Between: JEFFERSONVILLE RIVER STAGE (Purchaser) and VELCRO PYGMIES (Artist)
Purchaser so engages Crescent Moon Entertainment to contract said Artist for performance as stated by the
terms and conditions set forth below:

to CRESCENT MOON ENTERTAINMENT (federal tax ID number 62-1449253)
With balance due to artist of: Balance of $2,500.00 payable in cash(preferred)or check made payable to Cameron
Flener.

PAGE(2) OTHER TERMS:
Purchaser shall at all times have reasonable supervision,direction,and control over the services of Artist on this engagement.Purchaser shall be
liable for any and all damage and/or injury to Artist and/or Artist's equipment caused by either Purchaser or any person(s) attending the
engagement either as a guest,member,or employee of Purchaser or his/her organization,during the term of Purchasers engagement. Crescent
Moon Entertainment acts solely as an agent or consultant and assumes no liability or responsibility for the execution of the terms of this agreement.
Artist's obligations to perform are subject to detention or prevention by sickness,accident,riots,strikes,emergencies,epidemics,acts of God,any
act of public authority or any other cause,similar or dissimilar,beyond Artist's control. In such case there shall be no claim for damages by either
party to this contract If one of the above conditions exists. A comparable Artist may be substituted but no substitutions shall be made without the
authorization of Purchaser,which authorization shall not be unreasonably withheld.
If before the date of any scheduled performance It Is found that the Purchaser has not performed fully to its obligation under any other agreement
with any party for another engagement or that the financial credit of Purchaser has been impaired,the Artist may cancel this agreement. In the
event that the Purchaser does not perform fully all of it's obligations herein,the Artist shall have the option to perform or refuse to perform there
under,and in either event the Purchaser and the person signing for the Purchaser,jointly and severally shall be liable to the Mist and Agent for
the compensation provided herein including reasonable attorney's fees,courts costs and legal interest related to the collection thereof.
Artist shall not be required to perform outdoors if temperature is below 50 degrees,if there is a 50%or greater chance of rain,or if high winds or
standing water make performance unsafe for Artist. If any of these conditions exist and Purchaser has no suitable indoor location, Purchaser
agrees to pay Artist in full. If Artist has been instructed to set up outdoors and inclement weather prevents or interrupts performance,Purchaser
agrees to pay Artist in full.
Artist and Purchaser agree that Crescent Moon Entertainment has performed a valuable service to each of them and therefore agrees and
guarantees to Crescent Moon Entertainment that if Artist, their leader, manager, or representative accepts employment from Purchaser for a
period starting with the date this contract was made and ending thirteen(13)months from the performance date(play date)of this contract,Artist
and Purchaser will negotiate any such employment through Crescent Moon Entertainment. If in the event said employment is not negotiated
through Crescent Moon Entertainment as agent then it will be the responsibility of the Artist and the Purchaser,both jointly and individually,to pay
Crescent Moon Entertainment the usual and normal commission from said job.
Purchaser and Artist agree that the deposit paid is non-refundable in the event of a cancellation by Purchaser, and is paid to Agent in partial
consideration for its arranging the execution of this Agreement,regardless of whether the services contemplated herein are actually provided
and/or completed. In the event of cancellation of performance by Purchaser,Purchaser agrees to be liable for the entire amount of this contract.
This Agreement shall be governed by,and construed in accordance with,the laws of the State of Tennessee and the signatory hereby irrevocably
submit to the personal and subject matter jurisdiction of the courts of Tennessee sitting in and for the County of Davidson,for the purposes of the
resolution of any dispute or claim arising out of this agreement. The parties further agree that any dispute or claim in connection with this
Agreement shall be brought only in Davidson County,Tennessee.
Minimum Rider Requirements
The following constitutes the minimum acceptable requirements that Artist needs to perform.
This is not Intended to replace any additional riderlequirements that Artist may have provided
with this contract,
(1)Have a sturdy,level,dry stage OR a performance area(no bare ground)of at least 12'X 16'minimum dimensions for
Artist's use.Larger stages or performance areas are preferred when possible.
(2)Stage or performance area should be located as closely as possible to load-In area.If load-in requires an elevator,
stairs or more than 100'distance from load-in area to stage or performance area,Purchaser will notify Artist's agent in
advance so preparations can be made.
(3)Electricity:Supply 3 to 4,separate 20 amp power circuits of 110 volts AC,within 25 feet of stage or performance area.
(4)When possible,provide a private and secure dressing room for Artist's use.
(5)Provide Artist access to building at least 3 to 4 hours prior to starting time.
(6)Although not required(unless stipulated elsewhere),food and refreshments are always welcomed and appreciated by
the Artist.

Technical Requirements&Rider

Stage:
The Pygmies need a stage at least 2011 wide.16 feet deep,and 2 11 high.Bigler really is belle(for everybody
involved.The stage MUST be sturdy,and level,with no gaps,voids,or bodies of standing water. Stage,
wings,and sound booth must be on a level and stable surface lie...not mud,grass,or sand).If this isn't
possible please notify petefltzgerald(ryepbf.com immediately and ask if special arrangements can be made.
Power:
In order to safely operate their lighting,The Velcro Pygmies will need access to an electrical service panel
with a minimum of 100 amps available.This panel should be located AT THE STAGE,or within 1006 of the
stage and have 2"hots",a"common",and an"earth"ground.Please note.some venues require that a
qualified licensed electrician be present during the"tying"and"untying"of power.
Catering:
I case of Coors light, I six pack of Coca Cola,1 six pack of Mountain Dew, 12 bottled waters,3 bags of ice,
4 thin crust pepperoni pizzas. Drinks should be available during load in with food being delivered I hour
alter load in has begun.
Parking:
There must be parking for two cars and one 24 foot truck.These vehicles must be accessible at all times.
Merchandise:
The Velcro Pygmies will retain 100%of merchandise sales and are guaranteed the opportunity to sell it at the
show in an area adjacent to the stage if physically possible. Buyer agrees to provide at least one 6x3 table or
equivalent. Artist will staff this area and handle all merch money
Access to loading and performance area:
Performance area must be accessible to a 24 foot long 13 foot high truck.Truck needs to be within 10 l,'et of
entrance to performance area.Truck must be able to be unloaded onto a smooth hard surface.Grass,sand,
gravel,aggregate,brick,and dirt rue not acceptable.II-loading area is not on a hard surface,a plywood
pathway must be laid down from loading area to performance area.Doorways must be a minimum of 30
inches wide. NO STAIRS in excess of three steps. In the absence of these conditions Purchaser agrees to
provide four sober persons to load in AND out.
Weather:
The Velcro Pygmies LOVE to play outdoors but there are some limits. If the temperature is below 55
degrees they can't physically do. Just can't. Also,if the chance of rain is more than 50%the band will not
be required to set up outdoors. If they DO set up and it becomes unsafe due to ruin or especially lightning,
the band must stop the show until it clears up and there has been no lightning for 45 minutes. Nobody works
harder than The Velcro Pygmies do to make a show happen but bad weather trumps everything
1'enue Representative:
Buyer should provide contact information for a duly authorized representative.This person should be able to
answer specific questions concerning access and set up.
Drum Screens:
Under no circumstance will The Velcro Pygmies use a drum screen,or any similar device that restricts
interaction between drummer and other band members.even in mit attempt to contain volume
Extra Playing Time:
Occasionally three hours of Velcro Pygmies just isn't enough. If you find yourself in that position but you're
afraid to ask how much it will cost, here you go: The Velcro Pygmies will perform extra time,in half hour
blocks,for 50%ofa pro rata amount. To be clear,an extra hour of an engagement with u gross price of
S 10.000 would be 51.666.66(gross price divided by three hours equals 53.333.33.times 50%equals
S 1666.66). Don't make it awkward for the guys,write the check when you ask!
Opening Acts:
No opening acts arc allowed without WRITTEN and PRIOR approval from the band or management. This is
a big deal as any opening act requires much prior coordination. Don't try It!!
