HomeMy WebLinkAbout2021-R-1 Resolution Adopting Electronic Meeting Policy RESOLUTION NO. 2021-R7...±_ BEFORE THE JEFFERSONVILLE PARKS AUTHORITY STATE OF INDIANA A RESOLUTION ADOPTING AN ELECTRONIC MEETING POLICY WHEREAS,the purpose and intent of this resolution is to adopt a policy, pursuant to Indiana Code § 5-14-1.5-3.5, establishing the procedures by which members of the Jeffersonville Parks Authority may participate in meetings by a means of electronic communication. NOW, THEREFORE, BE IT RESOLVED by the Parks Authority of the City of Jeffersonville, Indiana as follows: As permitted by Indiana Code § 5-14-1.5-3.5, the Parks Authority adopts the following: Electronic Meeting Policy The City has invested in upgraded audio-visual technology in the city meeting facilities, as well as having secured a subscription to a business communications videoconferencing platform,all of which allows for both persons present in-person in the meeting facilities and persons whoare in remote locations to simultaneously communicate with and observe each other over the videoconferencing platform. Utilizing this technology, the Parks Authority authorizes participation in all its meetings by electronic means on the following terms: a. At least 5 of the members of the Parks Authority must be present in-person in the meeting room, while up to 4 members may participate remotely overthe City's videoconferencing platform. All votes taken during such a meeting must be taken by roll call vote and must address only matters permissible by statute.To be eligible to vote members must be able to be seen and heard. b. A member may not attend more than 50% of the Parks Authority's meetings ina calendar year remotely by videoconferencing platform, unless such remote participation is due to: (1) military service; (2) illness or other medical condition; (3) death of a relative; or (4) an emergency involving actual or threatened injury to persons or property. c. A member may not participate in a Parks Authority meeting remotely if the Parks Authority is attempting to take final action to: (1) adopt a budget; (2) make a reduction in personnel; (3) initiate a referendum; (4) establish or increase a fee; (5) establish or increase a penalty; (6) use the authority of eminent domain; or (7) establish,raise, or renew a tax. d. A member may attend 2 consecutive meetings (a set of meetings) remotely by videoconferencing platform, but then a member must be present in-person in the meeting room for at least 1 meeting between sets of meetings that the member, attends remotely, unless such remote participation is due to: (1) military service; (2) illness or other medical condition; (3) death of a relative; or e. an emergency involving actual or threatened injury to persons or property. The minutes of any meeting in which any member(s) participate(s) remotely overthe City's videoconferencing platform must state: (1) the name of each member who was present in-person at the meeting room, the name of each member who participated remotely, and the name ofeach member who was absent; and (2) identify the City's videoconferencing platform by which the member(s) participated and by which the public was permitted to attend and observe the meeting (if the meeting was not held in executive session). f. The Parks Authority or his or designee shall be responsible for the implementation and management of this policy. Ultimately, each parks authority member shall have the individual responsibility to ensure he or she complies with the requirements of this policy such as not exceeding the number of meetings allowed via videoconferencing. This resolution shall be in full force and effect from and after its passage by the Parks Authority.
