BEFORE THE COMMON COUNCIL FOR THE CITY OF JEFFERSONVILLE
STATE OF INDIANA
A RESOLUTION WAIVING CERTAIN PROCEDURES AND FORMALITIES
DURING DISASTER EMERGENCY PURSUANT TO I.C. 10-14-3-17
WHEREAS, on March 6, 2020 the Governor of Indiana declared a public health emergency for
Coronavirus Disease 2019 Outbreak("COVID-19") pursuant to I.C. 10-14-3-12; and
WHEREAS, I.C. 10-14-3-17 gives the City of Jeffersonville the authority to waive procedure and
formalities otherwise required by law as a result of the disaster emergency declaration;and
WHEREAS, I.C. 10-14-3-17(j)(5)states, in part, a political subdivision may:
In the event of a national emergency or disaster emergency as provided in section 12
(I.C. 10-14-3-12)of this chapter,waive procedures and formalities otherwise required by
law pertaining to, among other things "the appropriation and expenditure of public
funds."
WHEREAS, I.0 6-1.1.-18-5 states, in part, the legislative body shall provide public notice and
conduct a public hearing before acting upon an additional appropriation;and
WHEREAS, the Common Council for the City of Jeffersonville desires to avoid the disruption of
city government and essential city services that COVID-19 may create; and
WHEREAS, the Common Council for the City of Jeffersonville recognizes concern for public
health due to COVID-19 to the extent city departments are incurring unforeseen expenses related to the
city's response to COVID-19 including supplies and personal protective equipment utilized by city
employees who are maintaining essential services; and
WHEREAS, the Common Council for the City of Jeffersonville desires to establish funds for the
purposes of paying for such expenses as set forth by Resolution No. 2020-R- ;and
WHEREAS, the establishment of said funds requires the appropriation of certain funds from the
city's Rainy Day Fund;and
WHEREAS, the Common Council for the City of Jeffersonville believes it is appropriate and
necessary to waive the statutory requirements for the additional appropriation from the Rainy Day Fund
into the new funds so the city and its personnel may adequately and timely respond to the COVID-19
Pandemic; and
NOW, THEREFORE, BE IT RESOLVED by the Common Council for the City of Jeffersonville,
Indiana, that the procedures for additional appropriations set forth in I.C. 6-1.1.-18-5 including the
public notice and public hearing requirement shall be waived as to allow the Common Council to
consider and adopt an additional appropriation ordinance to fund COVID-19 Pandemic Response
(Ordinance No.2020-OR- ); and
IT IS FURTHER RESOLVED by the Common Council for the City of Jeffersonville, Indiana,that this
Resolution is only applicable to the additional appropriation set forth herein and shall not waive the
statutory requirements for any other additional appropriation;and
IT IS FURTHER RESOLVED by the Common Council for the City of Jeffersonville, Indiana, that the
city's fiscal officer is hereby directed to comply with the provisions set forth herein for purposes of the
additional appropriation.
