AN ORDINANCE TO AMEND THE JEFFERSONVILLE ZONING ORDINANCE (2000-OR-61)
APPROVING UPDATES TO R1 AND R3 DEVELOPMENT STANDARDS AS RECOMMENDED IN THE
STAFF REPORT (A COPY OF WHICH IS ATTACHED AS EXHIBIT "A")
Whereas, THE JEFFERSONVILLE DEPARTMENT OF PLANNING AND ZONING, filed a
petition before the Jeffersonville Plan Commission to amend the Jeffersonville Zoning
Ordinance (2000-OR-61) approving updates to R1 and R3 Development Standards as
recommended in the staff report (a copy of which is attached as exhibit "A") and,
Whereas, on June 25, 2019 the Jeffersonville Plan Commission has certified its favorable
recommendation of the enactment of this proposed zoning ordinance amendment by
ordinance of this Common Council; and,
Whereas, this matter is now before the Common Council at its regular meeting after
certification of the proposed zoning ordinance amendment pursuant to the provisions of I.C.
36-7-4-608(f)(1); and,
Whereas, this Common Council has timely posted notice of its intent to consider the
proposed zoning ordinance amendment at the regular meeting scheduled for July 1, 2019; and,
Whereas, all interested persons having been given an opportunity to appear before this
Common Council and be heard regarding this matter as required by law.
Now, THEREFORE, BE IT ORDAINED by the Common Council of the City of Jeffersonville,
Indiana, that the Jeffersonville Zoning Ordinance (2000-OR-61) has been Amended to approve
updates to R1 and R3 Development Standards as recommended in the staff report.
This ordinance shall be in full force and effect upon its adoption.

CERTIFICATION OF FAVORABLE RECOMMENDATION OF PROPOSED
ORDINANCE REVISION
Whereas, the Jeffersonville Department of Planning & Zoning filed a petition
before the Jeffersonville Plan Commission to amend the City of Jeffersonville Zoning
Ordinance (2000-OR-61), approving updates to R1i 'R3 Development Standards as
recommended in the staff report (a copy of which is attached as Exhibit "A"); and,
Whereas, after proper notice by publication, the Jeffersonville Plan Commission
held a public hearing on the petition on June 25, 2019 and,
Whereas, at the conclusion of the hearing the Jeffersonville Plan Commission
voted by a majority vote of its entire membership to favorably recommend the proposed
amendment to the Jeffersonville Common Council,
IT IS THEREFORE CERTIFIED that on June 25, 2019, the Jeffersonville Plan
Commission favorably recommends that the Jeffersonville Common Council enact by
ordinance the proposed Jeffersonville Zoning Ordinance amendment as requested in
the petition of Jeffersonville Department of Planning & Zoning.

Proposed Changes to the Jeffersonville Zoning Ordinance
The Planning & Zoning Department has recommended the following amendments to the
City of Jeffersonville Zoning Ordinance. The update includes:
1. To amend the R1 District Development Standards for Side Yard Setback as
highlighted in exhibit A
2. To amend the R2 District Development Standards for Side Yard Setback as
highlighted in exhibit B
3. To amend the R3 District Development Standards for Side and Rear Yard
Setbacks as highlighted in exhibit C
R1, R2, R3 Update Overview.
The update will amend Articles 3.4, 3.6, and 3.8.
Article 3.4 sets the Side Yard Setback for Primary and Accessory Structures in R1
residential zones at 10% of the lot width. This "non-fixed" number causes a number of
problems in practice. For example, in the same subdivision you may have 70'-wide lots
and 100'-wide lots next to each other. One person gets to build their tool shed 7' from
the property line, while the neighbor has to build theirs 10' away. Staff recently
encountered an instance of a property where a shed needed to placed 14' from the
property line (essentially in the middle of the yard). The 10% standard also gets
complicated on cul-de-sacs, where lots are not square and staff has to do elaborate
calculations to determine what the average width of the lot is in order to determine the
setback.
Planning staff requests that the standard is changed to a set of fixed numbers like all
other residential districts. We specifically recomending the following:
• A 6' setback for the primary structure, and
• A 5' setback for all accessory structures (the same distance allowed for the rear
setback and 2' greater than the setback for (smaller) R2 properties).
• Changes are highlighted in Exhibit A as they will appear in the Zoning code once
adopted.

Article 3.6 sets the side setback for primary structures in R2 residential zones at 7'. We
would like this standard to be equal to or less than the standard for R1 as the minimum
lot sizes are smaller.
Planning staff recomends:
• Changing the setback for the primary structure to 6'-0"
• Setbacks for accessory structures will remain unchanged (currently 3').
• Changes are highlighted in Exhibit B as they will appear in the Zoning code once
adopted.
Article 3.8 sets the Side Setback for Accessory Structures in R3 residential zones at 5'.
R3 lots, by their nature, are often only 25 or 30' wide. Imposing such a large setback on
small narrow lots often makes it extremely problematic for owners of R3 properties to
construct an accessory structure without sacrificing their entire back yard. It seems
particularly unfair since city residents who live in larger-lot R2 subdivisions only have to
abide by a 3' setback.
Planning staff recomends:
• Implementing 2' side and rear setbacks for all accessory structures in R3
districts.
• Setbacks for primary structures will not change.
• Changes are highlighted in Exhibit A as they will appear in the Zoning code once
adopted.

NOTICE OF HEARING ON ORDINANCE TO AMEND THE CITY OF
JEFFERSONVILLE ZONING ORDINANCE (2000-OR-61) APPROVING
UPDATES TO RI AND R3 DEVELOPMENT STANDARDS AS
RECOMMENDED IN THE STAFF REPORT (A COPY OF WHICH IS

Notice is hereby given that the Jeffersonville Department of Planning and Zoning
has filed Ordinance with the Jeffersonville City Council, Jeffersonville, Indiana asking
for an amendment to the City of Jeffersonville zoning ordinance (2000-OR-61) approving
updates to RI and R3 development standards as recommended in the staff report (A copy
of which is attached as Exhibit"A").
A public hearing will be held on July 1, 2019 at 7:00 pm in the City Council
Chambers, 1St floor, City Hall, 500 Quartermaster Court, Room 101, Jeffersonville,
Indiana at which time and place all interested persons will be heard in reference to the
matters set out in said ordinance.
