HomeMy WebLinkAbout1991-R-22 RESOLUTION NO. 91-R-~ RESOLUTION CLARIFYING DEPARTMENT OF'REDEVELOPMENT DEED DEFICIENCIES WHEREAS, the Jeffersonville Department of Redevelopment has been attempting to work with the State of Indiana for many months procuring title to a remnant parcel of 1-65 right-of-way real property that the State previously acquired and maintains title to; and, WHEREAS, the Common Council of the City of Jeffersonville is aware that title to such property in the name of the Jeffersonville Department of Redevelopment is essential for the of the Falls Landing Riverfront Development development Project; and, WHEREAS, said property in Indiana,"; and, WHEREAS, in the State of Indiana has now forwarded a deed to the name of "The City of Jeffersonville, order to cure existing defects or problems with title to this property, the Indiana Code provides that all property owned and maintained by a Department of Redevelopment shall be entitled "City of~.~_~/v~LL~-~ , for the use and benefit of its Department of Redevelopment". NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Jeffersonville that pursuant to the terms of Indiana Code 36-1-11-8, the City hereby agrees to transfer the property set forth on the attached deed from the State of Indiana to the City of Jeffersonville by a similar instrument with "the City of Jeffersonville" as grantor and "the City of Jeffersonville, for the use and benefit of its Department of Redevelopment" as grantee. The transfer shall be made without compensation by the Jeffersonville Department of Redevelopment upon adoption of a substantially similar resolution to that set forth herein.
