HomeMy WebLinkAbout2023-R-3 Resolution Regulating the Storage or Parking of Shared Mobility Devices in City Parks RESOLUTION NO. 2023-R- -3 BEFORE THE BOARD OF PUBLIC WORKS AND SAFETY FOR THE CITY OF JEFFERSONVILLE, INDIANA A RESOLUTION REGULATING THE STORAGE OR PARKING OF SHARED MOBILITY DEVICES IN CITY PARKS WHEREAS, the Common Council for the City of Jeffersonville ("Council") adopted Ordinance No. 2021-OR-12 (as amended) entitled, "An Ordinance Regulating Parking of Shared Mobility Devices"; and WHEREAS, Section 2 of Ordinance No. 2021-OR-12 regulates the parking of a Shared Mobility Device that is not in use; and WHEREAS, among other things, Section of 2 of Ordinance No. 2021-OR-12 authorizes the Jeffersonville Board of Public Works and Safety ("BPW") to regulate the locations where Shared Mobility Devices are to be stored or parked; and WHEREAS,the BPW has determined that it is necessary to regulate the parking or storage of Shared Mobility Devices in city parks when such devices are not in use and abandoned by its user; and WHEREAS,the BPW believes such regulation is necessary to protect the general welfare, health and safety of its citizens; and WHEREAS, the failure to regulate the parking or storage of Shared Mobility Devices in city parks when such devices are not in use and abandoned by its user impedes pedestrian traffic creating risk of physical harm or danger; and WHEREAS, the parking or storage of Shared Mobility Devices in city parks that impedes pedestrian traffic presents significant challenges for other sidewalk and park users, particularly older adults or persons with disabilities; and WHEREAS, the parking or storage of Shared Mobility Devices in city parks further impedes the use and enjoyment of recreational opportunity afforded by the park; and NOW THEREFORE, LET IT BE RESOLVED by the Jeffersonville Board of Public Works and Safety that it shall be prohibited from anyone to park, leave standing, leave unattended and abandoned a Shared Mobility Device on any sidewalk, or public right-of-way in any park under the jurisdiction of the City of Jeffersonville without a permit, agreement, or other written authorization issued by the BPW; and IT IS FURTHER RESOLVED by the Jeffersonville Board of Public Works and Safety that any Shared Mobility Device that remains parked left standing or left unattended and abandoned in violation of the aforementioned terms shall constitute a public nuisance subject to removal and impoundment set forth in Section 3 of Ordinance No. 2021-12 (as amended); and IT IS FURTHER RESOLVED by the Jeffersonville Board of Public Works and Safety that the operator of any Shared Mobility System shall be responsible for advising its user of the requirements for parking or storing a Shared Mobility Device necessary to comply with the aforementioned terms; and IT IS FURTHER RESOLVED by the Jeffersonville Board of Public Works and Safety that the operator of any Shared Mobility System shall be responsible for violations by their respective user of the aforementioned terms.
