IN RE THE PETITION TO VACATE CERTAIN PLATTED EASEMENTS
ON SELLERS COURT AS RECORDED IN PLAT BOOK 6, PAGE 57,
JEFFERSONVILLE, CLARK COUNTY, INDIANA
WHEREAS, Petitioners, Jeffersonville Commons, LLC, a Kentucky limited liability company, and
Broadway, LLC, a Kentucky limited liability company, have filed a petition for the vacation of certain platted
Easements on Petitioners' property pursuant to the provisions of IC 36-7-3-12 and 36-7-3-16; and,
WHEREAS, such Petitioners have further caused a notice of public hearing on such petition before this
Council to be properly published in accordance with Indiana law; and,
WHEREAS, this Council having held such public hearing at the date and time as stated in such
published notification; and,
WHEREAS, the owners, other than Petitioners, of land that abuts the portion of the Easement to be
vacated have been identified and have been given notice of the Petition to Vacate and a notice of public hearing
on such petition pursuant to the provisions of IC 36-7-3-12.
NOW, THERFORE, BE IT ORDAINED BY THE COMMON COUNCIL FOR THE CITY OF
JEFFERSONVILLE, INDIANA, as follows:
1. The Common Council for the City of Jeffersonville,hereby finds all of the following:
a. The persons owning real property that is adjacent to or served by the Easement
have not objected to the vacation.
b. The proposed vacation will not hinder the growth or orderly development of the
City of Jeffersonville, Indiana.
b. The proposed vacation will not make access to the lands of any aggrieved person
by means of public way difficult or inconvenient.
c. The proposed vacation will not hinder the public's access to a church, school, or
other public building or place.
d. Vacating the Easement will not hinder any utility company's ability to provide

utility services to the residents in the surrounding area.
2. The Petitioners' petition for vacation of the Easements is hereby granted, and the Easements
within Jeffersonville's municipal boundaries are hereby vacated as depicted on attached Exhibit A and
described in attached Exhibit B.
3. The Petitioners shall cause a certified copy of this Ordinance to be recorded in the office of the
Recorder of Clark County, Indiana, in accordance with the provisions of Ind. Code § 36-7-3-12(e), and
thereafter shall file a recorded copy with the office of the Clerk- ettsttres of the City of Jeffersonville, Indiana.
4. This Ordinance shall be in force and effect upon its adoption.
So Ordained by majority vote of the entire membership of the City of Jeffersonville, Indiana at a

PETITION TO VACATE PLATTED EASEMENTS
Petitioners, Jeffersonville Commons, LLC, a Kentucky limited liability company,
'and Broadway, 'LLC; a Kentucky limited liability company, for its petition states as
follows:
1. Petitioners own Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, and part of 12 (the
"Property) of Seller's Court subdivision, as recorded in Plat Book 6, Page 57 in the Clark
County Recorder's Office, a copy of which is attached as Exhibit "A" hereto (hereinafter
referred to as "Seller's Court Plat"). Lots 1, 3, 5, 7, 8, 9, 10, 11, and 12 lie on the west
side of the street of Seller's Court. Lots 2, 4 and 6 lie on the east side of Seller's Court.
2. The Seller's Court Plat reflects the existence of two (2) 5-foot wide
easements along the east side and west side of Seller's Court subdivision (collectively,
the "Easements"). Easements are not in use and no longer needed. See letter attached as
Exhibit"C" from Harold L. Hart, P.E., P.L.S., of Hart Surveying&Engineering, LLC.
3. Petitioners desire to have the portion of the Easements that are located
within the Property vacated to facilitate the development of the Property.
4. Pursuant to the provisions of Indiana Code 36-7-3-12 and 36-7-3-16,
Petitioners seek the vacation of a portion of the Easements, as depicted on the Seller's
Court Plat attached hereto as Exhibit "A" and described by metes and bounds on Exhibit
"B" attached hereto.
5. Other than the Petitioners, there are three other owners of land that abut
the portion of the Easements proposed to be vacated herein. They are as follows:

6. Petitioners have further caused notice of the filing of this petition and the
scheduled hearing hereon to be published in The Evening News one (1) time at least ten
(10) days before the scheduled date of such hearing as required by Indiana Code 5-3-1-
2(b).
7. Petitioners ask that the proposed vacation of Easements be granted by
ordinance of the City of Jeffersonville.
WHEREFORE, Petitioners respectfully ask that the City of Jeffersonville
Common Council conduct a public hearing on this petition, and that following such
petition enact and adopt the ordinance vacating the specified Easements as requested
herein.

Re: Easement Vacations within Sellers Court
For the Development of Jeffersonville Commons
Dear Council,
As you are aware, Jeffersonville Commons is an ongoing development located on the northwest side of
Tenth Street just south of Interstate 265 interchange. As part of the development process, the developer
of Jeffersonville Commons is requesting that a portion of two existing 5-foot wide easements be vacated.
These easements were created as part of the Sellers Court Subdivision and the developer has acquired
title to several of these lots within said subdivision. As a result of new and existing plats as part of the
development, new easements have been created for the location of new utilities that serve the immediate
area.After a recent inspection of the area and having called Indiana Underground to mark any underground
utilities in the portions of the easements being requested to be vacated, I find no existing utilities within the
5-foot easements except for those portions of the easement where a "new" easement has already been
created.

NOTICE is hereby given that the petitioners, Jeffersonville Commons, LLC, and
Broadway, LLC, has filed with the Common Council of the City of Jeffersonville, Indiana, a
petition to vacate a portion of two 5-foot utility easements shown on the Plat for Sellers Court(Plat
Book 6, Page 57)in the City of Jeffersonville,Clark County,Indiana.The proposed easements to be
vacated are more particularly described as follows:
Easement 1:
That part of Lots 1, 3, 5, 7 through 11 and part of Lot 12 of Sellers Court
Subdivision, Plat Book 6, Page 57 in the Office of the Recorders, Clark County,
Indiana,being further described as follows:
Beginning at the south corner of said Lot 1; Thence along the southwest line of

business hours.
Notice is further given that a public hearing on the petition will be held by the City Council
at its regular meeting on May 20, 2019, at 7:00 o'clock p.m. (prevailing local time), in the City
Council Chambers on the First Floor of Jeffersonville City Hall, 500 Quartermaster Court,
Jeffersonville, Indiana. All interested persons shall be heard at such public hearing regarding the
matters set out in said petition.
