NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Jeffersonville that Ordinance No. 90-OR-60 shall be amended to include the following provision: SECTION 4 In order that domestic and residential users of sewage services shall not be penalized for the sprinkling of lawns during the months of June, July, and August, the for treatment plant sewage service for residents domestic users for said months of June, July, and shall be based upon the average water usage for billing and/or August, Domestic and/or residential sewage to the sprinkling rate, shall apply of real estate or building which is and used as a residence. In the event a portion of such premises shall be used for commercial or industrial purposes, the owner shall have the privilege of separating the water service so that the residential portion of the premises is served through a separate meter, and in such case the water usage as registered by the water meteF serving such portion of the premises used for residential purposes would qualify as a sprinkling rate. .The Jeffersonville to determine that its Sewage Billing Office shall work billing system can retroactively apply any applicable credit under this ordinance to 1991 residential billings in the City of Jeffersonville. In the event that said credits can be accomplished within the current billing system, the Common Council of the City of Jeffersonville hereby authorizes the same. In the event that said credits cannot be processed for 1991 within the Sewer Department billing system, said office is directed to report the same to the Common Council for study of other alternatives. The Common Council further recognizes that adoption of this sprinkling credit will reduce Sewer Department revenues. If the reduction results in net revenues below either the level required to fund the user charge system replacement allowance requirement or the amount necessary to cover the City's obligation for bond indebtedness repayment, the Common Council hereby agrees to adjust the sewer user rates in a manner which will meet all such outstanding obligations of the utility. This Ordinance shall be in full force and effect upon its timely passage, promulgation and approval by the Mayor.
