APPROVAL OF THE PAYROLL: Mr. O'Brien made the motion to approve the payroll, seconded by Mr. Miles and motion passes 3-0. OLD BUSINESS: None NEW BUSINESS: Les Merkley/Sarah Green— Hearing on Notice of Determination of vicious/dangerous animal regarding Pit Bull Mix owned by Paul Eubanks Mr. Merkley—before you is the result of a matter before Animal control. On May 28, 2019 Animal Control determined a certain dog to be vicious and dangerous. The owner is Paul Eubanks and the result of that was from dog bites on May 12, 2019; May 11, 2018 and July 20 2017 and also complaints from May 31, 2017. Notice was sent to owner, Mr. Eubanks as a result of that Mr. Eubanks under the ordinance requested an appeal of the Animal Control's determination was a vicious and dangerous animal. On June 17, 2019 notice was sent to Mr. Eubanks certified mail in response for the appeal; and scheduling is for the hearing today. The matter before the Board is whether or not to confirm the Animal Control determination this is dangerous and vicious animal. Ms. Green, Animal Shelter Director, presented police reports regarding incidents with this dog and since it has been in our care almost two months it has acted viciously toward our staff. We determined with the history and severity of the last bite and that the dog continues lunging, growling, and hitting the kennel every time someone is near. Mr. Mike Ettel, Clark County Animal Control Officer and Mr. Ed White, City of Jeffersonville Animal Control Officer were both on the scene in Utica with the bit of the 13 year old girl. Mr. Ettel stated that Ms. Harbin who lives there brought the dog to us because she believed the dog was so vicious that he could get away from us and attach us (Mr. Ettel and Mr. White). Mr. White indicated that the three times he saw the dog; it lunges at you like he wants to tear you apart. I have been doing this for 19 years and feel if this dog is returned to a residential area and if the dog gets loose he will seriously injure or kill somebody. Jeffersonville Board of Public Works- Page 1 of 2 June 26, 2019 Mr. Eubanks stated the dog is a good dog and has been trained to project him and his family, as well as, his property and possessions. He had signs posted to beware of dog and no trespassing. The dog has been raise around other animal with no problems. Never acted like this and recently given birth to a litter of pups. Indicated the person who was bit was trespassing; that he was not present when this happened. The dog,"Reemy" is up to date on all her shots. The first event—the dog was provoked and broke her chain. He would like to bring the dog home. Mr. White—requested clarification of where home would be if the dog is returned? Mr. Eubanks- indicated that he has moved and is looking for a place in the county, currently living in Henryville (335 Vest Road). Mr. Ettel—there is no ordinance in the county regarding vicious animals; but protection of residents. Mr. Merkley—2016-OR-11 Animal Control has determine the dog, approximately three years old, is vicious and dangerous. The owner has 14 days to comply with confining the animal, post signs, registration, insurance, and pay outstanding fines; if this is all in compliance the dog is returned to owner. If not in compliance Animal Control can euthanize the animal. Or the Board can determine that the dog is not dangerous and vicious return dog to the owner, but fines are still owed. Mr. Miles stated that we support our staff's recommendation. Mr. Miles made the motion affirming Animal Control's determination that the dog, Reemy, is vicious and dangerous;that the owner shall have 14 days to compliance with 2016-OR-11 and pay outstanding fines as a requirement to have the dog returned; failure to comply with those terms Animal Control may depose of the dog as it deems appropriate, seconded by Mr. O'Brien and motion passes 3-0. Scott McVoy—request for approval of contract between Police Department and Ladyfingers Catering for the Police Awards Banquet in November. Asst Chief McVoy indicated funds are available in the budget. Mr. Miles made the motion to approve the contract, seconded by Mr. O'Brien and motion passes 3-0. Jerry Windell— Request for approval of street closure on Hemlock on Thursday,July 4, 2019 from 2:00 pm to 10:00 pm Mr. Windell indicated that the neighborhood would like to close one block of Hemlock between Cyprus and Tamarack again this year for a party. Police and Fire approve. Street to provide barricades. Mr. O'Brien made the motion to approve the street closure, seconded by Mr. Miles and motion passes 3-0. Clark Nickels/Ron Meredith—request for approval of road closure on Court Avenue between Meigs and Mechanic on Tuesday,July 2, 2019 from 7:00 am to 5:00 pm Mr. Nickels indicated this is necessary for a tap storm drain for the new school. Should only take one day, but if not they will cover the area with steel plates and re-open the next morning to finish. Total closure of all lanes. Mr. Miles made the motion to approve the road closure, seconded by Mr. O'Brien and motion passes 3-0.
