The Judge has taken the matter under advisement. He does feel the City will prevail. Several residents did attend the hearing. This may take 6-12 months. Mediation can be ordered. The residents can pursue the issue themselves. They can get their own attorney. This will not move swiftly. Mayor Moore asked about punitive damages. Board Attorney Gillenwater said fraud has been alleged. Any damages would go to the City. In order for the residents to receive punitive damages they would have to pursue it on their own. If the City won punitive damages the only thing the City could with the money is use it to correct the issues. Any money awarded to the City could not go to the residents.
