BEFORE THE COMMON COUNCIL OF
THE CITY OF JEFFERSONVILLE
ORDINANCE GRANTING PETITION TO VACATE PUBLIC WAYS
IN THE CITY OF JEFFERSONVILLE
Comes now Petitioners Commercial Logistics Corporation and the Clarksville
Redevelopment Commission, having heretofore filed their Petition to Vacate a Portion of a
platted alley and portions of Third Street, Fourth Street, and Fifth Street, Public Ways in the
City of Jeffersonville, which Petition is attached hereto as Exhibit A, and incorporated
herein by reference.
In support of this petition, the Petitioners state as follows:
a. Petitioners Commercial Logistics Corporation and Clarksville Redevelopment
Commission together own all of the property abutting the portion of the alley sought to be
vacated.
b. The proposed vacation of the alley will not hinder the growth or orderly
development of the City or the neighborhood in which it is located or to which it is contiguous.
c. The proposed vacation of the alley will not make access to the lands of any
persons by means of public way difficult or inconvenient.
d. The proposed vacation of the alley will not hinder the public's access to a church,
school, or other public building or place.
e. The proposed vacation of the alley will not hinder the use of a public way
by the neighborhood in which it is located or to which it is contiguous.
f. The 1938 Tax Maps already show Third and Fourth Streets as being
vacated and Fifth Street as being closed in these areas.
g. The proposed vacation of Third and Fifth Streets will only affect access to
petitioner Commercial Logistics' property, and it is willing to have such access restricted as
there are other access points to the property.
h. The proposed vacation of Fourth Street will allow development by Commercial
Logistics of the part of the street in their Deed that will go to it, and the balance of Fourth Street
that will go to the Clarksville Redevelopment Commission that will continue to be used as a
public road.
i. The alley of record parallel to Missouri Avenue and portions of Third Street,
Fourth Street, and Fifth Street, public ways in the City of Jeffersonville, Clark County, Indiana,
are unimproved.
j. The partial vacation of the alley of record parallel to Missouri Avenue and
portions of Third Street, Fourth Street, and Fifth Street, public ways in the City of Jeffersonville,
Clark County, Indiana, will clean up the chain of title of the subject properties.
WHEREFORE, the Council having examined and heard evidence on said petition and
being duly advised in the premises, now finds that said petition should be GRANTED .
NOW THEREFORE, IT IS HEREBY ORDAINED, by the Common Council of the
City of Jeffersonville, pursuant to the provisions of I.C. 36-7-3-12, that the public rights of way
located in the City of Jeffersonville, Clark County, Indiana, described and identified in the
attached Exhibit are hereby vacated to the adjoining property owners pursuant to Indiana law.
IT IS HEREBY FURTHER ORDAINED that the Clerk is hereby instructed to
record a copy of this Ordinance in the office of the Clark County Recorder and deliver a
copy of this Ordinance to the Clark County Auditor.
This Ordinance shall be in full force and effect from and after its adoption and
approval.

Comes now Petitioners, Commercial Logistics Corporation and Clarksville
Redevelopment Commission and hereby petition the City of Jeffersonville (hereinafter
referred to as the "City"), to vacate a portion of an alley of record parallel to Missouri
Avenue and portions of Third, Fourth, and Fifth Streets, and, in support hereof, would state as
follows:
1. Commercial Logistics Corporation is an Indiana corporation with principal offices
at 300 Missouri Avenue, Suite 102, Jeffersonville, Indiana 47130.
2. Clarksville Redevelopment Commission is a public entity created under Indiana
Code 36-7-14 with its principal office at 2000 Broadway, Clarksville, Indiana 47129.
3. Pursuant to the provisions of IND. CODE § 36-7-3-12, Petitioners seek the partial
vacation of an alley of record parallel to Missouri Avenue and portions of Third, Fourth, and
Fifth Streets, public ways in the City of Jeffersonville, Clark County, Indiana, as neither the alley
nor the sections of Third, Fourth, and Fifth Streets sought to be vacated any longer meets their

original purpose and is negatively affecting the surrounding properties. The area of the alley and
sections of Third, Fourth, and Fifth Streets proposed to be vacated are more particularly shown
on the plats attached hereto and incorporated herein as Exhibits "A" and "B".
4. The alley of record parallel to Missouri Avenue and portions of Third Street,
Fourth Street, and Fifth Street, public ways in the City of Jeffersonville, Clark County, Indiana
are unimproved.
5. Petitioners Commercial Logistics Corporation and Clarksville Redevelopment
Commission together own all of the property abutting the portion of the alley sought to be
vacated.
6. Petitioner Commercial Logistics Corporation owns all of the property abutting the
portions of Third and Fifth Streets which are sought to be vacated, and Commercial Logistics
Corporation and the Clarksville Redevelopment Commission together own all of the property
abutting the portion of Fourth Street sought to be vacated.
7. The partial vacation of the alley of record parallel to Missouri Avenue and
portions of Third, Fourth, and Fifth Streets, public ways in the City of Jeffersonville, Clark
County, Indiana, will clean up the title for the subject properties.
8. In support of the proposed vacation, Petitioners further affirmatively state their
good faith belief that:
a. The proposed vacations of the alley will not hinder the growth or orderly
development of the City or the neighborhood in which it is located or to which it is contiguous.
b. The proposed vacation of the alley will not make access to the lands of
any persons by means of public way difficult or inconvenient.

c. The proposed vacation of the alley will not hinder the public's access to a
church, school, or other public building or place.
d. The proposed vacation of the alley will not hinder the use of a public way
by the neighborhood in which it is located or to which it is contiguous.
e. The attached copies of the 1938 Tax Map shows Third Street and Fourth
Street as already being vacated and Fifth Street as closed in these areas.
f. The proposed vacation of Third and Fifth Streets will only affect access to
petitioner Commercial Logistics' property, and it is willing to have such access restricted as
there are other access points to the property.
g. The proposed vacation of Fourth Street will allow development by
Commercial Logistics of the part of the street in their Deed that will go to it, and the balance of
Fourth Street that will go to the Clarksville Redevelopment Commission will continue to be used
as a public road.
9. Petitioners appeared before and presented their request to the City of
Jeffersonville Board of Public Works on November 14, 2018, which gave its approval to the
requested vacations.
10. Petitioners have further caused notice of the filing of this Petition and the
scheduled hearing hereon to be published in The News and Tribune newspaper one (1) time at
least ten (10) days before the scheduled date of such hearing as required by IND. CODE § 5-3-1-
2(b).
WHEREFORE, petitioners, Commercial Logistics Corporation and Clarksville
Redevelopment Commission respectfully asks that the City Council of the City of Jeffersonville

Indiana, conduct a public hearing on this Petition, and that following such hearing, enact and
adopt an ordinance vacating the above-described alley, and portions of Third, Fourth, and Fifth
Streets as requested herein.
