ORDINANCE GRANTING PETITION TO
VACATE A TEN (10) FOOT ALLEY
IN THE CITY OF JEFFERSONVILLE,CLARK COUNTY, INDIANA
WHEREAS, Petitioner,Greater Clark County Schools,("GCCS"), filed its Petition
to Vacate a Ten (10) Foot Alley in the City of Jeffersonville,Clark County, Indiana, as
fully described in the Petition to Vacate, attached hereto as Exhibit"A", and incorporated
herein by reference, pursuant to Indiana Code §36-7-3-12; and,
WHEREAS,GCCS published notice of the public hearing on such Petition in the
News and Tribune on the 20th day of March, 2023 in accordance with Indiana Law; and
WHEREAS, GCCS is the sole property owner for parcels which abut the property
proposed to be vacated;and,
WHEREAS,on April 17, 2023 at seven o'clock p.m.,the Council held a public
hearing on the Petition to Vacate a Ten (10) Foot Alley and made the following findings:
1. The best use of the property would be to vacate the proposed Ten(10) Foot Alley.
2. The proposed vacation will not injure the public health, safety, welfare or morals
of the community.
3. It would be in the best interest of GCCS, as the sole property owner of adjacent
property,to grant the Petition set forth above.
4. The proposed vacation will not make access to the property of any persons in
which it is located or to which it is contiguous by means of public way difficult or
inconvenient.
5. The proposed vacation will not hinder the public's access to a church, school or
other public building or place.
NOW,THEREFORE, IT IS HEREBY ORDAINED,by the Common Council
of the City of Jeffersonville, pursuant to the provisions of Indiana Code §36-7-3-12,that
the Ten(10) Foot Alley in Block 71 in Jeffersonville, Indiana of Clark County, Indiana
extending approximately 210 feet east from Meigs Avenue to about the center of the
block, shall be and is hereby vacated by the Common Council of the City of
Jeffersonville, Indiana. The legal description attached hereto as Exhibit"A"depict the
vacated Ten (10) Foot Alley. GCCS will record a copy of this Ordinance in the office of
the Clark County Recorder and deliver a copy of this Ordinance to the Clark County
Auditor.
This Ordinance shall be in full force and effect from and after its passage and
approval.

Petitioner.
PETITION TO VACATE A TEN(10) FOOT ALLEY IN THE CITY OF
JEFFERSONVILLE, CLARK COUNTY, INDIANA
Comes now Petitioner, Greater Clark County School Corporation ("GCCS"), and hereby
petitions the Common Council of the City of Jeffersonville, Indiana ("City"), to vacate a ten (10)
foot alley in Block 71 in Jeffersonville, Indiana, and, in support thereof, states as follows:
1. Greater Clark County School Corporation, is a municipal school corporation with the
legal authority to own real estate.
2. Pursuant to Indiana Code §36-7-3-12, GCCS is requesting that the City vacate a Ten
(10) foot alley extending approximately 210 feet east from Meigs Avenue to about the
center of the block. The remaining approximate 210 feet further east will remain.
GCCS will create an easement parallel to and a few feet from the alley in the existing
parking lot aisle way between the parking spaces so that access to the parking spaces
are preserved. The legal description for the proposed vacated alley and easement is
attached hereto as Exhibit"A".
3. The general geographic area which is the subject of this petition is a 210 foot section
east of Meigs Avenue and immediately abutting Petitioner's Corden Porter School
Building directly to the North and abutting the Petitioner's property directly to the
South.
4. GCCS is the owner of Parcel 10-19-00-103-790.000-010, Block 71, Lots 9 and 10,
which Parcel is adjacent and north to the 10 foot alley that is the subject of this Petition
to Vacate (Exhibit"B").
5. GCCS is the owner of Parcel 10-19-00-103-811.000-010, Block 71, Lots 1 through 6,
which Parcel is adjacent and south of the 10 foot alley that is the subject of this Petition
to Vacate(Exhibit"C").
6. No other person or entity owns any land that abuts the property proposed to be vacated.
7. The above mentioned alley is no longer in use and as such, GCCS would like the City
to vacate the alley.
8. GCCS has been using the alley as parking spaces for Parcel 10-19-00-103-790.000-
010, Block 71, Lots 9 and 10, which is adjacent and north to the 10 foot alley that is
the subject of this Petition to Vacate.
9. The best use of the alley would be to allow it to be vacated for GCCS to use for a
parking lot.
10. The proposed vacation will not injure the public health,safety,welfare or morals of the
community.
11. It would be in the best interest of GCCS, as the sole property owner of adjacent
property, to grant the Petition set forth above.
12. The proposed vacation will not make access to the property of any persons in which it
is located or to which it is contiguous by means of public way difficult or inconvenient.
13. The proposed vacation will not hinder the public's access to a church, school or other
public building or place.
14. Pursuant to Indiana Code §36-7-3-12, the City shall hold a hearing on the petition
within thirty(30)days after it is received.
15. GCCS will give notice of the Petition and of the time and place of the hearing in the
manner prescribed in Indiana Code §5-3-1.
16. GCCS will record a copy of this Ordinance in the office of the Clark County Recorder
and deliver a copy of this Ordinance to the Clark County Auditor.
WHEREFORE,pursuant to Indiana Code§36-7-3-12,Petitioner requests that the Common
Council of the City of Jeffersonville vacate a Ten (10) foot alley as described above.

DESCRIPTION OF PROPOSED ALLEY TO BE VACATED IN BLOCK 71,JEFFERSONVILLE
Being a part of a 10 foot wide alley in Block 71, in the City of Jeffersonville, Clark County, Indiana and
being further described as follows:
Beginning at a drill hole in a concrete sidewalk on the southern most corner of Lot 9 in said Block 71;
Thence N.58.46'02"E.,along the northwestern Right-of-Way line of said alley,210.77 feet to a railroad spike on
the eastern most corner of said Lot;Thence S.30.59'14"E., 10 feet to a point in the southeastern Right-of-Way
line of said alley;Thence S.58.46'02"W., along said southeastern Right-of-Way line, 210.76 feet to a drill hole in
a concrete sidewalk on the western most corner of Lot 1 in said Block;Thence N.31•W., along the northeastern
Right-of-Way line of Meigs Avenue, 10 feet to THE TRUE PLACE OF BEGINNING.
Containing 2108 square feet and being subject to all easements of record.
