BEFORE THE BOARD OF PUBLIC WORKS AND SAFETY
CITY OF JEFFERSONVILLE, INDIANA
A RESOLUTION SUSTAINING DAMAGES AWARD FOR
CONDEMNATION OF CERTAIN REAL PROPERTY PURSUANT TO
INDIANA CODE 32-24-2 et. seq.
WHEREAS, on June 12, 2019 the Board of Public Works and Safety of the
City of Jeffersonville (the "Board") adopted Resolution 2019-R-4, A Resolution
Concerning Acquisition of Property for Pursuant to I.C. 32-24-2-5 for the purpose
of public infrastructure improvements on Michigan Avenue located within the Arts
and Cultural District; and
WHEREAS, notice of the resolution was published in the News and
Tribune on June 15, 2019 and June 22, 2019 as required by Indiana Code 32-24-
2-6(b); and
WHEREAS, said notice stated that at its regular meeting on Wednesday,
August 14, 2019, the Board would hear remonstrance's from persons interested in
or affected by the condemnation; and
WHEREAS, no one interested in, or affected by, the condemnation
appeared with regard to the condemnation at the Board's regular meeting on
Wednesday, July 12, 2019;
WHEREAS, the Board adopted Resolution NO. 2019-R-6, A Resolution
Confirming Condemnation of Certain Real Property, Establishing List of Owners
and Holders of Property and Awarding of Damages Pursuant to Indiana Code 32-
24-2 et. seq. and establishing Wednesday, August 14, 2019 as the date the Board
would hear remonstrances from persons in or affected by the condemnation, all
pursuant to Indiana Code 32-24-2 et. seq.

WHEREAS, an inadvertent error was made by the News and Tribune and
therefore, the above June 15, 2019 and June 22, 2019 dates did not get published,
as required by Indiana Code; and
WHEREAS, notice of the resolution was published in the News and
Tribune on August 13, 2019 and August 20, 2019 as required by Indiana Code 32-
24-2-6(b); and
WHEREAS, on August 12, 2019, written notice was mailed via certified
U.S. mail, postage prepaid, upon those persons in or affected by the condemnation
showing the amount of the damage award and stating that the Board would hear
remonstrances from persons with regard to the amount of damage award; and
WHEREAS, all those persons in or affected by the condemnation were
served by evidenced of return receipt; and
NOW THEREFORE, BE IT HEREBY RESOLVED that the Board
hereby sustains its damages as set forth in Resolution NO. 2019-R-6, A Resolution
Confirming Condemnation of Certain Real Property, Establishing List of Owners
and Holders of Property and Awarding of Damages Pursuant to Indiana Code 32-
24-2 et. seq.

Legal Description
Being the southwesterly eight feet of the following property:
Lot Nos. 10, 11 and 36.7 feet off the north side of Lot No. 12, all in Block 81 in the
City of Jeffersonville, Clark County, Indiana.
EXCEPTING THEREFROM, part of Lot 10 conveyed by Margaret L. Steinbach
and Frederick Steinbach to Harry Hudson and Mildred Hudson, his wife, by deed
dated February 21, 1919.
ALSO EXCEPTING THEREFROM the following described real estate:
Being part of Lot Nos. 10 and 11 in Block No. 81 in the City of Jeffersonville,
bounded thus: Beginning at an iron pipe on Michigan Avenue three (3) feet south
of the northeast corner of Lot No. 10; thence Westwardly and parallel to the line
dividing Lot Nos. 9 and 10, forty (40) feet to an iron pipe; thence Northwardly and
parallel to Michigan Avenue three (3) feet to an iron pipe in the line dividing Lot
Nos. 9 and 10; thence Westwardly along the line dividing Lot Nos. 9 and 10,
seventy-five (75) feet to an iron pipe at the northwest corner of Lot No. 10; thence
Southwardly along the western line of Lot Nos. 10 and 11 and the eastern line of a
20 foot alley, forty-eight (48) feet to an iron pipe; thence eastwardly and parallel to
the line dividing Lot Nos. 10 and 11, one hundred fifteen (1 15) feet to an iron pipe
in the western line of Michigan Avenue; thence Northwardly along the western line
of Michigan Avenue, forty-five (45) feet to the place of beginning.
Subject to any and all easements and restrictions of record affecting this real
estate.
