RESOLUTION OF THE COMMON COUNCIL OF
JEFFERSONVILLE, INDIANA AUTHORIZING THE
TRANSFER OF CERTAIN EASEMENTS BY THE CITY
TO THE JEFFERSONVILLE REDEVELOPMENT AUTHORITY
WHEREAS, the Jeffersonville Redevelopment Authority (the
"Authority") has heretofore authorized the issuance of its Lease
Rental Revenue Bonds (Riverside Landing Development Project)
(Capital Appreciation Bonds) in the principal amount not to exceed
Three Million Five Hundred Thousand Dollars ($3,500,000) in order
to finance certain land and public improvements (the "Project") to
be leased to the Jeffersonville Redevelopment Commission (the
"Commission") pursuant to a Lease dated as of November 1, 1990 (the
"Lease"); and
WHEREAS, it is necessary for the Authority to acquire
certain interests in land from the City constituting part of the
Project to be leased to the Commission pursuant to the Lease; and
WHEREAS, the Common Council of the city of
Jeffersonville, Indiana (the "Common Council") desires to transfer
to the Authority easements in the real property described in
Exhibit A.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF
THE CITY OF JEFFERSONVILLE AS FOLLOWS:
Section 1.' The Common Council hereby approves the
transfer of the easements in real property described in Exhibit A
from the City to the Authority, which easements are needed by the
Authority in connection with the Project for public improvements
consistent with the purposes set forth in IC 36-7-14.5.
Section 2. The Mayor of the City of
Jeffersonville is authorized to execute an easement deed
conveying said easements in such real property to the
Authority.
Section 3. This Resolution shall be in full force
and effect after its adoption by the Common Council.

The following described existing public Right-of-Ways in the
city of jeffersonville, Clark County, Indiana:
(1) 60 foot wide strip of West Market Street (formerly
Second Street) from the western Right-of-Way line of Interstate
Highway #65 to the eastern Right-of-Way line of U.S. Highway #31;
(2) 60 foot wide strip of West Riverside Drive (formerly
First Street) from the Eastern Right-of-Way line of Interstate
Highway #65 to the west Right-of-Way line of Illinois Avenue;
(3) 60 foot wide strip of Indiana Avenue from the north
line of West Riverside Drive (formerly First Street) to the south
line of West Market Street (formerly Second Street); and
(4) 60 foot wide strip of Illinois Avenue from the north
line of West Riverside Drive (formerly First Street) to the south
line of West Market Street (formerly Second Street);
EASEMENT DEED
THIS INDENTURE WITNESSETH, That CITY OF JEFFERSONVILLE,
INDIANA, a municipal corporation organized and existing under the
laws of the state of Indiana (,,Grantor") GRANTS to the
jEFFERSONVILLE REDEVELOPMENT AUTHORITY, a separate body corporate
and politic organized under the laws of the State of Indiana, of
Clark County in the State of Indiana for the sum of Ten Dollars
($10.00) and other valuable consideration, the receipt of which is
hereby acknowledged, an easement to construct and maintain certain
road and utility improvements in the following described public
right-of-ways in the city of jeffersonville, Clark County, Indiana:
(1) 60 foot wide strip .of West Market Street
(formerly Second Street) from the western Right-of-Way
line of Interstate Highway #65 to the eastern Right-of-
Way line of U.S. Highway #31;
(2) 60 foot wide strip of West Riverside Drive
(formerly First Street) from the Eastern Right-of-Way
line of Interstate Highway #65 to the west Right-of-Way
line of Illinois Avenue;
(3) 60 foot wide strip of Indiana Avenue from the
north line of West Riverside Drive (formerly First
Street) to the south line of West Market Street (formerly
Second Street); and
(4) 60 foot wide strip of Illinois Avenue from the
north line of West Riverside Drive (formerly First
Street) to the south line of West Market Street (formerly
