HomeMy WebLinkAbout2003-R-04 2003-R- ~ RESOLUTION APPROVING AN AGREEMENT FOR PROFESSIONAL SERVICES WHEREAS, the Common Council of the City of Jeffersonville (the "Council") des~es to promote certain historic p~eservafion activities within the City of Jeffersonville; and WHEREAS, the Council desizes the services of a qualified preservation professional to serve as part-time staffperson to its Historic Preservation Commission; and WHEREAS, the Historic Landmarks Foundation of Indiana (the "Contractor" represents that it is qualified to render such services to the Council, and is a qualified professional as defined in 36 CFR 61 authorized by the National Historic Preservation Act of 1966 as amended (PL 89-665) and the National Historic Preservation Amendments Act of 1980 (PL 96-515); and WHEREAS, the Council believes it is in the best interest of the citizens and taxpayers of Jeffersonville that the City enter into a Contract with the Contractor to p<ovided the needed services to the Jeffersonville Historic Preservation Commission. NOW, THEREFORE, IT IS HEREBY RESOLVED that the Council approves and adopts the provisions of the Agreement Fo~ Professional Services attached hereto as Exhibit A and incorporated by reference herein. City of Jeffersonville 2 AGREEMENT FOR PROFESSIONAL SERVICES This agreement entered into this first day of January, 2003 by and between the City of Jeffersonville, State of Indiana, hereinafter referred to as the "Local Public Agency," and Historic Landmarks Foundation of Indiana, hereinafter referred to as the "Contractor." WITNESSETH: WHEREAS, the Local Public Agency desires to promote certain historic preservation activities within the City of Jeffersonville; and WHEREAS, the Local Public Agency desires the services of a qualified preservation professional ("Circuit Rider") to serve as part-time staff person to its Historic Preservation Commission; and, WHEREAS, the Contractor represents that it is qualified to render, such services to the Local Public Agency, and is a qualified professional as defined in 36 CFR 61 authorized by the National Historic Preservation Act of 1966 as amended (PL 89-665) and the National Historic Preservation Amendments Act of 1980 (PL 96-515); as defined in the scope of services below; NOW THEREFORE, the Local Public Agency and the Contractor agree as follows: 1. SCOPE OF SERVICES: The Contractor will coordinate the work of a Circuit Rider, who will perform the following services: · Develop guideline books for all districts · Recommend a work program to the Commission members and staff · Conduct training workshops for the Commission members and staff · Prepare material for and attend the Commission meetings as needed · Assist the Commission in establishing historic districts · Coordinate the C.O.A. process with the Jeffersonville Building Commissioner · Assist with the application for, and maintenance of, federal and state grants for special projects · As time permits: promote historic preservation generally within the community; provide technical assistance in such areas as National Register review and tax act projects; counsel building owners on restoration; provide information on preservation legislation. 2. RESPONSIBILITIES OF THE LOCAL PUBLIC AGENCY: The Local Public Agency will prepare minutes and agenda for all meetings. The Local Public Agency will assist and encourage the creation of neighborhood associations in conjunction with local designation efforts. 3. TIME OF PERFORMANCE AGREEMENT: This agreement commences January 1, 2003 and expires December 31, 2003. 4. COMPENSATION: The Local Public Agency will compensate the Contractor a total of four thousand dollars ($4,000.00) for services under this Agreement. 5. METHOD OF PAYMENT: Payment shall be made in two payments, subject to receipt of an invoice or voucher from the Contractor that services provided under this Agreement are being performed. The first payment shall be payable not later than March 31, 2003 and the second payment shall be payable not later than August 31, 2003. 6. NON-FEDERAL LABOR STANDARDS PROVISIONS: The following Labor Standards Provisions are applicable to the Agreement under State or Local law. The inclusion of the Labor Standards Provisions in this Agreement may not be construed to relieve the Contractor or any subcontractor from the pertinent requirements of any corresponding Federal Labor Standards Provisions concerning hours per day, per week, or per month that the employees engaged in the work covered by this Agreement may be required or permitted to work. Where the minimum rate of pay required under State or Local law is higher than the minimum rate of pay required or set forth in the Federal Labor Standards Provisions of this Agreement for corresponding classification, such State or Local minimum rates are the applicable minimum rates of pay for such classifications. 7. PROVISION FOR EXTENSION: This Agreement is subject to renewal upon agreement by both parties. 8. TERMS AND CONDITIONS: This Agreement is subject to and incorporates the provision of Part II - Terms and Conditions (Form H621-B, dated February 1969).
