HomeMy WebLinkAbout1991-OR-29 ORDINANCE NO. 91-OR- ORDINANCE ESTABLISHING THE JEFFERSONVILLE DRAINAGE ASSISTANCE PROGRAM has recently undertaken a somewhat similar reconstruction assistance program, which program WHEREAS, the Mayor, the Board of Public Works and Safety of Jeffersonville have undertaken a comprehensive drainage plan to identify major existing storm water drainage problems on or across existing public rights-of-way or easements; and, WHEREAS, it is believed that the implementation of this plan when complete will substantially improve the storm water drainage patterns in the City of Jeffersonvitle, although it is also understood that such plan involves a significant commitment of resources for its implementation; and~ WHEREAS, it is further believed that even upon implementation of the drainage master plan, and subsequent maintenance of the improvements undertaken therein, that small pockets of private property owners may continue to have somewhat isolated drainage problems as a result of past~.~~ development practices and patterns of adjacent development'~ and, WHEREAS, the Common Council of the City of Jeffersonville sidewalk has met a existing reasonable degree of success in addressing the problems for which it was intended; and, WHEREAS, the Common Council of the City of Jeffersonville would like to similarly address the existing storm water which affect private property owners on a drainage problems trial basis; and, WHEREAS, the City and commitment by it is believed that joint cost sharing between the affected property owners will result in a the property owners to keep and maintain the drainage improvements which may be made under this program in good repair. NOW, THEREFORE, the City of Jeffersonville BE IT ORDAINED by the Common Council of Jeffersonville that it hereby establishes the Drainage Assistance Program on the following terms and conditions: 1. The Common Council of th~ City of Jeffersonville shall make a special appropriation of up to $50,000.00 in 1991 in order to establish and fund the Jeffersonville Drainage Assistance Program. 2. The Jeffersonville Drainage Advisory Committee shall be formed, and shall consist of the following: a. Two City Councilpersons elected by majority vote of Council b. City Engineer c. City Attorney d. A citizen appointment made by the Mayor of the City of Jeffersonville, although no more than twolof the three appointments in paragraphs b, c, and d above may be of the same political party 3. The committee shall adopt an application for drainage assistance by property owners in the City of Jeffersonville which shall be forwarded to the Common Council of the City of Jeffersonville for review and approval. Upon each and every application the Drainage Advisory Committee shall investigate the existing problem, and may utilize the advice of outside engineers and consultants where deemed advisable by the committee. The committee shall minimally give written advice to the property owner as to the cost effective method of solving the existing problem or shall advise as to the economic impossibility to provide a solution. e However, in those situations where a solution to the existing drainage problem can be provided under this program the committee shall undertake a detailed cost analysis of the anticipated cost effective solution. The applicant or applicants shall then be advised as to the anticipated cost of the project. At such time the applicant or applicants may commit to the project by paying into the sum of one-half (1/2) be matched by the office of the City Engineer the of the engineering estimate to City under this program up to a maximum of Fifteen Thousand Dollars ($15,000.00) total cost for any one application or project. This contribution shall be the maximum contribution to be received from the applicants, and the City will be bear the costs of any change orders or cost overruns in the project in their entirety. 7. No application by a single property owner which does not identify any benefit to properties other than that owned solely by that applicant shall not be considered or investigated under this program. 8. Applications received by the committee shall be ranked in their priority in accordance with the size of the area affected, the number of property owners affected, and the severity of the drainage problem. 9. Upon such ranking the committee shall proceed to approve such applications and offer matching funding herein to the maximum cost identified per project, and also up to the maximum allocation of funds for 1991 identified hereinabove. 10. Upon a determination by the committee that a publicly dedicated drainage easement is necessary for the continued maintenance of any drainage improvement undertaken herein, it may make the dedication of such easement by the applicant or applicants a condition precedent to the award of any public assistance under this program. 11. Should the Common Council of the City of Jeffersonville deem this program desirable and effective it shall make a budgetary appropriation for the program for 1992 and ensuing years thereafter. This ordinance shall continue in full force and effect until amended or appealed by the Common Council of the City of Jeffersonville.
