BEFORE THE JEFFERSONVILLE REDEVELOPMENT COMMISSION
STATE OF INDIANA
A RESOLUTION AUTHORIZING COMMISSION PRESIDENT
TO EXECUTE AFFIDAVIT OF OWNERSHIP
WHEREAS,various restrictions have been recorded on certain real estate owned bythe Jeffersonville
Department of Redevelopment;and
WHEREAS, those restrictions are set forth in Deed dated November 21, 1962 recorded in Deed
Record 250,Page 150 and Deed dated September 8, 1993 recorded in Deed Drawer 25,Instrument 14858,and
Deed dated June 12, 1980 recorded in Deed Drawer 13, Instrument 1175, and Deed dated May 13, 1973
recorded in Deed Drawer 5, Instrument 5461 and Deed dated August 4, 1967 recorded in Deed Drawer 1,
Instrument 7058;and
WHEREAS, the aforementioned instruments are hereby attached as Exhibit "A" entitled "Deed
Restrictions";and
WHEREAS, the Commission desires to clarify that the real estate that is the subject of the
aforementioned instruments is still owned by the Jeffersonville Department of Redevelopment free and clear
of any encumbrances;and
NOW,THEREFORE,BE IT RESOLVED bythe Jeffersonville Redevelopment Commission that
it has no knowledge or notice of any party exercising any rights of claim of interest in the aforementioned
instruments;and
BE IT FUTHRE RESOLVED by the Jeffersonville Redevelopment Commission that its President
is hereby authorize to execute the attached Affidavit of Ownership ("Exhibit"B").

THIS INDENTURE WITNESSETH, that THE PENN CENTRAL CORPORATION,
a Pennsylvania corporation, having its principal office at One Fast Fourth Street, Cincinnati,
Ohio 45202, (hereinafter referred to as the Grantor), for and in consideration of the sum of
FIFTEEN THOUSAND DOLLARS ($15,000.00) - - - - paid to said Grantor, the receipt of
which sum is hereby acknowledged, quitclaims to THOMAS W. KEtVIPF, dba TWK

ALL THAT PARCEL of land situate in the City of Jeffersonville, County of Clark, State of
Indiana, being part of Block Number 108 in the Jeffersonville Assn. Enlargement of 1839, and
being that property of the former Cleveland, Cincinnati, Chicago and St. Louis Railway
Company (predecessor of said Grantor) further bounded and described according to a plan of
survey made by B. L. Fewell, Registered Land Surveyor No. 12931, dated July 29, 1977, as
follows:
BEGINNING at an iron pin at the intersection of the Fast line of Broadway and the North line
of Ninth Street; thence North 04° 32' East along said East line of Broadway, 360.0 feet to an
iron pin on the South line of Tenth Street (a.k.a. State Highway 62); thence South 85° 30' 40"
Fast along said South line of Tenth Street, 105.0 feet to an iron pin; thence South 04° 32' West,
360.0 feet to an iron pin on the North line of Ninth Street; thence North 85° 30' 40" West along
said North line of Ninth Street, 105 feet to the Point of Beginning.
CONTAINING 0.868 of an acre, more or less.
TOGETHER with all of Grantor's right, title and interest of, in and to the Railroad Bridges over
Ninth and Tenth Streets in said City of Jeffersonville, including superstructure, piers and
abutments thereof, whether on the land conveyed herein or within the right-of-way of said
streets. In the event that it should become necessary to remove the bridges, whether by
governmental agency demand or other cause, Grantee shall remove said bridges together with
all supporting abutments at no cost to Grantor.

premises conveyed herein that may be imposed after the date of this Deed by any governmental
agency having jurisdiction thereover.

2. That he is the President of the Jeffersonville Redevelopment Commission;
3. That he is aware of various restrictions have been recorded on certain real estate owned by
the Jeffersonville Department of Redevelopment;
