RESOLUTION APPROVING THE ENLARGEMENT OF
THE INNER CITY ROADS ECONOMIC DEVEL MENT AREA

WHEREAS, the Jeffersonville (City) Redevelopment Commission (Commission) is the
governing body of the Jeffersonville Redevelopment District (Redevelopment District),
established and operating in accordance with IC 36-7-14 and IC 36-7-25 (the Act);
WHEREAS, on December 22, 1995, the Commission adopted a.Declaratory Resolution
(Original Declaratory Resolution), as supplemented and amended to date, establishing the Inner
City Road Economic Development Area (Original Area) and the Original Declaratory Resolution
was confirmed by a confirmatory resolution adopted on February 28, 1996 (Confirmatory
Resolution);
WHEREAS, the Original Declaratory Resolution and Confirmatory Resolution are
hereinafter collectively referred to as the "Area.Resolution";
WHEREAS,the Area Resolution established an allocation area in accordance with IC 36-7-
14-39 (Original Allocation Area) for the purpose of capturing property taxes generated from the
incremental assessed value of real property (Tax Increment) located in the Original Allocation
Area;
WHEREAS,the Area Resolution approved the Economic Development Plan (Original Plan),
which Original Plan contained specific recommendations for economic development;
WHEREAS,the Common Council approved the creation of the Original Area;
WHEREAS, the.Area Resolution, as amended and supplemented, has enlarged the
boundaries of the Original Area (Enlarged Area) and the Original Allocation Area (Enlarged
Allocation Area) and amended the Original Plan; (Amended Plan);
WHEREAS, on December 22, 2021, the Commission adopted an Amending Declaratory
Resolution (2022 Declaratory Resolution)to expand the boundaries of the Enlarged Area and the
Enlarged Allocation Area by: (i) adding certain real property to the Enlarged Area and the
Enlarged Allocation Area (Expansion Area); and (ii)to include the Expansion Area in the Amended
Plan;
WHEREAS, on March 1, 2022, the Plan Commission issued its order: (i) finding and
determining that the 2022 Declaratory Resolution and the Amended Plan conform to the plan of
development for the City; and (ii) approving the 2022 Declaratory Resolution and Amended Plan
(Plan Commission Order);
WHEREAS,on March 7, 2022,the Common Council approved the Plan Commission Order;
WHEREAS, on April 15, 2022, the Commission published notice in the News & Tribune of
the adoption and substance of the 2021 Declaratory Resolution, and of a public hearing on the
2021 Declaratory Resolution and Amended Plan, in accordance with IC 36-7-14-17 and IC 5-3-1;
WHEREAS, on April 27, 2022,the Commission conducted a public hearing at which
the Commission heard from all persons interested in or affected by the proceedings pertaining
to the proposed projects or other actions to be taken under the 2022 Declaratory Resolution and
considered all written remonstrances or objections that were filed;
WHEREAS, on April 27, 2022, after a public hearing at which all persons affected were
heard,the Commission adopted a resolution confirming the 2022 Declaratory Resolution adding
the Expansion Area and approving the Amended Plan (Confirmatory Resolution); and
WHEREAS, IC 36-7-14-41 requires the Common Council to approve the enlargement of
the Enlarged Area;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF
JEFFERSONVILLE, INDIANA, THAT:
Section 1. The Common Council hereby approves the enlargement of the Inner City Roads
Economic Development Area, as previously enlarged, by the addition of the Expansion Area.
Section 2. This resolution is effective from and after adoption.
Passed and Adopted by the Common Council of the City of Jeffersonville, Indiana this 2nd
day of May, 2022.

RESOLUTION CONFIRMING RESOLUTION NO. 2021-9,THE AMENDING DECLARATORY OF
THE JEFFERSONVILLE REDEVELOPMENT COMMISSION ADOPTED
DECEMBER 22, 2021, EXPANDING THE INNER CITY ROAD ECONOMIC DEVELOPMENT AREA AND
ALLOCATION AREA
WHEREAS, the Jeffersonville (City) Redevelopment Commission (Commission) is the
governing body of the Jeffersonville Redevelopment District (Redevelopment District),
established and operating in accordance with IC:36-7-14 and IC 36-7-25 (the Act);

WHEREAS, on April. 27, 2022, the Commission conducted a public hearing at which the
Commission heard from all persons interested in or affected by the proceedings pertaining to the
proposed projects or other actions to be taken under the 2022 Declaratory Resolution and
considered all written remonstrances or objections that were filed;
NOW, THEREFORE, BE IT RESOLVED BY THE JEFFERSONVILLE REDEVELOPMENT COMMISSION,
THAT:
Section 1. The 2022 Declaratory Resolution and the Amended Plan as approved by the
Commission on December 22, 2021, copies of which are attached hereto and incorporated
herein, are hereby confirmed.
Section 2. The Commission finds and determines that Expansion Area and the Amended Plan:
• Are reasonable and appropriate when considered in relation to the Original Resolution
and Original Plan and the purposes of the Act; and
• will be of public utility and benefit.
Section 3. The Commission finds and determines that no residents of the Expansion Area will be
displaced by the Amended Plan and the Commission is not required to develop plans for
transitional or permanent provisions for housing for residents of the Expansion Area.
Section 4. The Secretary of the Commission is hereby directed to file a copy of this resolution,
together with the Original Declaratory Resolution, Amended Plan and Factual Report, together
with lists of parcel numbers of real property in the Allocation Area, with: (i) the Clark County

Recorder; (ii)the Clark County Auditor; and (iii)the Department of Local Government Finance no
later than May 27, 2022.
Section 5. This resolution shall be effective from:and after passage.

DECLARATORY RESOLUTION
OF THE
JEFFERSONVILLE REDEVELOPMENT COMMISSION
•
WHEREAS, the City of Jeffersonville ("City") Redevelopment Commission
("Commission") has'investigated, studied and surveyed economic development areas within the -
corporate boundaries of the City; and
WHEREAS, the Commission has selected an economic development area to be
developed under IC 36-7-14 and IC 36-7-23 (collectively the "Act");and
WHEREAS, the Commission has prepared an economic development plan ("Plan") for
the selected economic development area, which Plan is attached to and incorporated by reference
in this resolution; and
WHEREAS, the Commission has caused to be prepared:
(I) Maps and plats showing:
(A) the boundaries of the economic development area, the location of various
parcels of property, streets, alleys, and other features affecting the acquisition,
clearance, replatting, replanning, rezoning or economic development of the area,
indicating any parcels of property to be excluded from the acquisition;and
(B). the parts of the acquired areas that are to be devoted to public ways, levees,
sewerage,parks,playgrounds,and other public purposes under the Plan;
(2) Lists of the owners of the various parcels of property proposed to be acquired;
and
,(3) An estimate of the cost of acquisition, redevelopment and economic
development; and
WHEREAS, IC 36-7-14-39.3 authorizes the Commission to modify the definition of
property taxes in IC 36-7-14-39(a) for the purposes of including taxes imposed under IC 6-1.1 on
the depreciable personal property of a designated taxpayer and all other depreciable property
located and taxable on the designated taxpayer's site of operations within the allocation provision
included in a declaratory resolution; and]
WHEREAS, the Commission has caused to be prepared a factual report ("Report") in

a. The attraction and retention of permanent jobs; .
b. An increase in the property tax base;
c. Improved diversity of the economic base; and
d. Improved traffic circulation;and '
e. Upgrading of sanitary sewer conditions.
6. The plan for the Economic Development Area conforms to other development and
redevelopment plans for the City.
7. The Commission does not now propose to acquire interests in real property within
the boundaries of the ICRED Area. If the Commission determines that it is'necessary to acquire
. real property in the ICRED Area, it will amend the Plan and this Resolution prior to any
acquisition.
8. - The Commission estimates that the cost of implementing the Plan will not exceed
$ 13.600,000 .
9. . The Commission finds that no residents of the ICRED Area will be displaced by
- any project resulting from the PIan; and, therefore,the Commission finds that it does not need to
give ,consideration to transitional and permanent provisions for adequate housing for the
residents. If the Commission determines that it is necessary to displace any residents of the '
ICRED Area, it will amend the Plan and this Resolution prior to any displacement and give
consideration to transitional and permanent provisions for adequate housing for the residents.
10: This paragraph shall be considered the allocation provision for the purposes of IC
36-7-14.-39. The entire ICRED Area shall constitute an allocation area as defined in IC 36-7-14-
39. Any property taxes levied on or after the effective date of this resolution by or for the benefit
of any public body entitled to a distribution of property taxes on taxable property in the
allocation area" shall be allocated and distributed in accordance with.'IC 3-7-14-39. [The
Commission hereby modifies the definition of property taxes in IC 36-7-14-39(a) for the
purposes of including taxes imposed under IC 6-1.1 on the depreciable personal property of the
designated taxpayer described below and all other depreciable property located on and taxable on
the designated taxpayer's.site of operations within the allocation provision included in a
Cie declaratory resolution.] This allocation provision shall expire no later than 30 years after the
effective date of this resolution.
11. All of the rights, powers,privileges, and immunities that may be exercised by the- i i

12. The presiding officer of the Commission is hereby authorized and directed to
submit this resolution, the Plan, and the Report to the Jeffersonville Plan Commission for its

approval.
13. . The Commission also directs the presiding officer, upon receipt of the written
order of approval of the Jeffersonville Plan Commission which has been approved by the
Common Council to publish notice of the adoption and substance of this resolution in accordance
with IC 5-3-14 and to file notice with the Jeffersonville Plan Commission, the Board of Zoning
Appeals, the Board of Public Works, the Park Board, the building commissioner and any other
departments or agencies of the City concerned with unit planning, zoning variances, land use or
the issuance of building permits. The notice must state that maps and plats have been prepared
and can be inspected at the office of the City's department.of redevelopment and must establish a
date when the Commission will receive and hear remonstrances and objections from persons
interested in or affected by the proceedings pertaining to the proposed project and will determine
the public utility and benefit of the proposed project. Copies of the notice must also be filed with
the officer authorized to fix budgets, tax rates and tax levies under IC 6-1.1-17-5 for each taxing
unit that is either wholly or partly located within the proposed allocation area.
14. The Commission also directs the presiding officer to prepare or cause to be
prepared a statement disclosing the impact of the allocation area, including the following:
(A) The estimated economic benefits and costs incurred by the allocation area, as
measured by increased employment and anticipated growth of real property,
personal property and inventory assessed values;and
(B) The anticipated impact on tax revenues of each taxing unit that is either wholly or
partly located within the allocation area, A copy of this statement shall be
forwarded to each such taxing unit with a copy of the notice required under
Section 17 of the Act at Ieast 10 days before the date of the hearing described in
Section 14 of this Resolution.
15. The Commission further directs the presiding officer to submit this resolution to
the Common Council for its approval of the establishment of the Inner City Road Economic
Development Area. '

NOW,THEREFORE,BE IT RESOLVED BY THE COMMISSION THAT:
•
1. The Commission has selected as an economic development area an area within its
corporate boundaries, which area the Commission is hereby designating as the Inner City Road
Economic Development Area ("ICRED Area"), and which ICRED Area is described in Exhibit
A.
2. The Commission finds that the Plan for the ICRED Area:
a. Promotes significant opportunities for the gainful employment of the citizens of
the City;
b. Attracts major new business enterprises to the City;
c. Retains or expands a significant business enterprise existing in the City;
d. Benefits the public health,safety,morals and welfare of the citizens of the City;
•
e. Increases the economic well-being of the City and the State of Indiana; and
f. Serves to protect and increase property values in the City and the•State of Indiana.
3. The Commission finds that the Plan cannot be achieved by regulatory processes
or by the ordinary operation of private enterprise without resort to the powers allowed the
Commission under IC 36-7-14 because of:
a. The lack of local public road and sewer improvements;
b. Existence of conditions that lower the value of the land below nearby land; and
• c. The lack of public facilities needed for potential industrial and commercial
development to be realized.
4. The Commission finds that the public health and welfare will be benefited by the
accomplishment of the Plan for the Area, specifically by:
a. Providing for safer traffic conditions;
b. Decreasing the likelihood of through traffic in residential neighborhoods; and
c. Correcting health conditions through improved sanitary sewer facilities.

INNER CITY ROAD PROJECT
FEASIBILITY STUDY REPORT
On December 19, 1994, the Common Council of the City of I
Jeffersonville authorized the Department of Redevelopment to
proceed with a feasibility study of the Inner City Road Project.
Work items which were to be included in . this study were Project
C_ost,' Development Potential, and Financial Strategy. The team of
individuals which was involved in this process includes:

Meetings_ were held on Tuesday, January 10, 1995, Wednesday,
February 15, 1995, and Tuesday, March 14, 1995, to discuss the work
items which are a part of this report.
Before detailed discussion is presented regarding the study's work
` items, several recommendations must be stated which have developed
from extensive discussion among the Team members and also from
input given by regional commercial/industrial realtors (See Exhibit
A) .
* The Team recommends that the alignment of the Inner City
Road Corridor be changed to encompass New Albany-Charlestown 4
Pike and Holmans Lane (See Exhibit B) . i
* The Team recommends that the Inner City Road Project be
constructed in two phases, thereby allowing the City to be F
encumbered with less debt service from the bond issue used to f
fund the construction of this project.
* The Team recommends that the TIF District which will be
developed to allow for the issuance of TIF bonds be extended
to include the corridor along SR 62 between Holmans Lane and #
I-265. The Realtors believe that this area will see
significant commercial development within 3-5 years.
* The Team :recommends that sanitary sewer extensions be'
constructed along SR 62 to provide potential developments with f
ready access to sewer service. The Realtors have been R°
emphatic from this study's outset that access ' to utilities
will be a crucial factor if the City e�

PROJECT COST
The first work item involves Project Cost. The Team has developed
cost estimates for Phase, 1 and Phase 2 of the Inner City. Road
Project and for Sanitary Sewer; Extensions along SR 62, as
exemplified below:
PHASE 1: INNER CITY ROAD, PROM SR 31 TO NEW ALBANY-CHARLESTOWN

This phase includes a bridge overpass on SR 31/Conrail
Railroad tracks, five (5) lanes from 'SR 31 to about 300'
southeast of Hamburg Pike, three (3) lanes from about •
300' southeast of Hamburg Pike to New Albany-Charlestown
Pike, the realignment of a. section of New Albany-
Charlestown Pike to intersect the new Inner City Road, a
- traffic signal at. Hamburg Pike, improving Hamburg Pike
south 700' and north 300' '(total of 1000') and a new
crossing at the' CSX railroad tracks.

This phase includes the realignment of the horizontal
curve at New Albany-Charlestown Pike and Holmans Lane, a
new signalized intersection at Holmans Lane and
Jeffersonville-Charlestown Pike, the widening of Holmans
Lane to provide a minimum of two (2) 12-foot traffic
lanes with turn lanes at the major street intersections
to the point at which the INDOT' project terminates
approximately 700' north of SR 62.

These estimates include construction, right-of-way acquisition,
design and inspection costs, and have been used as a basis for the
creation of the Team's financial strategy recommendations.
DEVELOPMENT POTENTIAL
4:;, The area impacted by the proposed Inner City Road is generally east
of I-65 and south of I-265 along the following road corridors:
State Road 62, Hamburg Pike, New Albany-Charlestown Pike and
Jeffersonville-Charlestown Pike. For data collection and analysis
purposes, the area can be defined by 1990 Census Tracts 503.04,
506.01, and 506.03, with Census Tract 506.01 being the largest area
and the most likely recipient of development generated by the
construction of the Inner City Road. Traffic, Zone data for Zones
623, 624, 625, 633, 634, 636, 637, 638, 640, and 642, which are
congruent to ,the. three census tracts, will also be utilized to
predict development potential of the Inner City Road Corridor.
Having analyzed the data available for the Inner City Road Corridor
area, the Team has determined that the area to be impacted by the
Inner City. Road, particularly Census Tract 506.01, is one of the
premier development areas in Jeffersonville. In 1990, while the
Louisville MSA and Clark County were losing population and
Jeffersonville was increasing by only slightly over one (1)
percent, the Inner City Road Corridor area gained about 8 percent
including a 23 percent gain for Census Tract 506.01. By the year
2010, this area is expected to grow by over 18 percent from 12,939
people in 1990 to 15,296 -by 2010. Census Tract 506.01 is expected
to achieve a growth of over 28 percent or 1362 persons. These
population projections represent only a portion of what might be
expected if the Inner City Road becomes a reality. This road,
LP; however, will not only affect population. Industrial and
commercial development can be expected to accelerate as well.

Between 1985 and 2010, total employment in the Inner City Road
Corridor area is anticipated to increase by over 50 percent.
Again, Census Tract 506.01 is expected to lead the way with a gain
of over 87 percent. The total employment gain is expected to be
about 600 jobs for a total in 2010 of approximately 1700 jobs.

More specifically, non-retail employment is projected to increase I
by nearly 47 percent or 300 jobs for a total of about 1000 jobs by
2010. As expected, the largest gain - over 90 percent or 250 jobs i

Positive comments and suggestions made by the Realtors regarding
the Inner City Road Corridor's development potential help to re-
emphasize the statistical analysis results, which show the
opportunities for development and revenue that exist in this
Corridor. One important feature of this project that the Realtors
discussed was the road's proximity to the new I-65 Interchange.
They believe that significant development will occur very rapidly
around the interchange, both before and after its construction.
Once the interchange has been built, however, the additional access
provided and a general shortage of .commercial/industrial land in
Louisville will make the area along: the Inner City Road Corridor
even more lucrative.
• Two areas along the Corridor were targeted by the Realtors as "hot
spots": the area between SR 31 and New Albany-Charlestown Pike and 1
the area between Holmans Lane and I-265 along SR 62. The estimated 1
time frame for development in these areas is 1-3 years for the
Northern leg of the Corridor and 3-5 years for the Southern leg.

Types of development which have been predicted for the Corridor
include primarily office/warehouse, light manufacturing, and
distribution center development. A light smattering of strip
retail development may appear along New Albany-Charlestown Pike and
Holmans Lane, including banks, fast food restaurants, . and
L'is convenience centers, These developments would be located in close f:
proximity to residential areas.

ce Two factors which the Realtors indicated would be KEY to the
success of the Inner City Road Project were utility access and
zoning. The Realtors indicated to the Team that development
recruitment would be difficult, at best, if utilities were not
available when sites were purchased. In addition, the City must
take responsibility now to ensure that all developable areas are
properly zoned for commercial/industrial development.
FINANCIAL STRATEGY
The financial strategy of the Inner City Road Project involves
three major steps:
1. The City will annex key areas which. are along the Inner .
City Road Corridor to allow for the formation of a TIF (Tax
Increment Financing) District (See Exhibit C) .
2. The City will create a TIF District which includes the
Inner City Road Corridor and prime commercial/industrial real
estate around the Corridor (See Exhibit D) .
3. The City will issue bonds to fund design and construction
of Phase 1 of the Inner City Road Project. Monies to be used
in repayment of these bonds will be captured from assessed
improvements in the TIF District. Funding options and sources
for Phase 2 will be explored at a later date.

City officials are currently discussing an Inter-Local Agreement
with the Town of Clarksville to finance construction of the Inner
City Road. Joint costs of construction will be negotiated between
the municipalities and the State. _ Payment of those costs is not
addressed in this report.
Four schedules of financial information have been included in this
report which exemplify the Phase I investment and the development
needed to support a .bond issue of that size (See Exhibit E) . If
the City chooses to finance Phase #1 of the Inner City Road Project
in this . manner, further cost analyses will be done using final
budget figures and realistic projections of new development to be
located in the TIF District.
SUMMARY
In summary, the Inner City Road Project is located in the section
of Jeffersonville with the most potential for growth. The ; :
development of this thoroughfare will not only provide easy access .
to the interstate system and other major arterials thereby creating 1
convenient residential opportunities, but will also enhance the
marketability of the proposed Inner City Road Corridor for
commercial and industrial use. The greatest value of this road's .
construction, however, will be to provide easy interstate access to
prime commercial/industrial development areas in the City of
Jeffersonville, which are presently an untapped asset for the
City's overall growth. Without the Inner City Road, the corridor

is likely to'continue its relatively slow growth pattern, primarily
through residential development, intermittent retail establishments
and occasional examples of light industrial or non-retail
operations. With the construction oftthe Inner City Road, however,
there will be opportunities for; accelerated high quality
development through a variety of uses.

RESOLUTION NO. 61
AMENDING DECLARATORY RESOLUTION OF THE JEFFERSONVILLE
REDEVELOPMENT COMMISSION EXPANDING THE INNER CITY ROAD
ECONOMIC DEVELOPMENT AREA AND ALLOCATION AREA AND THE
ECONOMIC DEVELOPMENT PLAN FOR THE INNER CITY ROAD
ECONOMIC DEVELOPMENT AREA •
WHEREAS, the Jeffersonville (City) Redevelopment Commission (Commission) is the
governing body of the Jeffersonville Redevelopment District (Redevelopment District),
established and operating in accordance with IC 36-7-14 and IC 36-7-25 (the Act);
WHEREAS, on.December 22, 1995, the Commission adopted a Declaratory Resolution
(Original Declaratory Resolution), as supplemented and amended to date, establishing the Inner
City Road Economic Development Area(Original Area) and the Original Declaratory Resolution
was confirmed by a confirmatory resolution adopted on February 28, 1996 (Confirmatory
Resolution);
WHEREAS, the Original Declaratory Resolution and Confirmatory .Resolution are
hereinafter collectivelyireferred to as the"Area Resolution";
WHEREAS,the Area Resolution established an allocation area in accordance with IC 36-
7-14-39Original Allocation Area) for the a ose of ca turin Property taxes generated from

the incremental assessed value of real property (Tax Increment) located in the Original
Allocation Area;
WHEREAS, the Area Resolution approved the Economic Development Plan (Original
Plan), which Original Pian contained specific recommendations for economic development in the
Original Area; '
WHEREAS, the Common Council approved the creation of the Original Area;
WHEREAS, the Area Resolution, as amended and supplemented,: has enlarged the
boundaries of the Original Area (Enlarged Area) and the Original Allocation Area (Enlarged
Allocation Area) and amended the Original Plan(Amended Plan);
WHEREAS, the Commission now desires to amend the Area Resolution to expand the
boundaries of the Enlarged Area and the Enlarged Allocation Area by: (i) adding certain real
property to the Enlarged Area and the Enlarged Allocation Area (Expansion Area); and (ii) to
approve the Amended Plan;
WHEREAS, Ia, 36-7-14-15(a) (4) provides that, when amending the Area Resolution or
the Amended Plan,the;Commission must find that:
(1)the amendmiient is reasonable and appropriate when considered in relation to
the Area Resolution, the Amended Plan, and the purposes of Act; and
i
(2)the Area Resolution and the Amended Plan,as amended,with the proposed
amendment,conform to the comprehensive plan for the City;
WHEREAS,the Commission shall cause to be prepared:
(1)maps and plats is showing:
(A)the boundaries of the Enlarged Area,as amended,in which property would be
acquired for, or otherwise affected by,the amendment of the Area Resolution or
the Amended Plan;
(B)the is cation of the various parcels of property, streets,alleys,and other
features',affecting the acquisition, clearance,rernediation,replatting,replanning,
rezoning,or development of the area,indicating any parcels of property to be
excluded from the acquisition or otherwise excluded from the effects of the
amendment of the Area Resolution or Amended Plan;and
(C)the parts of the Enlarged Area,as amended,acquired, if any,that are to be
devoted Ito public ways,levees, sewerage,parks,playgrounds,and other public
purpose under the amendment to the Amended Plan;
(2) lists of the owners of the various parcels of property proposed to be.acquired for, or
otherwise affected by, the amendment of the Area Resolution or Amended Plan for the
Amended Area;and
(3) an estimate bf the costs, if any, to be incurred for the acquisition and development of
the property;
WHEREAS, IC 36-7-14-17.5 authorizes the Commission to amend the Area Resolution
and the Original Plan,as amended,after conducting a public hearing, if it finds that:
(i) The amendment is reasonable and appropriate when considered in relation to the
Area Resolution,the Amended Plan,and the purposes of IC 36-7-14; and
(ii) The Area Resolution,with the proposed amendment and the application of the
Amended Plan, as amended,conforms to the comprehensive plan for the City;

NOW,. THEREFORE, BE IT , RESOLVED BY THE JEFFERSONVILLE
REDEVELOPMENT i COMMISSION,THAT:
Section 1. The Area Resolution is hereby amended to expand the Enlarged Area and
the Enlarged Allocation Area to include the Expansion Area as set forth on the map attached,
hereto as Exhibit A-k and the parcel list attached hereto as Exhibit A-2.
Section 2. (a) The Commission finds, after consideration of the evidence presented,
that the public health and welfare will be benefited by the amendment to the Area Resolution
to establish the Expansion Area.

(b) The Commission finds and determines that the Expansion Area was omitted
from the description of property added to the Enlarged Area on January 27, 2021, and
now intends to add the Expansion Area to the Enlarged Area.
Section 3. The Commission now finds and.determines that the addition of the
Expansion Area to the Enlarged Area and the Enlarged Allocation Area described in Section 1
above is reasonablei and appropriate when considered in relation to the Area Resolution as
amended by this amending resolution and to the economic development and redevelopment
purposes set forth in the Act. The'Commission finds that the Area Resolution, with the
amendment,conforms to the comprehensive plan for the City.
Section 4. The Commission hereby finds that no other parcels of property in the
Enlarged Area will be affected by the Expansion Area or the accomplishment of the Amended
Plan,
Section 5. The Commission hereby finds that amendment to the Area Resolution to
establish the Expansion Area will result in new property taxes in the Enlarged Area that,would
not have been generated without the establishment of the Expansion Area and the application
of the Amended Plan to the Expansion Area.
Section 6. The Commission hereby finds that the property described on Exhibit B is
the property that may be affected by the establishment of the Expansion Area.
Section 7. The base assessment date for the Original Allocation Area shall remain
, March 1, 1995, the base assessment date for the;enlarged Area shall be January 1, 2016, and
the base assessment date for the Expansion Area shall be January 1,2021.
Section 8. This paragraph shall be considered the allocation provision for ,the
Expansion Area for the purposes of IC 36-7-14-39. The Expansion Area shall constitute an
allocation area as defined in IC 36-7-14-39 and shall become a part of the Original Allocation
Area for all other.purposes than the base assessment date: Any property taxes levied on or
after the effective date of this resolution by or for the benefit of any public body entitled to a
distribution of property taxes on taxable property in the Expansion Area shall be allocated and
distributed in accordance with IC 36-7-14-39 or any applicable successor provision. This
allocation provision shall expire no later than 25 years after the date on which the first
obligation is incurred to pay principal and interest on bonds or lease rentals on leases payable
from tax increment revenues generated in the Expansion Area. ,
Section 9. i the rights, powers,privileges and immunities that may be exercised by
the Commission in a redevelopment project area under the Act may be exercised in the
Expansion Area,subject to any limitations in IC 36-7-14-43:
Section 10. The presiding officer of the Commission is hereby authorized and directed
to submit this resolution to the Jeffersonville PIan Commission (Plan Commission) for its
approval.
Section 11. The Commission also directs the presiding officer, after receipt of the
written order of approval of the Plan Commission which has been approved'by the Common

Council,to publish notice of the adoption and substance of this resolution in accordance with
IC 5-3-1 and to file notice with the Plan Commission, the Board of Zoning Appeals, the
building commissioner and any other departments or agencies of the City concerned with unit
planning,zoning variances, land use or the issuance of building permits. The notice must also
be mailed to the owner or owners of real property, if any, being added to the acquisition list.
The notice must state that maps and plats have been prepared and can be inspected at the
office of the City's department of redevelopment and must establish a date when the
Commission will receive and hear remonstrances and.objections from persons interested in or
affected by the proceedings pertaining to the proposed amendment to the Area Resolution and
will determine the public utility and benefit of the proposed amendment to the Area
Resolution. Copies of the notice must also be filed with the.officers authorized to fix budges,
tax rates and tax levies under IC 6-1.1-17-5 for each taxing unit that is either wholly or partly
located within the proposed Expansion Area. Notice must also be mailed by first class mail to
all owners of real property within the proposed Expansion Area.

Section 12. The Commission also directs the presiding officer to prepare or cause to
be prepared a statement disclosing the impact of creating the Allocation Area, including the
following:
(a) The estimated economic benefits and costs incurred, as measured by increased
employment,i1 and anticipated growth of real property and personal property assessed
values;and
(b) The anticipated impact on tax revenues of each taxing unit that is either wholly or
partly located within the new Allocation Area.
A'copy of this statement shall be filed with each such taxing unit with a copy of the notice
required under Section'17 of the Act at least 10 days before the date of the hearing described in
Section 11 of this Resolution.
Section 13. In all other respects, the Area Resolution, the Amended Plan, and actions
of the Commission consistent with this resolution are hereby ratified and confirmed. _

Section 14. This resolution is effective upon passage.

OF AN AMENDING DECLARATORY RESOLUTION
OF THE JEFFERSONVILLE REDEVELOPMENT COMMISSION
Taxpayers of the Jeffersonville Redevelopment District ("District"), and all other persons affected
hereby, are notified that the Jeffersonville Redevelopment Commission (Commission) on
December 22, 1995 adopted a Declaratory Resolution (Original Declaratory Resolution), as
supplemented and amended to date, establishing the Inner City Road Economic Development
Area (Original Area) and the Original Declaratory Resolution was,confirmed by a confirmatory
resolution adopted on February 28, 1996 (Confirmatory Resolution). The Original Declaratory
Resolution, as amended, and Confirmatory Resolution are hereinafter collectively referred to as
the "Area Resolution." The Area Resolution established an allocation area in accordance with IC
36-7-14-39 (Original Allocation Area)for the purpose of capturing property taxes generated from
the incremental assessed value of real property(Tax Increment)located in the Original Allocation
Area. the Area Resolution, as amended and supplemented, has enlarged the boundaries of the
Original Area (Enlarged Area) and the Original Allocation Area (Enlarged Allocation Area) and
amended the Original Plan (Amended Plan). On December 22, 2021,the Commission adopted a
resolution (2022 Amending Declaratory Resolution)to: (i) expand the boundaries of the Enlarged
Area and the Enlarged Allocation Area (Expansion Area) by adding certain real property; and (ii)
to approve the Amended Plan. Maps and plats of the Enlarged Area,the Expansion Area; and the
Amended Plan have been prepared and can be inspected at the office of the Department of
Economic Development and Redevelopment, City Hall, Suite 257, 500 Quartermaster Court,
Jeffersonville, Indiana, Monday through Friday(except holidays) between the hours of 8:30 a.m.
and 4:30 pm.
Notice is further given that the Commission on April 27, 2022, at the hour of 5:00 p.m. (local
time), in the Mayor's Conference Room, 2nd floor, Jeffersonville City Hall, 500 Quartermaster
Court,Jeffersonville, Indiana, will receive and hear remonstrances from persons interested in or
affected by the proceedings pertaining to the 2022 Amending Declaratory Resolution and the
Amended Plan, including taxpayers of the District. At the time fixed for hearing or at any time
prior thereto any person interested in the proceedings may file a written remonstrance with the
Secretary of the Commission in the office of the Department of Economic Development and
Redevelopment, City Hall, 500 Quartermaster Court, Suite 257, Jeffersonville, Indiana. At such
hearing, which may be adjourned from time to time, the Commission will hear all persons
interested in the proceedings and all remonstrances that have been filed. After considering this
evidence, the Commission will take final action by either confirming, modifying and confirming,
or rescinding the Amending Declaratory Resolution. A copy of this notice has been filed with the
agencies, boards and any other departments, bodies, or officers of the City of Jeffersonville
having to do with planning, variances from zoning ordinances, land use, or the issuance of
