ORDINANCE GRANTING PETITION TO VACATE A PORTION OF A CERTAIN PLATTED
EASEMENT
ON LOT 2A OF KEYSTONE CROSSING AS RECORDED IN PLAT BOOK 19,PAGE 61,
JEFFERSONVILLE,CLARK COUNTY, INDIANA
WHEREAS, petitioner, Koetter Investment Partners, LLC, an Indiana limited liability company, has
filed a petition for the vacation of a portion of a certain platted Variable Width Easement on petitioner's
property pursuant to the provisions of IC 36-7-3-12 and 36-7-3-16;and,
WHEREAS, such petitioner has further caused a notice of public hearing on such petition before this
Council to be properly published in accordance with Indiana law;and,
WHEREAS, this Council having held such public hearing at the date and time as stated in such
published notification; and,
WHEREAS, the owner, other than petitioner, of land that abuts the portion of the Variable Width
Easement to be vacated has been identified and has been given notice of the Petition to Vacate and a notice of
public hearing on such petition pursuant to the provisions of IC 36-7-3-12 and IC 36-7-3-16.
NOW, THERFORE, BE IT ORDAINED BY THE COMMON COUNCIL FOR THE CITY OF
JEFFERSONVILLE, INDIANA,as follows:
1. The Common Council for the City of Jeffersonville, hereby finds all of the following:
a. The only other person owning real property that is adjacent to or served by the
Variable Width Easement has been properly notified of the vacation.
b. The proposed vacation will not hinder the growth or orderly development of the
City of Jeffersonville, Indiana.
b. The proposed vacation will not make access to the lands of any aggrieved person
by means of public way difficult or inconvenient.
c. The proposed vacation will not hinder the public's access to a church, school, or
other public building or place.
d. Vacating the Easements will not hinder any utility company's ability to provide
utility services to the residents in the surrounding area.
2. The petitioner's petition for vacation of a portion of the Variable Width Easement is hereby
granted, and the Variable Width Easements within Jeffersonville's municipal boundaries are hereby vacated as
depicted on attached Exhibit"C"and described in Exhibit"D". Exhibits A and B are intentionally omitted.
3. The Petitioner shall cause a certified copy of this Ordinance to be recorded in the office of the
Recorder of Clark County, Indiana, in accordance with the provisions of Ind. Code § 36-7-3-12(e), and
thereafter shall file a recorded copy with the office of the Clerk-Treasurer of the City of Jeffersonville, Indiana.
4. This Ordinance shall be in force and effect upon its adoption.
So Ordained by majority vote of the entire membership of the City of Jeffersonville, Indiana at a
properly noticed and convened public meeting held this day of ,2023.

PETITION TO VACATE PORTION OF PLATTED EASEMENT
Petitioner, Koetter Investment Partners, LLC (hereinafter referred to as
"Koetter"),an Indiana limited liability company,for its petition state as follows:
I. Petitioner owns Lot 2A, Keystone Crossing Subdivision (the "Property"),
as recorded in Plat Book 19, Page 61 in the Clark County Recorder's Office (hereinafter
referred to as the "Plat"), a copy of said Plat being attached as Exhibit "A" hereto. The
Property lies on the north side of the street known as Keystone Boulevard.
2. Following completion of a building on the Property, Petitioner had a
Boundary Retracement Survey prepared and discovered that the building extends into a
platted easement by approximately three and 1/10 (3.1) feet, a copy of said Boundary
Retracement Survey being attached as Exhibit"B"hereto.
3. The Boundary Retracement Survey reflects the existence of one (1)
previously recorded easement as well as the dedication of three (3) additional easements,
all as shown on the "Easement Descriptions" portion of the Boundary Retracement
Survey (collectively,the"Easements").
5. Pursuant to the provisions of Indiana Code 36-7-3-12 and 36-7-3-16,

Petitioners seek the vacation of all or a part of the platted variable width drainage and
utility easement (the "Variable Width Easement"), as shown on the drawing attached
hereto as Exhibit "C," and described by metes and bounds on Exhibit "D" attached
hereto. None of the other Easements shall be affected by the proposed vacation.
6. Other than the Petitioner, there is one (1) other owner of land that abuts
the portion of the Variable Width Easement proposed to be vacated herein. It is as
follows:

7. Petitioner has further caused notice of the filing of this petition and the
scheduled hearing hereon to be published in The Evening News one (I) time at.least ten
(10) days before the scheduled date of such hearing as required by Indiana Code 5-3-1-
2(b).
8. Petitioner asks that the proposed vacation of the portion of the Variable
Width Easement be granted by ordinance of the City of Jeffersonville, and that such
ordinance provide that subsequent to such vacation Petitioner shall own the vacated
property.
WHEREFORE, petitioner respectfully asks that the City of Jeffersonville
Common Council conduct a public hearing on this petition, and that following such
petition enact and adopt the ordinance vacating the specified portion of the Variable
Width Easement as requested herein.

NOTICE is hereby given that the petitioner, Koetter Investment
Partners, LLC, has filed with the Common Council of the City of
Jeffersonville, Indiana (the "City"), a petition to vacate a portion of that
certain platted variable width drainage and utility easement adjacent to Lot
2A, Keystone Crossing Subdivision in the City of Jeffersonville, Clark
County, Indiana. The proposed area to be vacated is more particularly
described as follows:
Metes and Bounds Description of Portion of Variable Width
Easement to be Vacated:
Part of an existing Variable Width Drainage and Utility Easement located
on Lot 2A of Keystone Crossing,Plat Book 19,Page 61,City of
Jeffersonville,Clark County,Indiana,being further described as follows:
Commencing at the westerly corner of said Lot 2A;thence along the
northwesterly line of said lot,North 4409'21"East 15.25 feet,to a
northeasterly line of said Easement;thence along said line,South
3533'19"East,402.12 feet to the True Point of Beginning;

Notice is further given that a public hearing on the petition will be held
by the City Council at its regular meeting on August 7,2023,at 7:00 o'clock
p.m.(prevailing local time),in the CityCouncil Chambers on the First Floor
of Jeffersonville City Hall,500 Quartermaster Court,Jeffersonville,Indiana.
All interested persons shall be heard at such public hearing regarding the
matters set out in said petition.
