HomeMy WebLinkAbout2018-OR-78 ORDINANCE NO. 2018-OR- /23' AN ORDINANCE TRANSFERING DORMANT FUNDS WHEREAS,the Finance Department for the City of Jeffersonville has determined that there are several funds which are considered dormant funds as they have been unused for an indefinite period of time; WHEREAS, Indiana Code 36-1-8-5 allows for these unused funds to be transferred to the City General Fund or Rainy Day Fund; NOW,THEREFORE, BE IT ORDAINED by the Common Council of the City of Jeffersonville, Indiana that the following funds shall be considered dormant and transferred accordingly: Fund # Fund Name Transfer to Fund # 203 Street Dept. I've tried to go on the State's website • review the cu - statute, but it's not working right now. The receipt would be posted to 391.3 according to the current City/Town manual. Stumler, CPA Indiana State Board of Accounts dstumler@sboafe.in.gov 1 A,v) ,A • • • ry ORDINANCE NO. /q - 6�-d 0 ORDINANCE ESTABLISHING THE JEFFERSONVILLE CITY ENGINEER EMERGENCY REPAIR & IMPROVEMENT NON-REVERTING FUND WHEREAS, the City Engineer's Department receives non-tax revenues from the sale of easements to utilities and from the use of city easements by utilities; and WHEREAS, the City Engineer's Department may have unexpended funds at the end of a fiscal year that would be available for use in later years; and WHEREAS, the City Engineer often is responsible for payment of unexpected emergency expenses incurred as a result of the breakdown of roads, curbs and other structures and improvements maintained by the City; and WHEREAS, the Common Council of the City of Jeffersonville ("the Council") wishes to make the non-tax revenues generated from utilities' use of City easements and from sale of easements to utilities, as well as appropriated but unexpended tax funds, available for payment of said unexpected emergency expenses; NOW, THEREFORE, BE IT ORDAINED that the Council hereby establishes a non- reverting fund for the purposes of receiving non-tax revenues generated from utilities' use of City easements and from sale of easements to utilities, as well as appropriated but unexpended tax funds, for payment of unexpected emergency expenses incurred as a result of the breakdown of sewer structures and other improvements maintained by the City. This fund shall be entitled the "City Engineer- Emergency Repair and Improvement Non-Reverting Fund" and monies shall be extended from this fund only upon the filing of a proper claim in issuance of a warrant for payment by the Clerk- Treasurer after approval by the Council. This fund shall be a non-reverting fund and all non-tax revenues generated from utilities' use of City easements and from sale of easements to utilities shall hereafter not be required to be received into the City's general fund. Passed and adopted this \'f‘) day of t Ut --- ,200G- Oniine Copy From C tyOfJeff..n t -RH ORDINANCE NO.2009-OR-12 ORDINANCE ESTABLISHING SERVICE CHARGES FOR FALSE ALARMS • REPORTED TO JEFFERSONVILLE FIRE DEPARTMENT WHEREAS,the City of Jeffersonville typically responds to fire alarms when notified by alarm companies and/or the public; and WHEREAS, many persons who are the owners of property where fire alarms are installed,are negligent and careless,regarding the use of those alarms; and WHEREAS,continuous false alarms lower the efficiency and prepared ness of the firemen of the Jeffersonville Fire Department,thereby causing persons with actual alarms or emergencies to be disadvantaged; and WHEREAS,experience has indicated that when persons are assessed penalties for reporting false alarms that the number of false alarms decrease dramatically. NOW,THEREFORE,BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE that no person, corporation,business,private and/or not for profit hospital,residential facility or other entity shall report a false alarm to the City of Jeffersonville Fire Department. "False alarm"means,in the case of a fire alarm, an alarm signal or recorded message indicating the presence of fire or excessive smoke or heat,when it fact no evidence exists upon inspection of the premises upon response to such alarm. Persons who report false alarms to the City of Jeffersonville Fire Department shall be fined as follows during any calendar year: (1)Three false alarms shall be allowed at no penalty to the property owner. (2)The fourth false alarm shall result in a$150.00 fine. (3)The 5th false alarm shall result in a$250.00 fine. (4)The 6th and all other subsequent false alarms shall result in a$350.00 fine Any company reporting an alarm as the agent for an alarm holder shall be jointly and severally liable for the payment of fines as outlined above. For the Fire Department,The Deputy Chief of the Jeffersonville Fire Department shall be in charge of tracking all reported false alarms to the Jeffersonville Fire Department. That upon the report of a false alarm the designated person above shall send notice to the offending property owner of the fine owed by the property owner in accordance to the above schedule of fines. The property owner shall have 14 days in which to pay the fine. Failure to pay the assessed fine shall result in the matter being filed in the Jeffersonville City Court. The property owner and/or alarm company would then be subject to court costs in addition to the appropriate fine above. All fines collected in violation of this ordinance and in response to false alarms responded to the Jeffersonville Fire Department shall be paid directly to the Jeffersonville Fire Department Non-reverting Fund. This Ordinance shall become effective thirty days after its passage upon its last reading.
