ORDINANCE 2018-OR-1 7
AN ORDINANCE CHANGING THE ZONING MAP DESIGNATION OF A
CERTAIN TRACT OF PROPERTY LOCATED AT 3207 COOPERS LANE AND
FULLY DESCRIBED IN ATTACHED EXHIBIT A FROM C2 TO R1
Whereas, Michael Hacker filed a petition before the Jeffersonville Plan Commission to
change the zoning map designation of the real property located at 3207 Coopers Lane and fully
described in the attached Exhibit A from C2-Medium to Large Scale Commercial to RI-Low
Density Residential and,
Whereas, on July 31, 2018 the Jeffersonville Plan Commission has certified its
favorable recommendation of the enactment of this proposed zoning map designation change
by ordinance of this Common Council; and,
Whereas, this matter is now before the Common Council at its regular meeting after
certification of the proposed change of zoning map designation pursuant to the provisions of I.C.
36-7-4-608(0(1); and,
Whereas, this Common Council has timely posted notice of its intent to consider the
proposed change of zoning map designation at the regular meeting scheduled for August 6,
2018; and,
Whereas, all interested persons having been given an opportunity to appear before this
Common Council and be heard regarding this matter as required by law.
Now, THEREFORE, BE IT ORDAINED by the Common Council of the City of
Jeffersonville, Indiana, that the zoning designation of the real property located at 3207 Coopers
Lane and fully described in the attached Exhibit A is hereby changed from C2-Medium to Large
Scale Commercial to R1-Low Density Residential.
IT IS FURTHER ORDAINED that the zoning map of the City of Jeffersonville shall be
amended to include such change.
This ordinance shall be in
full force and effect upon its adoption.

Whereas, Michael Hacker filed a petition before the Jeffersonville Plan
Commission to change the zoning designation of the property described in attached
Exhibit A (the "Property"), from C2 ; and,
Whereas, after proper notice by publication, the Jeffersonville Plan Commission
held a public hearing on the petition on July 31. 2018 ; and,
Whereas, at the conclusion of the hearing the Jeffersonville Plan Commission
voted by a majority vote of its entire membership to favorably/unfavorably/not
recommend the proposed change of zoning designation of the Property to the
Jeffersonville Common Council.
IT IS THEREFORE CERTIFIED that on July 31, 2018 , the
Jeffersonville Plan Commission Favorably Recommends that the Jeffersonville
Common Council enact by ordinance the proposed zoning designation change of the
property from C2 as requested in the petition of

Notice is hereby given that the City of Jeffersonville Plan Commission has filed
Ordinance with the Jeffersonville City Council, Jeffersonville, Indiana asking for a
change in the zoning map designation of a certain tract of property located at 3207
Coopers Lane and fully described in Exhibit A from C2-Medium to Large Scale General
Commercial to R1-Low Density Residential.
A public hearing will be held on August 6, 2018 at 7:00 p.m. in the City Council
Chambers, 1St floor, City Hall, 500 Quartermaster Court, Room 101, Jeffersonville,
Indiana at which time and place all interested persons will be heard in reference to the
matters set out in said ordinance.

Request for Minor Plat Approval
The applicant filed a Minor Plat application for approximately 12.85 acres of
property located at 3207 Coopers Ln. The applicant seeks subdivide the property
to create two lots. Where the subdivision is proposed is indicated approximately
by the dashed line in the Figure 1. One of these lots would be landlocked, but the
proposed plat includes a 30-foot access easement to be used to achieve access
to Coopers Lane. The applicant plans to build a single family home on the property
and has also filed a rezoning application.

These areas are reserved for the provision of outdoor recreational amenities
and/or the preservation of existing landscapes. Open space areas may consist of
heavily wooded, swampy, or otherwise environmentally sensitive areas. They may
also exist to preserve undeveloped floodplain and/or existing agricultural uses.
These open spaces promote healthy recreation, provide an escape from urban
landscapes and serve as a connection to our community's history. Open spaces
may also provide natural services, such as drainage control and air quality
improvements. As such, open spaces tend to increase property values within the
city. Open space may be intended for public use, especially as parks with trails,
playing fields, and other recreational spaces. Sometimes, however, they may
consist of a privately owned facility that may or may not be publicly accessible.
Additional uses that fall into this category include cemeteries, sport facilities, urban
parks/plazas and event facilities.

A Suburban Workplace is a form characterized by predominately industrial and
office uses where the buildings are set back from the street in a landscaped
setting. Suburban workplaces often contain a single large-scale use or cluster of
uses within a master planned development. New larger proposed industrial uses
are encouraged to apply for a planned development district.
Zoning
The subject property is currently zoned C2 (Medium to Large Scale General
Commercial), with a proposed zoning of R1 (Low Density Residential). Adjacent
properties to the East and South are a mix of different residential zoning districts
including R1 (Low Density), R2 (Medium Density), and M1 (Medium Density)
West and Northwest are also zoned R1 (Low Density Residential). Properties to
the North and West are zoned 11 (Light Industrial/Business Park) and Cl (Small
to Medium Scale General Commercial), respectively. Figure 2 illustrates the
zoning within the vicinity.
