HomeMy WebLinkAboutJPC June 27, 2023 MINUTES OF THE JEFFERSONVILLE PLAN COMMISSION June 27, 2023 Call to Order Board President Mike McCutcheon calls to order the Plan Commission meeting. It is Tuesday, June 27, 2023, it is 5:30 pm in the City Council Chambers, Jeffersonville City Hall, 500 Quartermaster Ct., Jeffersonville, Indiana. The meeting was held in person and streamed live on the City's website and City's Facebook page. Roll Call Board President Mike McCutcheon and board members Duard Avery, Chris Bottorff, Bill Burns, and David Schmidt were present in the City Council Chambers. Also present were Planning & Zoning Attorney Les Merkley, Planning & Zoning Director Chad Reischl, and Secretary Zachary Giuffre. Joe Paris and Steve Webb were absent. (Secretary's Note: All plat maps, public letters, photos, etc. presented before the Plan Commission on this date can be found in the office of Planning & Zoning.) Approval of Minutes Approval of the minutes from May 30, 2023. Mr. Burns made a motion to approve the May 30, 2023 minutes, seconded by Mr. Schmidt. Approval of the minutes from the June 12, 2023 special meeting. Mr. Bottorff stated that there is a correction. The minutes stated I am concerned about housing diversity, infrastructure, and traffic; rather, I am concerned with issues raised by various stakeholders that do not always align with the Comprehensive Plan such as housing diversity in the community, infrastructure, and traffic. Mr. Paris made a motion for approval of the June 12, 2023 special meeting minutes with the modification mentioned by Mr. Bottorff, seconded by Mr. Schmidt. Roll call vote. Motion passed 5-0. Approval of the Docket Motion to approve the agenda made by Mr. Bottorff, seconded by Mr. Bottorff. Roll call vote. Motion passed 5-0. Old Business None New Business PC-23-15 Rezoning The Elder Company, LLC filed a Rezoning application for properties at 3409 and 3410 Stenger Lane. The current zoning is R1 (Single Family Residential- Large Lot); the proposed zoning is R3 (Single Family Residential- Small Lot). The Docket Number is PC-23-15. Jake Elder stated the following: • Jason Copperwaite from Paul Primavera & Associates is here with me 1 • The property is 5.5 acres and is located directly behind the Meadows subdivision. • I am requesting a rezoning from R1 to R3. The only change here would be the size of the lots. • There are other R3 subdivisions nearby that have been approved. • This will be responsible growth as it will help create diversity in the housing market. Chad Reischl stated there are significant hurdles to overcome with this development. We have flexibility in the code to allow for smaller units. This property is adjacent to other R3 developments. This subdivision will still need to go through primary plat approval. Open Public Comment Suzie Sanders, who lives at 3411 Stenger Lane, stated my waterline runs through this property. It is Indiana American's waterline. Will the developer put up fencing for the development? I am concerned about children coming onto my property and messing with my animals. People tend to throw trash and grass clippings which are fatal to horses. Melinda Ames, who lives at 3404 Stenger Lane, stated we are concerned about the size of this development. Stenger Lane is a one-lane road. We are concerned about access. We are already blocked in by Amazon, FedEx, and garbage trucks. This road cannot sustain more homes. The railroad tracks are heavily used and there is only a stop sign (no gate arms). Catherine Rhodes, who lives at 4507 Golden Crest, stated I am concerned that opening the road up to Meadow Springs will create traffic. Todd Gregory, who lives on Perimeter Drive, stated I am concerned about the loss of trees and the endangerment of wildlife. The trees are a sound and visual barrier. The trees should not have been removed already. Close Public Comment Jake Elder stated Perimeter Drive does not touch this specific parcel. Perimeter Drive is part of a separate subdivision. The waterline brought up is protected by an easement. We will be able to work with the neighbors to create fencing or a vegetative buffer. Stenger Lane is currently a single lane; however, we are going to work with Councilman Anderson to expand Stenger Lane as the City owns 25ft of right-of-way along the road. Mr. McCutcheon stated we have deliberated projects in the past that have utilized a gate until it is determined that the road has been sufficiently improved to handle the traffic from the new subdivision. Mr. Schmidt asked was the treeline question for the development to the north? Jake Elder stated yes it was. Mr. Avery made a motion for a favorable recommendation, seconded by Mr. Burns. Roll Call vote. Motion passed 5-0. 2 PC-23-16 Rezoning MP Decorative Concrete LLC filed a Rezoning application for properties at 5412 Hamburg Pike. The current zoning is R2 (Single Family Residential- Medium Lot); the proposed zoning is I1 (Business Park/Light Industrial). The Docket Number is PC-23-16. Ronald Culler stated the following: • MP Property Concrete is seeking to move their business to this location. • This project is on a 4-acre parcel located south of the interstate. This area is transitional. • All of this property except for a small piece is located in the AE Fringe, which does not lend the property to residential development. • The proposed business has around 7 employees that will be coming to work at the site. • Large amounts of the decorative concrete products would not be created at the subject property; rather, they would be created on the job site. • This use falls within the light industrial uses that are authorized within the Comprehensive Plan. • Nearby properties are also zoned I1. Chad Reischl stated Staff took a close look at this particular project. We felt this business could fit into either the I1 or C2 designation; however, when we look at the site, we see that its location in the floodplain and proximity to the freeway makes the 11 designation the right direction to go for the site. This staff report is based on the previous Comprehensive Plan; however, the new Comprehensive Plan shows this area transitioning to more of a commercial/industrial part of the City. Ronald Culler stated the stream at the rear of this property creates a natural barrier between this property and the adjoining parcel to the rear. Open Public Comment Herman Spears, who lives at 5408 Hamburg Pike, stated my house is 15ft from the property line. The traffic on this road is a mile long from Veterans Parkway to Highway 31. Within that mile, there are several thousand storage units located on this stretch of road. There are 5 storage businesses, the Fountain Crest subdivision, and the Slate Apartments on this road. There are no turn lanes, stoplights, or sidewalks. This road is not being upkept at all. Close Public Comment Mr. Avery stated it appears there is a lot of industrial usage along Hamburg Pike. The drainage complicates how the site can be used. Chad Reischl stated the plan is to add one building on the site. We are not talking about a huge development. This will likely consist of 80% impervious surface when completed. Missy Poe, a representative of MP Decorative Concrete LLC, stated we want to add an 80 x 100 building to the site. That is the only additional improvement we are going to make to the property. There is currently a 30 x 60 building on the property which will be used for a showroom display. The employees will show up in the morning and will take our trucks and trailers to the job sites. We will not be putting an open-door business here that generates a lot of traffic. We will have deliveries. 3 Mr. Avery made a motion for a favorable recommendation, seconded by Mr. Schmidt. Roll Call vote. Motion passed 5-0. Administrative Review Update Chad Reischl stated we approved an expansion to the Peterbilt property, a small industrial building off of Sable Mill Road, Pike Elementary, and Domino's Pizza on the 1500 block of E. 10th Street. Mr. Burns asked is Domino's vacating a location? Chad Reischl stated that they are likely going to vacate the business in Jeff Plaza.
