant/guest activity in common or private spaces. Perishable/food
• ' waste is NOT permitted to be left out overnight. Dumpsters are located behind the facility.
r • Tenant recognizes that all resident artists are representatives of the City's Public Art Program and agree

Tenant recognizes that the NAC is a shared access space used for supporting the Public Arts Program,
INITIA and will allow for the Public Arts Program's event schedule to be prioritized over personal intentions.
I Tenants will not be guaranteed event reservations until they are communicated and confirmed with PAA.
lucs)• Tenant assumes full responsibility for any damage caused to the facility due to tenant and/or guest
activity.

any damage,loss,or injury caused by the pet. Pet(s) must be accompanied and supervised at all times.
Tenant will be responsible for proper waste disposal and for any costs associated with damaged or soiled
property caused by pet(s). Damage,loss,or injury caused by pet(s) could result in immediate termination
a ' of this contract.Tenant will provide proof of vaccination for pet(s). There will be a limit of 2 pets allowed.
Upon termination of this lease, Tenant shall yield up possession, remove all property and belongings,

vacate, CITY may take all steps necessary to remove Tenant and Tenant's property as provided by law
and Tenant shall acquire no additional rights or extension of the lease term by reason of such holding

14 days absence by Tenant with rent unpaid, or the removal of a substantial portion of Tenant's
irriWOpersonal property without explanation or notice to PAA shall be deemed an abandonment of the leased
studio by Tenant. In such event, CITY may reenter the studio immediately, take all action necessary to
remove the remaining property and belongings of Tenant and relet the studio, without notice and
without responsibility for damages resulting therefrom.

3 Tenants will also be expected to clear out trash and vacuum/sweep the floor to prepare for the next incoming renter. Ant
may be asked to repair damage(s)associated with studio habitation upon departure(wall holes,paint scratches, etc)
TENANT/FACILITY RESTRICTIONS: .,
• Smoking is prohibited in any space on the premises/property.

• Candles(Only Flameless) are allowed. Incense may be used with approval.
• Overnight stays by Tenants and/or guests are prohibited.

• Discrimination against any person due to race, color, sex, national origin, religion, age, veteran status

LEGAL ADDENDUM: �-
P. The City carries the required liability insurance for the NAC. However, if a suit is brought against "
the NAC as a result of a Tenant or their guest's activity, the Tenant could potentially be named in
the case and exposed to personal liability. The Tenant has hereby been advised of personal liability V'`
risk and may elect to secure their liability policy. �),v
► The terms of this agreement may be modified at the discretion of the City. This includes
modifications to ensure compliance with public laws, ordinances, and regulations to protect the X
and its associated entities. �+W
► The City has the right to terminate this lease agreement without cause, along with the responsi�fi
to provide 30 days of notice to the Tenant for said termination.
RELEASE AGREEMENT:
In consideration of the undersigned's use of space at the NoCo Arts Center, the undersigned hereby inderr ies''
and holds harmless the City of Jeffersonville, the Jeffersonville Board of Public Works and Safety, the 4r
Jeffersonville Redevelopment Commission, and the NoCo Arts Center-along with its directors, officers, and
agents- from and against any and all injuries, damages, claims, actions, causes of action, liability(including
liability for negligence), and expenses (including attorney's fees) arising from in any manner connected with thyme

use of the said facility by the undersigned. The undersigned further hereby fully releases and discharges, h�1 . '
NAC and its directors, officers, employees, and/or agents from all known/unknown and ��//
anticipated/unanticipated occurrences, arising from, or in any manner connected with, any such claims,
demands, damages, actions or causes of action.
