SANITARY SEWER BOARD
MINUTES OF MARCH 16, 2023
The Sanitary Sewer Board of the City of Jeffersonville, Indiana met in regular
session on Thursday, March 16, 2023 at 3:00 P.M in Jeffersonville City Hall Mayor's
Conference Room and via Zoom. Mayor Moore called the meeting to order at 3:00 P.M.
Board Members present are Mike Moore (via zoom), Bill Saegesser and Dale Orem. Also
present are Utility Director Len Ashack, Assistant Utility Director Jay Thompson, Board
Attorney Mike Gillenwater, Utility Billing Office Manager Elisha Gibson, Assistant
Controller Yvonne Dowd, Josh Darby representing Jacobi, Toombs, and Lanz, Paul
Boone representing American Structurepoint, John Herriford representing Strand, John
Kraft representing MAC Construction, Jorge Lanz, and Secretary Barbara Hollis.
Attending via Zoom are Mayor Mike Moore and City Council Representative Ron Ellis.
Director Ashack asked to amend the agenda to include a request for sewer service
for 5612 Highway 62. Board Member Saegesser made the motion to approve the agenda
as amended, second by Board Member Orem, passing on a roll call vote of 3-0.
The minutes of the March 2, 2023 meeting were presented for approval. Board
Member Orem, made the motion to approve the minutes as presented, second by Board
Member Saegesser, passing on a roll call vote of 3-0.
CONTROLLER'S REPORT
Assistant Controller Dowd presented the adjusted claim list dated March 16, 2023
in the amount of $1,389,397.04. Board Member Saegesser made the motion to approve
the claim list as presented, second by Board Member Orem, passing on a roll call vote of
3-0.
Manager Gibson presented the Adjustment Certificate dated March 13, 2022 in the
amount of $-151,806.09 Sewage, -$5,424.85 Drainage, and $186.26 Refund, noting the
large amount of certifications. Board Member Saegesser, made the motion to approve
the Certificate as presented. second by Board Member Orem, passing on a roll call vote
of 3-0.
OLD BUSINESS - No Old Business This Meeting
NEW BUSINESS
Director Ashack explained a major leak in the Downtown WWTP Sludge Holding
Tank Blower Air Line which was installed in the 90"s. The design and specs need to be
done for the repair. Board Member Saegesser made the motion to approve solicitation
for design and specs, second by Board Member Orem, passing on a roll call vote of 3-0.

Director Ashack explained a request for sewer service for a residence at 5612
State Route 62. The property is within the city limits, however has never been provided
sewer service. The property is pretty much land locked and there is no service within a
reasonable distance. Following all discussion, Board Member Saegesser made the
motion to hire Jacobi, Toombs, and Lanz to look at the request and provide options,
second by Board Member Orem, passing on a roll call vote of 3-0.
ENGINEERING REPORTS - No Engineering Reports This Meeting
DEPARTMENT REPORT
Director Ashack presented and reviewed the February 2023 Flow reports for both
locations along with the CSO Overflows. The Monthly Report is on CD. The formal award
of the READI Grant will take place at the RDA Meeting to be held March 17, 2023.
ATTORNEY COMMENTS
Board Attorney Gillenwater announced that Utility Billing Office Manager Gibson
was able to collect the delinquent sewer charges for Wash-O-Rama. Manager Gibson
has suggested, and Board Attorney Gillenwater agrees, a letter should be sent to all
realtors asking them to call and check regarding sewer fees. He will work with Manager
Gibson on the letter.
BOARD MEMBER COMMENTS
Mayor Moore asked about the Hadley Commons hearing. Board Attorney
Gillenwater said oral arguments were heard on a motion. The Judge has taken the matter
under advisement. He does feel the City will prevail. Several residents did attend the
hearing. This may take 6-12 months. Mediation can be ordered. The residents can
pursue the issue themselves. They can get their own attorney. This will not move swiftly.
Mayor Moore asked about punitive damages. Board Attorney Gillenwater said fraud has
been alleged. Any damages would go to the City. In order for the residents to receive
punitive damages they would have to pursue it on their own. If the City won punitive
damages the only thing the City could with the money is use it to correct the issues. Any
money awarded to the City could not go to the residents.
