DOCKAGE AGREEMENT Between Rubaiyat Boat Harbor, herein called "Marina", and the
undersigned boat owner, and/or owner's agent, herein called "Owner".

*Living Aboard: $8.00 per foot per month*
(Owner is not entitled to refunds for shortened length of stay under any circumstances
whatsoever.)
*Per foot rates calculated will include additional charges for additions on front or back of
boats (Swim platforms, dingy boat, ladder, pulpit, etc.)
Slips will accommodate:

RUBAIYAT BOAT HARBOR DOCKAGE AGREEMENT
STANDARD TERMS AND CONDITIONS
1. This Agreement is for the use of dock space by the above owner and boat only, and such
space is to be used at the sole risk of the boat owner. This Agreement is not a bailment.
The Marina shall not be liable for the care or protection of the boat (including gear,
equipment and contents), personal injury to the Owner, his crew or guests, or for any loss
or damage of whatever kind or nature.
2. The Marina shall have a lien against the above described boat, her appurtenances and
contents for an unpaid sums due for the use of dock facilities, other services or for damage
caused or contributed to by the above described boat or by Owner to any docks or
property of Marina or any other person at the Marina.
3. Any Owner with an outstanding balance for charges at the Marina (for dockage, labor,
storage, materials, or any other services provided by Marina) that become due but are
unpaid for a period in excess of sixty (60) days shall be deemed to have abandoned the
above described boat. In such event, the Marina shall have the absolute right, at the
Owner's expense, to remove the boat from dockage and to perform any labor thereon
which may be required in order to place the abandoned boat in wet or dry storage. The
Marina shall have the right to immediately proceed with whatever legal remedies may be
available to recover any sums which may be owed in connection with an abandoned boat,
including but not limited to, the foreclosure of its lien rights.
4. Owner shall carry liability insurance on the above described boat with bodily injury and
property damage liability coverage with limits of no less than $500,000. Upon request,
Owner shall provide a copy of a Certificate of Insurance or a Declaration Page indicating
that Owner has complied with this paragraph. Uninsured boats are a danger to the entire
Marina and may be expelled from the Rubaiyat Boat Harbor without a refund.
5. OWNER INDEMNIFIES AND HOLDS THE MARINA HARMLESS AGAINST ANY LOSS, COSTS,
SUIT, OR CLAIM ARISING OUT OF THE USE OF DOCKAGE SPACE BY OWNER, ANY HANDLING
OF THE BOAT IN CONNECTION THEREWITH, AND ANY AND ALL PERSONAL INJURIES
SUFFERED OR ALEDGEDY SUFFERED BY OWNER, HIS CREW OR HIS GUESTS WHILE AT THE
MARINA.
6. This Agreement shall be in full force and effect during the term set forth under the Season
of Stay unless sooner terminated in accordance with one of the following conditions: (a) by
destruction of the Marina facilities by fire, storm, or other calamity; (b) in the event Owner
shall make a bona fide sale of the boat listed above; (c) by breach or default as provided in
this Agreement.
7. Owner agrees to comply with all posted rules and regulations as attached hereto, (or as
posted by the Marina) as fully as though they were set forth herein. Should breach of this
Agreement or an uncorrected violation of posted rules and regulations occur, this
Agreement shall terminate immediately, and the Marina may remove the boat from her
dockage space at the Owner's risk and expense and retake possession of the dockage
space. Such action will not entitle to Owner to any refund of dockage fees paid nor relieve
Owner of any liability for unpaid balances that are due or become due pursuant to this
Agreement. Page (3)
8. Owner is responsible for all electrical usage and shall be billed in accordance with electrical
meter usage. Electric Deposits shall be refunded in full upon the natural expiration of this
Agreement, unless outstanding electric charges or other charges are due.
9. Water service will not be provided after the first frost and during winter season.
10. In the event any portion of this Agreement shall be deemed to be in violation of any law of
the United States or any laws of the State of Indiana, said portion, and said portion, shall
be deemed null and void, and the balance of this Agreement shall remain in full force and
effect. This Agreement shall be interpreted in accordance with the laws of the State of
Indiana and laws of the United States. Waiver of any condition by the Marina shall not be
deemed to entitle Owner to a continuing waiver.
11. The Owner shall be responsible for and shall pay any and all reasonable attorney's fees
incurred in the enforcement of this Agreement, including any fees incurred at trial or
appeal, together with any costs and/or other charges incurred by the Marina in the
enforcement of this Agreement.
12. Additional services may be provided for additional fees as authorized by Owner and
agreed to by Marina.
13. The dock space is rented to the Owner as an individual and is not transferable in case
Owner's boat is sold, and Owner agrees not to switch dock space with any other boat
without first receiving authorization from the Marina.
14. The Marina will not assume any responsibility for any injuries to Owner, members of
Owner's family, Owner's crew or Owner's guests while on Marina premises or within the
boundaries of Marina property.
15. Owner agrees to keep the space allotted to him in a neat and orderly condition and free
from anything which is a fire hazard; to not place or store gasoline in the boat or docking
space above designated except that contained in the tank of the boat, and to not deliver or
permit others to deliver gasoline or other fuel into tank of the boat, and to not deliver or
permit others to deliver gasoline or other fuel into tank of the boat from tank trucks
directly or by any other method while said boat is in the docking space; and to at all times
comply with all local county, state, and federal laws and regulations including, but not
limited to, USCG , police, fire, and sanitary regulations.
16. The Marina will not be responsible for boats after they have been launched. It is the
responsibility of the Owner to assure that his boat is not taking on water. If it becomes
necessary for the Marina to put pumps aboard the boat, at the sole discretion of the
Marina, the Owner agrees to pay the cost thereof.
