MINUTES
July 10, 2019

CALL TO ORDER: Mayor Moore called the meeting to order at 9:30 a.m.
APPROVAL OF THE MINUTES: Mr. Clark made the motion to approve the minutes from July 3, 2019,
seconded by Mr. Waiz and motion passed 3-0.
APPROVAL OF THE PAYROLL: Mr. Waiz made the motion to approve the payroll, seconded by Mr. Clark
and motion passes 3-0.
OLD BUSINESS:
Les Merkley/Sarah Green - Update of hearing held at June 26, 2019 BPW meeting regarding to
Notice of Determination of vicious/dangerous animal regarding Pit Bull Mix owned by Paul Eubanks
Mr. Merkley—This is an update to the 14 day notice to correct issues and pay fines regarding
determination of vicious dog owned by Mr. Eubanks.
Ms. Green—Mr. Eubanks called the day after our last hearing and said he made some
improvements to the home; I called the home owners and she was unaware of the bites and that we had
determined the dog was vicious and she said he was not going to be allowed at that house. This is the last
time we have heard from him.
Mr. Merkley—let the record show that 14 days has elapsed and Mr. Eubanks has not complied with
the ordinance and therefore, Animal Control can deal with the dog as it deems appropriate and necessary.
NEW BUSINESS:
Les Merkley—Hearing on Resolution Confirming Condemnation of a parcel of real property located
on Michigan Avenue
Mr. Merkley—presented Resolution 2019-R-6 in reference to a small sliver of property. This is on
Michigan Avenue and this is necessary for the Depot Redevelopment Art Project. Two appraisals were
done and the average is nineteen hundred dollars ($1,900); at this time we adopt this resolution confirming
the condemnation of the real estate and then establishing those damages. We will have another hearing
on Wednesday,August 14 at 9:30 to hear any remonstrates regarding the amount of damages. Today is
scheduled for a hearing. It was noticed in the paper on June 15th and 22nd on anyone who wants to
remonstrate on the condemnation; the actual taking of the property. Is anyone here in reference to taking
the property on Michigan Avenue—let the records show that the hearing occurred and no one appeared.
Mr. Clark made the motion to adopt Resolution 2019-R-6, seconded by Mr. Waiz and motion passes 3-0.

Clark Miles—request for barricades for National Night Out in Whispering Oaks II. The Nation Night
Out is at their Clubhouse and barricades are needed at John Wayne and 21 Century
Mr. Miles—Whispering Oaks has requested barricades for NNO on August 6.
Mr. Waiz made the motion to approve the barricades, seconded by Mr. Clark and motion
passes 3-0.
Bill Dixon—Request for approval of road closure on Primrose Drive from 7/22/2019 to 7/24/2019
for culvert replacement
Mr. Dixon indicated this is for replacement of culvert under the road near Garden Side Terrace.
Mr. Waiz made the motion to approve the road closure, seconded by Mr. Clark and motion
passes 3-0.
Dawn Spyker—Request for approval of Artisan Agreement between the City and Lisa Marie Fowler
for Performing Artist, Creative Impact Series
Ms. Spyker indicated this is the Glass Lampworking event and funds are in the budget.
Mr. Waiz made the motion to approve the agreement, seconded by Mr. Clark and motion
passes 3-0.
Dawn Spyker—Request for approval of Artisan Agreement between the City and various artists for
Traffic Control Box Murals
Ms. Spyker indicated funds are in the budget for these 13 traffic control box paintings.
Mr. Waiz made the motion to approve the agreements, seconded by Mr. Clark and motion
passes 3-0.
Curtis Petty with Kovert Hawkins—Request for approval of Change Order#10 for Chapel Lake
Mr. Petty explained that these changes totaling$3,325 will be paid out of the contingency funds:
install relief system under the lake; parking lot—install larger drain pipe; and nature use sight—install a
pipe to reduce standing water.
Mr. Clark made the motion to approve Change Order#10, seconded by Mr. Waiz and motion
passes 3-0.
ADDITIONAL NEW BUSINESS:
Mr. Merkley—presented a list of events held by the City and Jeffersonville Main Street; there has
been discussion of the City's Noise Ordinance which is greatly outdated. Under that Ordinance 86-OR-54
the BPW and Safety shall have the authority to issue permits for: holidays, celebrations, concerts, parades
or other special events (public or personal). Persons who demonstrate that bringing the source of sound or
activity for which the permit is sought into compliance with the provisions of this Ordinance would
constitute an unreasonable hardship on the applicant,the community or other persons that the adverse
effect they can also grant a permit.
Mr. Clark made the motion to issue permits to accept all the events listed (see attached), seconded
by Mr. Waiz and motion passes 3-0.

Eric Hedrick—request for street closure
Chief Hedrick indicated that a wedding September 21st will take place at the Fire Union Hall.
Request the closure for September 20 at 6 pm to set up tents and September 22 take tents down on 11th
Street,from Dutch to Mechanic. Local access will be allowed.
Mr. Clark made the motion to allow the road closure, second by Waiz and motion passes 3-0.
